TOWN OF MAMARONECK, NEW YORE
HELD DEMMER 23RD, 1933.
At the Town Offices , 118 Nest Boston Post Road, Mamaroneck , N.Y.
The meeting was called to order by Supervisor Burton at
10 ,50 A. Td.
Present: Supervisor Burton
Justices Leeds, Messersmith and Burbank
Deputy Town Clerk Jacobs
The presence was also noted of Counselor Gamble, Supervisor-
elect KcCulloch and Councilman-elect Ileginniss.
The Board took up the matter of bids for collecting garbage ,
etc. for Districts No. 1 and No. 2, which matter had been laid over at
a previous meeting.
Upon motion by Justice Messersmith, seconded by Justice
Burbank, the following resolution was presented,
RESOLVED, that Estimates 1B and ID in the bids for
District No. 1, being the additional amount, if any,
to be paid for daily collection instead of three times
a week from buildings in the business and apartment house
areas, be and they hereby are eliminated.
A vote being taken upon the foregoing resolution resulted as
follows,
Ayes : Burton, Vessersmith, Burbank
Noes, Leeds
Upon motion by Justice Burbank, seconded by Justice Messersmith,
it was upon roll call unanimously
RESOL`M, that the contracts for removal and disposal
of swill, garbage and ashes in the Districts in the-
Town of Mamaroneck known as (1) Fire Lighting and water
Supply District No. 1 and (2) Fire District No. 21
respectively, be awarded to the low bidders DONOFRIO &
DIFALCO, of New York, at the bid price for the period
of two years, namely (1) $20,800. for Fire Lighting and
Water Supply District No. 1 and (2) $1200. for Fire
District No. 25 respectively, with the option on the
part" of the Town to cancel either or both of said contracts
on July 1, 19340 upon giving ninety days prior notice of
said intention to cancel and/or with the option to cancel
either or both of said contracts at the end of any three
months thereafter, upon giving ninety days prior notice
of said intention to cancel, and
BE IT FURTHER RESOL=, that Counsel be and he hereby is
authorized and directed to dt-aw up suitable contracts
covering the award of the above contracts and that the
- Supervisor be authorized to execute the same in the name
of the Town.
The Clerk was upon roll call unanimously authorized to return
to the unsuccessful bidders their bid checks.
A petition was received from the yamaroneck Free Library
requesting an apportionment of certain taxes on property now owned by
the Library. The matter was ordered referred to Counsel.

The Clerk presented and read a letter dated December 22, 1933,
from Supervisor-elect Bert C. McCulloch, requesting this Board to adopt
a resolution fixing the bonds of certain Town Officers , which letter the
Clerk read and is as follows:

Section 25 of the new Town Law requires the Supervisor, the
Town Clerk and the Receiver of Taxes and Assessments to file in the
office of the County Clerk an official undertaking, conditioned fur the
faithful performance of his duties, in such form, in such sum and with
such sureties as the Town Board shall direct and approve.
The undertaking of the Supervisor must be further conditioned
that he will well and truly keep, pay over and account for all moneys
and property, including the local school funds, if any, belonging to
his Town and coming into his hands as such Supervisor.
I request that your Board, at its next meeting, pass a resolu-
tion fixing the new Supervisor 's bond in the sum of $25,000. the bond of
the Receiver of Taxes in the sum of x$,050,000. and that of the Town Clerk
in the sum of 81,000. and that the resolution provide that a qualifying
bond for the four newly elected Councilmen be not required.
I further request that the resolution provide that such bonds
be executed by the Fidelity & Casualty Company of New York.
I further request that you fix the bond of the Supervisor under
Section 29, securing to the Town the safety of town funds deposited by him
in or with the First National Bank of Mt. Vernon, and indemnifying the
Town against loss there:, in the sum of $759,000. and that this bond may
be furnished by the Fidelity & Casualty Company of New York, or any like
responsible Company.
The resolution should further provide that the premiums upon
all these bonds be a Town charge.
These requests have the approval of a majority of my Board.

Supervisor-elect McCulloch, who was present at the meeting,
stated that the new Board had discussed this matter of bonds for the new
Town Officers, aid as Section 25 of the Town Law provided for the taking
of an oath, aw well as the filing of bonds in the office of the Clerk of
westclaester County, he desired this Board to pass the necessary resolu-
tions so that the bonds might be procured, approved and filed in the
office of the County Clerk of Westchester County prior to January lst,
when said respective officers took office, and which action was necessary
prior to their qualifying. He stated that the new Board intended to
ratify the amount of these various bonds at their first meeting.
Upon motion of Justice Meseersmith, seconded by Justice Burbank,
it was
RESOIV='D that W?ITRE'AS this Board has received a
request from Supervisor-elect HcCulloch that the
bonds of certain officers of the Town who will take
office on January let, 1934, be fixed, that pursuant to
Section 25 of the new Town Law the bonds of the follow-
ing respective Town Officers be fixed in the amount set
opposite said respective offices :
Supervisor $252000.00
Receiver of Taxes and Assessments 50,000.00
Town Clerk 1,000.00
Four Councilmen None
FURTHER RESOLVED. that said officers be and they hereby
are authorized, empowered and directed to execute and
file bonds in the said respective amounts and file the
same in the office of the Clerk of the County of Westchester,
said bonds b eing conditioned for the faithful performance
of his respective duties and further conditioned that each
will well and truly keep, pay over and account for all
moneys and property (and in the case of the Supervisor
including local school funds) belonging to the Town and
coming into their respective hands as such officers;
FURTHER RESOLVED, that the bond of the Supervisor-elect
under Section 29 of the new Town Law, securing to the
Town the safety of Town funds deposited by the Super-
visor in or with the First National Bank of Idt. Vernon,
New York, and indemnifying the Town against loss thereof
be fixed in the sum of $751000]
FURTHER RESOLVED, that in accordance with the request of
the Supervisor-elect, said bonds be procured from the
Fidelity and Casualty Company of New York or some equally
fesponsible surety company authorized to do business in
the State of New York;
FURTHER RESOLVED, that the cost and expense of procuring
said bonds shall be a proper charge against the Town.
The Board then resumed its discussion of the budget estimates
for the year 1934.
At 4 F. M. the Board resolved to adjourn to meet again on
December 26th, at 10 A. M. xx
