CZMC Minutes
March 25, 2015
A regular meeting of the Coastal Zone Management Commission (CZMC) was held on March
25, 2015 in the Mamaroneck Town Center, Conference Room D, 1st Floor, 740 W. Boston Post
Road, Mamaroneck, New York. The meeting was called to order at 7:30 p.m.

1. Approval of Minutes
The minutes of the February 23, 2015 meeting was approved as submitted.
2. Referrals:
a. 15 Park Avenue—Pier Reconstruction
Referred by the Village of Larchmont Building Department
John Hilts, the engineer for 15 Park Avenue presented plans for the reconstruction of
the Pier that was destroyed during super-storm Sandy. CZMC found the proposed
action to be consistent with the policies in the LWRP. It was suggested that the plans
be modified to allow the ramp to be raised, in order to protect it from storm damage.

b. 23 North Brook Road—Wetlands and Watercourses Permit
Referred by the Town of Mamaroneck Planning Board
Rick Yestadt, the Architect for 23 North Brook Road, presented the proposal for the
construction of a driveway and new house. This proposal was originally referred to
CZMC in 2006 by the Planning Board and was approved by them. The project,
however, was never completed and the permits have since expired. The applicant has
decided to move ahead with the project once again and is seeing new approvals at this
time.
When the Coastal Zone Management Commission (CZMC) originally reviewed this
application in 2006, CZMC found the proposal to be inconsistent with Policy 44 of
the LWRP because the construction of the proposed retaining wall and driveway
would disturb soils and vegetation within the 100-foot buffer and possibly along the
bank of the river itself. Policy 44 is to "Preserve and protect tidal and freshwater
wetlands and preserve the benefits derived from these areas." The explanation of the
policy and the guidance for determining consistency with this policy specifically
states:
"Where possible, 100 foot buffers, at a minimum, should be preserved around all
wetlands."
Although the proposal is inconsistent with this policy, the applicant has made an
effort to mitigate any impact the proposal could have on the wetland buffer.
Mitigation measures include the location of the retaining wall above the base flood
elevation and the use of infiltrators to detain and treat stormwater runoff CZMC
would find this proposal consistent with the LWRP if these measures are
implemented along with the stabilization of the river bank both during and after
construction.
3. LWRP Discussion
Charles McCaffrey was available to discuss the LWRP via telephone, however CZMC
decided to wait until the April meeting to call him when more time is available. Several
questions were raised during the discussion: Is CZMC required to update our current
LWRP?; Can we keep the existing policy format or must follow the format of the Long
Island Sound Coastal Management Program, which has only 13 policies? A call should
be made to the NYS Department of State to verify.
