The meeting was called to order by Supervisor Burton at — 2 P. Y. Present : Supervisor Burton Justices Boyd, Leeds, Messersmith and Durbank Town Clerk Marvin The presence was also noted of Counselor Gamble , Supervisor- elect McCulloch and Councilmen `elect Ueginniss and Griffin. Justice Yessersmith reported to the Board that he had con- ferred with Special Counselor J. Henry Esser in regard to the Lanza defalcation matter as provided for at the meeting on December 16th and that he recommended the acceptance of the offers of the surety companies as outlined in Mr. Esser's report to the Board on the condition that the payment by the New Amsterdam Casualty Company in the amount of 429,500. 00 be not fully binding and final until a court order has been issued approving the claim against the National Surety Company in the amount of $4,843.52. Upon motion duly made and seconded, it was upon roll call, unanimously RESOLVED, that the above report be and it hereby is approved and the recommendation accepted. --- The Supervisor advised the Board that he had been in consult- ation with the County Bankers Committee and county financial officers., and that they had urged the importance of having a survey of the town's finances made by experts in that line. He said that Messrs. Cummin and Harmon were highly recommended for this work. Upon motion by the Clerk, seconded by Justice Burbank, it was unanimously RESOLVED, that the Supervisor be ,,and he hereby is authorized, empowered and direction to engage Messrs Gaylord Curmin and Charles A. Harmon to conduct a survey of the finances of the 'Town of Mamaroneck and to make recommendations thereon at a cost of not to exceed $1,500.00. On motion of Justice Boyd, seconded by Justice heeds, the following preambles and resolution were adopted : WHEREAS the purchasers of the $60,000. Sewer District No. I bonds, Series K, sold on August 22, 19332 have not yet taken up said bonds and paid for same, and WHE4E SS, it seems improbable that said bonds will be taken up and paid for in the immediate future , and WHEREAS, a certificate of indebtedness of the Town in the amount of $20,000, issued for sewer purposes , matures on November 15, 1933, and WHEREAS, a certificate of Indebtedness of the Town in the jaggnt of $22,500. issued for sewer purposes matures on December 20, , and �rkk �k d P WHEREAS, said certificates of indebtedness are to be paid from the proceeds of said bond issue, and WHEREAS, the respective holders of said certificates of indebt- edness have agreed to renew the same, NOWt THEREFORE, BE IT RESOLVED: - Section 1. For the purpose of renewing Sewer Certificates of Indebtedness of the Town of Mamaroneck, No. 24-4 in the amount of $20,000. dated September 15, 1933 and maturing November 15, 1933 , and Ise. 24-5 in the amount of $22,500. dated October 14, 1933 and maturing December 201, 1933, the Supervisor is hereby authorized to issue two new Certificates of Indebtedness in an amount not exceeding p20,000. and $229,500. , respectively, pursuant to the following laves of the State of New York, as amended : The Town Law constituting Chapter 62 and the Gen- eral Municipal Law constituting Chapter 24 of the Consolidated Laws,, Chapter 594 of the Laws of 1926 , Chapter 437 of the Lasts of 1928 and Chapter 860 of the Laws of 1930. Section 2. The following matters in connection with said Certificates of Indebtedness are hereby determined : No. 24-6 No. 24-7 Date : November 15, 1933 Dater December 20, 1933 Maturity: January 1,1934 Maturity : May IS 1934 Denomination: 1 of $20,000. Denomination: 1 of $221,500. Interest rate per annum: 6% Interest Rate : 6% Form: As determined by resolution Farm: As determined by resolution adopted September 16, 1933. adopted September 16, 1933. Said Certificates of Indebtedness shall be signed by the Supervisor and shall have the corporate seal affixed and attested by the Clerk. The Supervisor is hereby authorized to determine all matters in connection with said Certificates of Indebtedness, the det® ermination of which is not otherwise provided for and his signature upon said certificates shall be conclusive as to such determinations. The Supervisor is hereby authorized to sell such Certificates of Indebtedness at not less than par without advertisement or public bidding and deliver the same to the respective purchasers upon receipt of the purchase price plus accrued interest from the date of the said Certificates to the date of the respective delivery, or in exchange for the surrender of the respective Certificates of Indebtedness for the renewal of which these Certificates of Indebtedness are authorized. Section 3. Any instrument issued pursuant to this resolution shall be a general obligation of the Town of Mamaroneck and the faith and credit of the Town are hereby pledged to the punctual payment of the principal of and interest on said obligation, and unless otherwise paid or payment provided for, an amount sufficient for such payment shall be inserted in the budget and a tax sufficient to provide for the Payment thereof shall be levied and collected. Ayes . Burton, Boyd, Leeds, Hes:sersmith and Burbank and Marvin Nayes : None The Board then went into executive session to continue its discussion of the budget estimates for 1934. At 4:10 P.
