March 28, 2011
A regular meeting of the Coastal Zone Management Commission (CZMC) was held on March
28, 2011 in the Mamaroneck Town Center, Conference Room C, 1' Floor, 740 W. Boston Post
Road, Mamaroneck, New York. The meeting was called to order at 8:00 p.m.

1. Approval of Minutes
The approval of the Minutes from the November 29, 2010 meeting were tabled until the
next meeting.
2. Thank you Letter to Lorraine Walsh
Mr. Godick gave a letter to Ms. Walsh thanking her for serving as Co-Chair of CZMC.
She read the letter into the record.
3. Approval of the 16th Annual Report
The 16th Annual Report was discussed. There were no comments and the report was
approved as submitted.
4. Proposed Amendments to Town of Mamaroneck Code: Chapter 95 Erosion and
Sediment Control. On the Town Board's Agenda for a Public Hearing on April 6,
2011.
The original Erosion Control Law has been substantially rewritten to break down projects
into Major and Minor activities. Minor projects are greater than 100 square feet but less
than one acre. Major projects are greater than one acre and require the preparation of a
Stormwater Pollution Prevention Plan (SWPPP).

Comments include:
• As written, it seems to indicate that all projects subject to review by one of
the Town boards are required to submit a SWPPP. Was that the intention
of the paragraph? I thought the requirement for a SWPPP is specified in
Article III for major projects.
• 95-19.G. The title of the paragraph "On-site SWPPP retention" is
confusing. I would recommend changing the term to "Retention of
SWPPP On-site".
• 95-21.C-E: I like the approach of an easement as opposed to a deed
restriction as it has broader applicability and can be dynamic. In my
experience, easements (in the form of environmental easements) are used
for remediation sites under the jurisdiction of the NYSDEC. It should
refer to a working document (for the Town— it should be an Operation &
Maintenance Plan) that would be prepared by the developer and approved
by the Town. It can only be modified in the future with approval by the
Town. The Operation & Maintenance Plan should specify periodic
certification requirements to ensure proper inspection and maintenance, as
well as some form of certification (probably by a PE or other "qualified
professional") that the system is functioning as designed and in
accordance with the O&M Plan. A template should be developed for the
maintenance easement. While not directly applicable, the following is the

5. Coastal Assessment Form—Review and Comments
Very few comments were received. The form was accepted for use.
6. Old and New Business
a. Open Space- Councilwoman, Phyllis Wittner suggested that an open space committee
be formed to continue the work done earlier by CZMC. The Town could get someone
from Westchester Land Trust to assist with conservation easements, which might be
attractive to some land owners if they knew more about the subject. Members are needed
for a committee.
b. LWRP - Mr. Godick suggested that CZMC members review the LWRP section by
section and discuss comments at each meeting. Ms. Wittner stated that the Department of
State talked about changes to the policies, but as far as she knows, none have been
changed.
c. Member attendance- If CZMC members miss three meetings without valid reason
given to the Chairman, they can be taken off the commission.

e. The Nolles Ridge Subdivision in the Village of Mamaroneck was discussed. The land
has been a buffer for Country Road residents.
The meeting was adjourned at 8:50 p.m.
The next scheduled CZMC meeting will be held on MONDAY,April 25, 2011 at the
Mamaroneck Town Center, 740 W. Boston Post Road, 1st Floor Conference Room C.
