RECESSED T;FFTING OF THE TOWT BOARD
TOWIT OF MAMARONECK, NEW YORK
HELD DECFW_BER 30TH, 1933.
At the Town Offices, 118 West Boston Post Road, Mamaroneck, TT. Y.
The meeting was called to order by Supervisor Burton at
2:30 P. 191.
Present : Supervisor Burton
Justices Boyd, Leeds, blessersmith and Burbank
Town Clerk Yarvin
The presence was also noted of Superintendent Coles.
The Clerk reported to the Board, that in accordance with
instructions given him at the meeting on December 29th, he had obtained
binders on all insurance policies of the town expiring December 31st,
or January Ist whereby these policies would be extended so as to
protect the town against any possible loss until new policies could be
written by the incoming administration.
Mr. William F. Edwards, Chairman of the Board of Park
Commissioners presented a report on the activities of the Park Commission
for the first ten months of 1933, during which period he was the sole
member of the Board of Park Commissioners. The report was ordered
filed with the Town Clerk.
Ifr. Edwards addressed the Board and stated that his nine years
of service as a member of the Park Commission would expire on January
9, 1934. He thanked the Board for its cooperation during all these
years and offered his cooperation to the new members of the Park
Commission whoever they might be.
I1r.. H. Id. Whitaker addressed the Board in regard to a claim
for rent supplied on the order of the Welfare Department.
After discussion, the following resolution was moved by Justice
Messersmith and seconded by Justice Boyd :
RESOLVED, that the claim of H. ILT. Whitaker above
described be and it hereby is approved, subject
to endorsement thereon by Public �ffelfare Officer
DeVinne, that he investigated the claim and that
he finds the case one suitable for public welfare.
follows: A vote being taken upon the foregoing resolution resulted as
Ayes : Burton, Boyd, Leeds, I1lessersmith and Burbank
Noes : Narvin
A claim was received from Nfrs. ,Geraldine O 'Donnell in the
amount of $11.50 for services rendered as temporary office assistant
in c,..onnection with the preparation of the 1934 budget estimates.
Upon motion made and seconded, the claim was upon roll
call unanimously ordered approved and paid.
Superintendent Coles advised the Board that the action taken
by the Board at its meeting on December 29th in referring; the request
Bern rd L vin a, 385 Weaver Street, concerning his property linen
�f o the new own Soar , would result in some delay to ISr. Levino owing to
the time required to institute and complete abandonment proceedings.
He suggested that as a temporary measure the Board grant an easement to
Yr., Levino covering the area in question, pending the completion of
the abandonment proceedings.
Upon motion of Justice Messersmith, seconded by Justice Boyd,
it was upon roll call unanimously
RESOLVED, WKTPFAS, the Town heretofore widened, improved
and reconstructed Weaver Street in the Town of Mamaroneck,
and
WHTREAS in connection with said improvement it acquired
from LeVino two parcels of land on the northerly side of
Weaver Street -® one at the northwesterly corner of the
_._ property owned by LeVino and another at the easterly
corner of said property, which said property was used in
connection with the new line of I+Deaver Street, and
971TREAS in connection with said purchase made by the
Town it was understood and agreed between the parties
hereto that the Town would deed and/or give an easement
to LeVino to that piece or portion of land between the
old line of Weaver Street and the outside or Weaver Street
face of the new wall which was constructed by the Town on
the new line of Weaver Street, which piece or parcel of
land was located between the two parcels purchased by the
Town and along which there was an old wall, which wall was
taken down by the Town and a new wall constructed along
the new line of Weaver Street, the erection of which new
wall created a strip of land between the old line of Weaver
Street and the new line of Weaver Street in front of the said
LeVino *s property, and
H7PREAS LeVino deeded the aforesaid parcels of land to
the Town but the Town has never deechior granted an easement
to the aforesaid parcel of land to LeVino as hereinbefore
agreed,
NOW, THL'RFFORE, BE IT RESOLVED,. that the Supervisor be
and he hereby is authorized, embowered and directed to
execute and deliver to Bernard LeVino et ux of 385 Weaver
Street, Town of Mamaroneck, a quit claim deed or an easement
to that portion of Weaver Street in front of his property
known as 385 Weaver Street in the Town of Mamaroneck,
Westchester County, New York, between the old line of
Weaver Street and the outside or Weaver Street face of
the new stone wall constructed by the Town on the new line
of Weaver Street, i.e, that portion of land between the
two parcels heretofore purchased by the Town from LeVino
located between the old line and the new line.
The Supervisor advised the Board that Messrs. Donofrio and
D&Falco, the Contractors to whom the garbage contract for the next
two years has been awarded, were =pilling to post a bond or guaranty
of $15000, cash in lieu of the $5,000.00 Surety Company performance
bond called for in the contract and also to post as additional guaranty
the payment due them under the terns of the contract for the first
month's work.
Upon motion by Justice Burbank, seconded by Justice Boyd,
it was upon roil call unanimously
RESOLVED, that the offer of Messrs. Donofrio and
DeFalco, the new arbage contractors, to post a
guaranty bond of 1,000.00 cash plus the payment
to be made to them by the Town for the first month's
work, under the terms of the contract, in lieu of
the $5,000. Surety Company performance bond called
for by the contract, be and it hereby is approved
and accepted subject to the approval by Counsel
as to legali�y; and be it furt'der
RESOLVED, that this matter be referred to the Supervisor
and Counsel with power to attend to all necessary details
and to execute such papers as may be necessary in connec-
tion therewith.
The contractors thereupon delivered to the Clerk a certified
check in the amount of $x600.00, which, with the $ 400.00 cash deposit
made at the time of submitting bids and already in the possession of
the Clerk, totalled $1,000.00 called for in the plan above described.
A copy of a letter dated December 30th addressed to Supervisor -
elect McCulloch was received from the Supervisor, itemizing the funds
on hand to the credit of the Town of Mamaroneck as of December:3091933
and specifying the banks in which these funds were on deposit. The
letter was ordered received and placed on file.
A report dated December 27th addressed to the Supervisor was
received from the Board of Sewer Commissioners of Sewer District No. 18
covering its activities for the year 1933. The report was ordered
received and placed on file.
The Supervisor addressed the Board and stated that in closing
18 years of service as Supervisor, he desired to express his "sincere
appreciation to all associated with him in the town government. " "To
some degree , I will mism the association in this office." he declared,
but felt the administration deserved credit at the hands of the people
of the Town of Mamaroneck.
Justice Boyd stated that he had been a member of the Town
Board for 44 years and 9 months and that his associatiors had always been
pleasant. "I have been with Supervisor Burton over 18 years and I have
always tried to work for the entire town and not for one section of it.
I with to thank all the members of the Board for the courteous way they
have always treated me. So endeth the lesson. "
Justice Messcrsmith expressed his appreciation of the consider-
ation shown him at such times as he has raised various questions. "To
work on the Town Board has been a good and liberal education," he said.
Jay H. Van Harden, Veteran Relief Officer addressed the Board
and thanked it "for the splendid and humane way in which it permitted
me to care for 190 Veterans. " On behalf of the Veterans, he expressed
appreciation for the work of the Town Board.
Justice Burbank declared it had been a pleasure for him to be
associated with the Town Board. He paid his personal respects to the
Supervisor, and stated that "no question of the Supervisor 's integrity
has been raised in all the political upheavals of late. "
Justice Leeds stated : "I am very, very sorry for you, Mr.
Supervisor, that you listened to the calamity howlers who induced you
not to run this year. "
The Clerk expressed his appreciation of having an opportunity
to learn about politics and municipal administration from an exper-
ienced public official like Supervisor Burton and he expressed his thanks
to the Board for the consideration shown him.
Supervisor Burton expressed once more his appreciation of the
work done by Superintendent of Highways John L. Coles.
At 3 ;10 P. M. the Board unanimously resolved to adjourn sine die.
