Capicotto, Consulting Engineer vc'4741 [CO Nancy Seligson, Liaison dJ 4 - ocur Stephanie Poli, Public Stenographers kk Terranova, Kazazes & Associates, Ltd. 9 4040 Eighth Street New Rochelle, New York 10801 Marguerite Roma, Recording Secretary 410 CALL TO ORDER The meeting was called to order by Chairwoman Marilyn Reader at 8:15 p.m. APPROVAL OF MINUTES Ms. Reader said that the Board still has to vote on the Minutes of the January 10, 2001 Planning Board meeting. After some discussion, Ms. Reader tabled the January 10, 2001 review for another month. She said she had a few comments, and will give the secretary those changes for that meeting. Ms. Reader asked if the Board members had reviewed the draft Minutes of February 14,2001 and if there were any amendments. After some discussion and a few amendments noted, on a motion made by Ms. Aisen, seconded by Dr. Mason, the Minutes were unanimously approved. The Public Stenographer was present for this meeting and her transcript will become a permanent part of this record. Chairperson Reader read the application as follows: PUBLIC HEARING- FRESHWATER WETLANDS AND WATER COURSES PERMIT-Anthony DiMaggio- 15 Briarcliff Road - Block 220, Lot 215 On a motion made and, seconded, it was unanimously RESOLVED, that the Public Hearing be, and hereby is, declared open. (110 Benedict Salanitro, the engineer working for the DiMaggio's, addressed the Board. He stated they were before the Board in January, 2001 on a preliminary conference for the proposed addition located in the flood plain area on Briarcliff Road. He said that the plan is basically the same as originally proposed,with the exception of the inclusion of the comments from the Coastal Zone Management Commission's(CZMC) request for future consideration of the drywell and the paving of the driveway. The plan was submitted Planning Board March 14,2001 Page 2 yesterday to the Town Engineer for his review and approval. Mr. Salanitro had made and distributed copies for Board review,marked exhibit 1. Ms.Reader said to make sure she is on the same page as Mr.Salanitro since he met with the CZMC,she asked if he has made a revision of the plans to include an additional drywell from what was previously submitted to the Board and asked if that's what he is about to handout. Mr.Salanitro said that is correct. Ms.Reader thanked Mr.Salanitro. Mr.Salanitro said the project consists of a rear two-story addition,approximately 600 sq.ft.in terms of footprint. The provisions of the site plan include the installation of erosion control measures during construction and the installation of a subsurface disposal system for the drainage as well as the most recent revision dated yesterday,March 13,2001,which includes and incorporates the drywell and trench drain to incorporate any future paving of the driveway. He said that is basically to incorporate the comments of the CZMC. He said he will be happy to answer any questions the Board may have. Dr.Mason said he noticed Mr.Salanitro provided a hatch cover for...inaudible. He asked how that is indicated on the surface. Mr.Salanitro said it will be below grade,approximately 6 inches as he indicated to the CZMC. That it is below grade,it's buried and typically it's metal so it can be located on a magnetometer. He said you Qwant it below grade,because you don't want to hit the surface. Ms.Reader said he has the drywell 6 inches below the surface and said there will be a ground cover over it,which Mr.Salanitro said is correct. It's buried in place. Ms.Reader asked how the water gets into it. Mr.Salanitro said the water gets into it by piping. It's a direct pipe from the leader system of the house to it and it disperses through the ground and the gravel. Ms.Reader said it works like a drywell. Dr.Mason said he was curious because it uses a similar situation with a septic system...inaudible. Mr.Salanitro said a lot of times they are buried as well. They have to offset points where they have to excavate,remove the topsoil and get down there. The reason for it is because nobody wants to see a slab of concrete on the surface. They have indicative markers that are on the surface and typically there is a plan someplace that the owner should have which indicates the offset at that point,so it can be gotten to. Ms.Reader said they have one drywell that was original at the rear of the house. Mr.Salanitro said that is correct. The rear of the house has one drywell. Ms.Reader said he wants a second one that he will be putting in near the driveway. Mr.Salanitro said that is correct. It is strictly to take care of the water runoff from the driveway. Ms.Harrington said she is curious. These drywells--what's the average span of time before they have to be maintained. She said eventually they get plugged. Mr.Salanitro said there is a 25%clogging factor that's incorporated in the design. Typically you can get a good ten (10) years where it's always recommended that you try to access it and remove any • Planning Board March 14,2001 Page 3 0 sedimentation that's built-up in it. However,if the water is clean and there are screens on the gutters,this is fresh water,there is no indirect contact to this facility other than rainwater. Whatever the leaders and gutters are collecting,is what's going to be dispensed into the system. If you have leaves that eventually get flushed down,that obviously will biodegrade and develop into mass which at sometime should be removed. Ms.Harrington said also the little budding on the trees. Mr.Salanitro said it's all those little things. He reiterated there is a 25%clogging factor already included in the design and they already reduced that for future clogging that may occur. In ten(10)years,there is probably no reaching it,but that is normally what you would want to see happen. The first indication of it you will see is that the leaders start to back up,just like a septic system typically. It may go a little longer than ten(10). Dr.Mason asked if gravel is not the fabric. Mr.Salanitro said they have filter fabric wrapped around the 12 inches of gravel around the diameter, except for the base which is a typical detail. Ms.Reader said so the fabric is a screen. Mr. Salanitro said that is correct. What you want the water to do is exfiltrate and you don't want to infiltrate any of the findings into the gravel. That's just another permeable surface for it to work and to © screen any findings. Ms.Reader said she would figure whatever leaves you find or whatever,would ultimately decompose in the sewer. Mr.Salanitro said that's right. He asked if there were any questions from the public or anyone else. Ms.Reader asked if anyone in the audience wished to speak on this project. There being no one that wished to speak,she then asked if the Board or the professional staff,Mr.Capicotto,wished to speak on this project or had any recommendations. Ms.Reader said there is a letter dated March 14,2001 in which Mr. Capicotto had indicated that he reviewed the new plans and that the calculations include the second drywell in the front lawn with a trench drain to collect runoff from the driveway. The calculations were reviewed and the drywell is sized to accept all the stormwater flow from the driveway,assuming it was paved. Mr.Capicotto said last month they put together the Freshwater Wetlands letter dated February 14,2001, that said it is in compliance with the Freshwater Wetlands Law. Ms.Reader asked if there was anything else. Ms.Reader said it says the plans do comply with CZMC's recommendations and account for the enhanced impervious land/ground if the driveway is asphalt. She asked if Mr.Salanitro saw the letter from Mr.Capicotto. Mr.Salanitro said he did not see the letter,but had spoken to him. Mr.Capicotto gave Mr.Salanitro a copy of the letter. On a motion made by Dr.Mason,seconded by Ms.Aisen,it was unanimously RESOLVED,that the Public Hearing be,and hereby is,declared closed. Planning Board March 14,2001 Page 4 Ms.Reader that this is a Type II action having no significant impact on the environment pursuant to 6 NYCRR§617 et seq. Accordingly,no further action under SEQRA is required. Ms. Reader then asked for a motion to approve this application. On a motion made by Dr.Mason, seconded by Mr.Cohen the following resolution was adopted: WHEREAS,Anthony DiMaggio has applied for a permit pursuant to Mamaroneck Town Code Chapter 114 for the premises located at Lot No.15 Briarcliff Road and known on the Tax Assessment Map of the Town of Mamaroneck as Block 220,Lot 215;and WHEREAS,this Planning Board has previously determined that the proposed action is a Type II action and that no further review is required under SEQRA;and WHEREAS, the Consulting Engineer to the Town has submitted a letter to the Planning Board dated February 14,2001 indicating that the project meets the criteria contained in the Freshwater Wetlands Law. Thereafter,the Town Coastal Zone Management Commission recommended that the project's drainage system be designed to account for the increased impervious surface that would be created if the existing gravel driveway were to be paved. By letter dated March 14,2001,the Town's Consulting Engineer, Dolph Rotfeld,indicated that the proposed trench drain and dry well,shown on the revised plans dated March 13,2001,are sized to accept all the storm water flow from the driveway were it to be paved;and WHEREAS,this Planning Board has determined,pursuant to Mamaroneck Town Code Chapter 114,that the activity proposed is of a minor nature and is compatible pursuant to 6 NYCRR§665.7; WHEREAS,a Public Hearing pursuant to Mamaroneck Town Code Chapter 114 having been held on February 14,2001 and March 14,2001; NOW,THEREFORE,BE IT RESOLVED,that this Board makes findings as follows: 1. The activity proposed is of such a minor nature as not to affect or endanger the balance of systems in a controlled area; 2. The proposed activity will be compatible with the preservation, protection and conservation of the wetland and its benefits,because(A)the proposed activity will have only a minor impact,(B)it is the only practical alternative,and(C)it is compatible with the economic and social needs of the community and will not impose an economic or social burden on the community; 3. The proposed activity will result in no more than insubstantial degradation to,or loss of any part of the wetland because of the minor impact of the activity and the protective conditions imposed by this resolution; 4. The proposed activity will be compatible with the public health and welfare,because of its minor impact in the controlled area; BE IT FURTHER RESOLVED, that the application of Anthony DiMaggio for a permit,pursuant to Mamaroneck Town Code Chapter 114,be and it hereby is granted subject to the following terms and conditions: © 1. This permit is personal to the applicant and may not be transferred to any other individual,entity or combination thereof; Planning Board March 14,2001 Page 5 2. All debris is to be removed prior to the completion of the project. Construction must be in accordance with the requirements of the Town Flood Damage Prevention Code and the Town Erosion and Sedimentation Control Law. 3. Work involving site preparation shall only take place from Monday through Friday between the hours of 8:30 a.m.and 4:30 p.m. 4. A cash deposit or bond for$1,500.00 shall be furnished to the Town by the applicant to ensure the satisfactory completion of the project and the rehabilitation of the affected or disturbed arm. 5. This permit shall expire upon completion of the proposed activity or one year from the date of its issue whichever first occurs. Ms.Reader thanked Mr.Salanitro for his cooperation,was sorry about the confusion and wished Mr. Salanitro good luck with the project. NEXT MEETING The next meeting of this Board will be held on April 11,2001. Ms.Harrington said she will not be able to attend that meeting. OTHER BUSINESS © Mr.Carpaneto introduced the Town's new Environmental Coordinator,Elizabeth Paul.
