At the Town Offices, 118 West Boston Post Road, Tiliamaroneck, N. Y. 8:45 P. M. The meeting was called to order by Supervisor Burton at Present: Supervisor Burton Justices Boyd, Leeds, Messersmith and Burbank Town, Clerk Marvin The presence was also noted of Counselor Ralph A. Gamble. The regular order of business was suspended in order to hear Joseph LaRocco who desired to address the Board concerning monies owed him by the town for welfare claims. After stating the facts in the case, Mr. LaRocco thanked the -6oard for its attention. A letter dated November 27th was-received from Supervisor-elect Bert C. McCulloch on behalf of the newly elected Town Board, declining tith thanks the invitation of this Board to consult concerning the preparation of the 1934 budget. The letter was ordered received and jilaced on file. A letter dated November 23rd was received from Counselor Gamble reminding the Board that the present garbage contract expires on December 31st. After discussion, it was upon motion duly made and seconded, upon roll call unanimously RESOLVED, that the matter of a new garbage contract be referred to Counsel and Clerk to prepare specific- ations, notice to bidders- and form of contract, the life of the new contract to run for one or two years in the alternate; and be it further RESOLVED, that bids be received by this Board at its regular meeting on December _20th. Par. George B. Gibbons of the firm of the saffie name and SAY^. Henry Dietz of the same firm addressed the Board in regard to renewing a certificate of indebtedness in the amount of $40,000.00 issued in connection with the construction of the Pine Brook Drain, which becomes due on December 1st. On motion of Justice Boyd, seconded by Justice Messersmith, the following resolutions were adoptedc WHEREAS the purchasers of the $641,000. Pine Brook Drainage bonds isold on August 22nd, 1933, have requested an extension of the periai of time during which they may be permitted to take up and pay their said bonds , and and WHEREAS it appears advisable to grant such extension of time, WHEREAS five Certificates of Indebtedness of the Town aggreg- atin the principal amount of $409000; issued October 2nd, 19330 to pay the own off' Mamaroneck's share of the cost of the construction of Pine Brook Drain, pursuant to Chapter 260 of the Laws of 1930 of the State of New York, mature on December 1, 1933, and =REAS said Certificates of Indebtedness are to be paid from the proceeds of said bond issue, ITOw, THFRFFORE, BE IT RESOLVED, Section 1. For the purpose of renewing the aforesaid Pine Brook Drain Certificates of Indebtedness Nos. 26 to 303, inclusive, in the principal amount of $403,000. of the Town of Mamaroneck, dated October 2nd, 1933, and maturing December 1, 1933, the Super -- visor is hereby authorized to issue new Certificates in an amount not exceeding $40,000. pursuant to the Laws of the State of New York, including Chapter 260 of the Laws of 1930. Section 2. The following matters in connection with said Certificates of Indebtedness are hereby determined: Date - December 1, 1933.. Maturity - January 1, 1934. Denominations - No. 31 $20,000. , Nos. 32 and 33 $10,000. each. Interest rate per annum - six (6%) per cent. Place of payment - Bankers Trust Company, 16 wall Street, New York City Form- as determined by resolutions heretofore adopted on June 21, 1933 and October 15, 1932. Said Certificates shall be signed by the Supervisor and shall have the corporate seal affixed and attested by the Clerk. The Supervisor is hereby authorized to determine all matters in connection with said Certificates of Indebtedness, the determination of which is not otherwise provided for, and his signature on such Cert- ificates zhall be conclusive as to such determination. The Supervisor is hereby authorized to sell such Certificates of Indebtedness at private sale at not less than par without advertise- ment or public bidding and deliver the same to the purchaser upon receipt of the purchase price , plus accured interest from the date of the Certificate to the date of the delivery, or in exchange for the surrender of the Certificates of Indebtedness for the renewal of which these Certificates are authorized. Section 3. Any instruments issued pursuant to these resolu- tions shall be a general obligation of the Town of Mamaroneck and the faith and credit of the Town are hereby pledged to the punctual payment of the principal of and interest on said obligations and unless otherwise paid or payment provided for, an amount sufficient for such payment shall be inserted in the Budget and a tax sufficient to provide for the payment thereof shall be levied and collected. FURTHER RESOLVED, that the Supervisor be and he hereby is authorized and empowered to make payment of the interest to become due and payable on the aforesaid Certificates of Indebtedness maturing December 1, 1933, in connection with obtaining a renewal or renewals thereon. Ayes: Burton, Boyd, Messersmith, Burbank and Marvin Nays : None The Supervisor advised the Board that he had sold the Certific- ates of Indebtedness hereinabove authorized in the principal amount of X40,000. to Georg e B. Gibbons & Company at par and at a rate of six per cent per annum, the same to be dated December 1st, 1933, and to mature January 1st, 1934. On motion of Justice Boyd, seconded by Justice Messersmith, the following resolution was adopted: i 289 RESOLVED that the Supervisor be and he is hereby authorized and empowered to deliver to George B. Gibbons & Company said Certificates of Indebtedness, together with a cheek for accrued interest an the maturing Certificates of indebtedness, the same to be delivered in exchange for Certificates of Indebt- edness maturing December 1, 1933, in the amount of - $40,000. Ayes: Burton, Boyd, Messersmith, Burbank and Marvin Hays: None Mr. Gibbons suggested that he be compensated for his services during the recent past as agent in renewing certificates of indebtedness for the town. Action was deferred on his suggestion, The Clerk advised the Board that he had been in consultation with Special Counselor J. Henry Fsser, concerning the costs in the Tortorella zoning cane and that on the suggestion of Mr. Esser he introduced the following resolution which was seconded by Justice Boyd and upon roll call unanimously approved :as follows; RESOLVED WHEREAS the Town of Mamaroneck in the Tortorella zoning case, was successful in sustaining the validity of itz zoning ordinance ; and WHEREAS the request of Tortorella has subsequently been settled to the satisfaction of all concerned; now therefore, be it RESOLVED that the records involving a lien resulting from said litigation against Tortorellars property, be rekared and that the Supervisor execute the nec- essary pape-rs in this connection, said papers to be prepared by Special Counselor Esser. The Board then commenced its discussion of the proposed 1934 budget, without, however, taking definite action on any matter. On motion by the Clerk seconded by Justice Messersmith, it was unanimously RESOLVED that this Town Board favor a reserve for uncollected taxes to be placed in the 1934 budget, the actual amount of this reserve to be determined later. Upon motion by the Clerk, seconded by Justice Boyd, it was unanimously, RESOILVED, that this Board recommend that the Board of Supervisors consider the advisability of amendments to the Westchester County Tax Act and/or the Town Maw so as to bring the beginning of the fiscal year of towns and the beginning of the tax year of towns closer together. At 11:50 P. M. the Board unanimously resolved to recess to meet again on Tuesday, December 5th, at 2 P. Y. to continue its discussions on the budget. Town Clerk
