ADJOURNED UEETING OF THE TOWN BOARD
TOWN OF MAYARONECK, NE,. YORK
held August 7th, 1933
At the Town Offices , 118 'dezt Post Road, Mamaroneck, N . Y.
The meeting was called to order by the Supervisor at 10 A. M.
Present . Supervisor Burton
Justices Boyd, Leeds, Messeremith and Burbank
Town Clerk Marvin
The presence was also noted of Superintendent of Highways
Coles and Counselor Gamble .
Commissioner of Public `'Welfare DeVinne addressed the Board
and reported that he had interviewed Mrs . Katherine 'Westwood, an
applicant for the position of Supervising Case Worker in the Town
Welfare Office . He stated that Mrs . Westwood had been recommended
by the County 'Welfare Department and the State Ydelfare authorities;
that she would accept the position at a salary of 42.000. a year of
which 1,000. would be reimbursed to the town by the state ; that
she desired mileage to be paid at the rate of 4)6 per mile; and that
in his opinion, she was qualified for the position and he , therefore ,
recommended that she be engaged at once .
Upon motion by Justice lessersmith, seconded by the Town
Clerk, it was upon roll call unanimously
RESOLVED, that Commissioner of Public Welfare DeVinne
be and he hereby is authorized, empowered and directed
--- to engage Mrs . Katherine Westwood as Supervising Case
Worker on the terms and conditions_outlined above.
The Supervisor advised the Board that in his opinion, the
town would be able to sell bonds at the present time and recommended
that steps be taken to conduct such a sale in the near future .
Upon motion by Justice Messersmith,- seconded by Justice Boyd,
the following resolution was adopted:
RESOLUTION AUTHORIZING THE ISSUANCE OF $169 ,000
SE'?'d"ER FUNDING BONDS OF 1933 OF THE TOWN OF MiaARONECK, NEW YORK,
DETERMINING THE FORT OF SAID BONDS .AND PROVIDING FOR THEIR SALE'.
RESOLVED, by the Town Board of the Town of Mamaroneck,
in the County of 'Westchester, New York, as follows :
Section 1. Pursuant to the provisions of Chapter 444 of the
Laws of 1933 of the State of !New York, bonds in the principal amount
of $169,000 shall be issued to provide funds to pay its proportion or
share of the assessments or levies imposed by the County of 'Westchester
for the years 1932 and 1933 for the construction of the sanitary trunk
sewer in the Mamaroneck Valley Sewer District.
Section 2. Said bonds shall be designated as "Sewer Funding
Bonds of 1933 , " shall be dated August 1, 1933 , shall mature in the prin-
cipal amount of $15 ,000 on August 1 in each of the years 1934 to 1939,
both inclusive, 420,000 on August l in each of the years 1540 to 1942,
both inclusive , and $'19,000. on August 1, 1943 , shall bear interest at a
rate not exceeding six per centum (6%) per annum, the exact rate to be
determined by the Supervisor upon receipt of bids, payable semi-annually
on the first days of February and August in each year , shall be coupon
in form, registerable as to principal only or as to both principal and
interest, shall be numbered from 1 to 169, both inclusive , shall be in
the denomination of $1,000 . each, shall be signed by the Supervisor, and
the seal of the Town shall be affixed and attested by the Town Clerk, and
the coupons attached thereto shall be authenticated by the facsimile sig-
nature of the Supervisor, and shall be payable as to both principal and
interest in lawful money of the United States of America, at the office
of the National City bank of New York, of the City , County and State of

municipal corporation of the State of New York, hereby acknowledges
itself indebted and for value received promises to pay to the bearer
of this bond or , if it be registered, to the person in whose name
it is registered, on the first day of August, 19 , the sum of
One Thousand Dollars (41,000 . 1 , and to pay interest on such sum at
the rate of per centum ( %) per annum, semi.-annually on the
first days of February and August in each year from the date of this
bond until it matures upon presentation and. surrender, as they severally
mature , of the coupons therefor annexmd. hereto or, if this bond be
registered as to both principal and interest , to the registered owner.
Both principal and interest of this bond will be paid in lawful money
of the United States of America, at the office of the National City
Bank of New York, of the Uity, County and State of New York.
At the written request of the holder this bond may be
registered as to principal on the books of the Town , kept in the office
of the Town Clerk, and a certificate of such registry shall be
endorsed upon this bond by such Town Clerk, after which the principal
of this bond shall be payable only to the registered holder , his
legal representatives , successors or assigns and shall be transferable
only upon presentation to such Town Clerk, with a written assignment
duly acknowledged or proved. The name of the assignee shall be
entered upon this bond and such books . Such registration shall not
affect the negotiability of the coupons which shall continue to pass
by delivery . At the written request of the owner, this bond may be
converted into a bond registered as to both principal and interest
and the coupons annexed hereto cut off and destroyed after which both
principal and interest shall be payable only to the registered owner,
his legal representatives , successors or assigns and shall be transfer-
able only in the manner hereinal?ove set forth.
This bond is one of an authorized issue , the aggregate prin-
cipal amount of which is : 169,000. the bonds of which are like tenor,
except as to maturity , issued pursuant to the provisions of Chapter
444 of the Laws of 1933 of the State of New York, and by virtue of a
resolution of the Town Board of the Town of Yamaroneck_duly adopted on
August 7th, 1933.
The full faith and credit of said Town are hereby irrevocably
pledged to the punctual payment of the principal and interest of this
bond according to its terms.
It is hereby certified and recited that all conditions , acts
and thins required by the Constitutidn and statutes of the State of
New York to exist , to have happened and to have been performed preced-
ent to and in the issuance of this bond , exist, have happened and have
been 16erformed, and that the issue of bonds of which this is one, to-
gether with all other indebtedness of said Town , is within every debt
_ and other limit prescribed by the Constitution and laws of said State®

RESOLUTION AUTHORIZING TIE ISSUANCE OF $110,000.00 GENERAL
BONDS OF` 1933 OF TIE TOWN OF FWANARONECK,_ NE'd1 YORK, AND DETERMINING
T"TINA FORM.
RESOLVED by the Town Board of the Town of Mamaroneck,
in the Co}}nty of destchester, New York, as follows :
-- Section 1. The sum of $100,000 is hereby appropriated for
home relief in the Town of Eama roneck.
Section 2. The sum of Q10,000 is. har.eby appropriated for
work relief in the Town of Mamaroneck.
Section 3 ., To meet said appropriations , bonds of the Town,
each to be known as "General Bond of 193311 , in the aggregate principal
amount of $11G.00. shall be issued pursuant to the following laws of
the State of New York, as amended: The Town Law , constituting Chapter
62, the General Municipal Law , constituting Chapter 24 , of the Consolid-
ated Laws and Chapter 798 of the Laws of 1931°
Section 4. Said bonds shall be dated August 1, 1933, shall
mature in the principal amount of $11,000 on August 1 in each of tale
years 1934 to 1943, both inclusive , shall bear interest at a rate not
exceeding six per centum (60) per annum, the exact rate to be determined
by the Supervisor upon receipt of bids, payable semi-annually on the
first days of February and August in each year, shall be coupon in form,
registerable as to principal only or as to both principal and interest ,
shall be numbered from 1 to 110, both inclusive , shall be in the
denomination of $1000 each , shall be signed by the Supervisor, and the
seal of the Town shall be affixed and attested by the Town Clerk, and

be levied and collected a tax upon all the taxable

of sale of said bonds to be oubliohed in the manner
provided by law, calling for the receipt of sealed bids
at a meeting of this Board to be held on the 22nd day

Sealed proposals will be received by the Town Board of the
Town of Mamaroneck, at 118 West Post Road in Mamaroneck, New York,
until 4 :30 o 'clock PL 31. on August 22nd, 1933, for the purchase of
the following described bonds of said Town:
$64 ,000.00 Pine Brook Improvement Bands in the denomina-
tion of $1,000, each, dated August 1, 1933, numbered 1 to 64, both
inclusive , maturing : 2,000. on August lot in each of the years 1938
to 1945 both inclusive , $3,000. on August 1st in each of the years
1946 to 1961 both inclusive . The bonds will be issued in coupon
form with privilege of registration as to principal or as to both
principal and interest. Principal an.d. interest (February 1st and
August lst) will be payable in lawful money of the United States
-- at the National City Bank of New York, New York City, N. Y.
Bidders are requested to name the rate of interest the
bonds shall bear expressed in multiples of 1/10 or 1/4 of one per
centum, not exceeding six per centum. The bondx will be awarded to
the bidder offering to take them at the lowest rate of interest
and to pay therefor the highest price. No bid for less than par
and accrued interest will be considered and the right is reserved
to reject all bids .
Each proposal must be enclosed in a sealed envelope
addressed to the undersigned Supervisor and marked on the outside
'"Proposal for Bonds" , and must be accompanied by a certified check
upon an incorporated bank or trust company payable to the order of
the Town of Mamaroneck for two per centum of the par -aloe of the
bonds to secure the Town against loss in case of the failure of the
successful bidder to comply with the terms of his bid. Checks of
unsuccessful bidders will be returned upon the award of the bonds .
The approving opinion of Messrs. Caldwell and Raymond,
attorneys , of New York amity , will be furnished to the purchaser
without charge .

The following resolution was offered by Justice Leeds
andpseeonded by Justice Burbank to-wit:

WHEREAS, pursuant to authority conferred by Chapter 654 of the
Laws of 1927, the Town of Mamaroneck issued $156,000. Water Distribution
System Bonds for the purpose of purchasing the water distribution
system in said Town formerly owned by the New York Inter Urban water
Company; and
=TEAS, pursuant to authority conferred by Chapter 627 of
the Laws of 1929, $100,000 water Distribution System Bonds of said
Town were issued for the purpose of further extending the water distrib-
ution system in said Town; and
WHTTEAS, funds are now required for further extending the
water distribution system in said Town; NOW THERTFORF? BE IT
RESOLVED, that there shall be issued Twenty®five Thousand
Dollars: ($25,000.00) water Distribution System Bonds of the Town of
Mamaroneck for the purpose of further extending the water distribution
system in said Town, dated the first day of September, 1933, of the
denomination of one thousand dollars ($19,000. ) each, numbered from
two hundred and fifty-seven (257) to two hundred and eighty-one (281)
both inclusive, maturing in numerical order one (1) bond on the first
day of September, in each of the years 1934 to 1958 both inclusive ;
that said bonds shall bear interest at a rate not exceeding six per
cdntum per annum, payable semi-annually on the first days of March and
September, and shall have interest coupons attached. That said bonds
shall be signed by the Supervisor and sealed with the corporate seal
of said Town, attested by the Town Clerk, and the interest coupons
shall be signed with the fac-simile signature of the Supervisor, and
that broth principal and interest shall be payable in lawful money of
the United States of America, at the National City Bank of New York,
New York City, New York, in New York exchange.
FURTHER RESOLVED, that said bonds shall be issued in sub-
stantially the following form, to-wit:

September upon presentation and surrender of the annexed interest

the water distribution system in said Town pursuant to and in strict

the acts amendatory thereof, and proceedings of the Town Board of said
Town duly hand and taken in all respects authorizing the same.
It is hereby, certified, recited and declared: that all acts,
conditions and things required to exist, to happen and to be performed
precedent to and in the issuance of this bond; exist, have happened
and have been performed in due time, form and manner as required by
law; that the issue of bonds of which thin is .one , .together with all
other indebtedness of said Towns is within every debt and other limit
prescribed by the Constitution and Laws of the State Of New York, and
that due provision has been made for raising annually by tax on the
taxable property of said 'Town, a sum sufficient to pay the principal
and interest of this bond as the same respectively become due and

This bond may be registered as to principal only as well as
to both principal and interest in accordance with the provisions of the
General Municipal haw. If this bond be registered as to both prin-
cipal and interest, the interest-hereon at the request of the registered
owner, will be remitted by mail in New York exchange.

FURTHER RESOLVED, that there shall be levied, assessed and
collected annually by tax upon the taxable property of said Town a sum
sufficient to pay the principal and interest of. said: bonds as the same
respectively become due and payable.
FURTHER RESOLVED, that the sum necessary to pay Ehe principal
and interest of said bonds may be provided for and included in the
water rates or raised as otherwise :provided in said Chapter 654 of the
Laws of 1927, as amended, but this providion-shall in nowise limit or
control the power and duty of the Town Board to assess, levy and collect
an annual tax sufficient to pay the principal and interest of said bonds
as the same respectively become due and payable.
FURTHER RESOLVED, that said bonds shall be negotiated by the
Supervisor of said Town for not less than par and sold in the manner
provided by law, and the Supervisor is hereby authorized to award said
bonds.
FURTHER RESOLVED, that when said bonds shall have been duly
sold and executed, the same shall be delivered to the purchaser upon
payment of the purchase price to the Supervisor; and the receipt of the
Supervisor shall be a full acquittance to said purchaser who shall not
be obliged to see to the application of the purchase money.

RESOLVED, WHTRFAS this Board heretofore petitioned the
Board of Supervisors for authorization to borrow the
sum of $75,000. in connection with the reconstruction
and/or pavement of Chatsworth Avenue and Rockingstone
Avenne,, and
WHEREAS the Board- of Supervisors on October 15 1931,
authorized the Town to borrow the said sum, and
WHEREAS said bonds have never been issued, and
WHEREAS it is now deemed desirable to increase the
amount heretofore authorized by $5,000. to $80,000.
and to provide for dating the bonds as of September • l, 1933,
and to provide new maturities,
THTREFORE, BE IT HTSOLVED, that this Board do and it
hereby does petition the Board of Supervisors of the
County of Westchester to amend Act I=VIII adopted on
October 15, 1931, and that said petition in the following
form for said purpose be executed by the members of th%s

WHEREAS, heretofore on the 18th day of September, 1931, this
Board petitioned your Honorable Board for authorization to borrow on
the faith and ere-iit of the Town of Mamaroneck, the sum of $75,000 for
the purpose of paying the cost of draining, curbing, grading, paving
and otherwise improving CHATSWORTH AVENUE' and ROCKINCSTONF AVENUE in
said Town of Mamaroneck, pursuant to the provisions of Chapter 17 of the
Laws of New York of 1905, as amended; and
WHEREAS, your Honorable Board, by Act No. L9ILFIII passed on
the 15th dad of October, 1931, did authorize the Town of Mamaroneck
to borrow the sum of $75,000 to pay the cost mf improving Chatsworth
Avenue and Rop'kingstone Avenue. and to issue its bonds therefore ; and
WHERFAS, pursuant to such act, the Town Board of the Town
of Mamaroneck w as authorized to issue $75,000 Highway Improvement Bonds
1931, of the denomination of $,"19000 each, numbered from l to 75 both
inclusive, dated October 1, 1931, maturing $4,000 on October 1, in each
of the years 1932 to 1946 both inclusive , and $3,000 on October I, in
each of the years 1947 to 1951 both inclusive , bearing interest at a
rate not exceeding six per centum per annum; payable semi-annually
April 1 and October 19 and both principal and interest of said bonds
payable in gold coin of the United States of America of the present
standard weight and fineness, or its equivalent in lawful money -of the
United States, at the Trust Company of Larchmont, Larchmont, New York,
in New York exchange, or at the Bankers Trust Company, New York City,
New York, at the option of the holder; and
WHEREAS, the first installment of bonds has already become
due and the second installment will become due on Odtober It 1933; and
WHEREAS, the total cost of such improvement, including all
incidental expenses, is not less than $8090005 and it is therefore nec-
essary to issue the entire amount of $75,000 already authorized plus an
additional sum of $59000;

your Honorable Board on October 15, 1931r be amended so as

The 'bonds will be coupon bonds with the privilege of registration
as to principal only or as to both principal and interest.
Bidders must state in their bids a_ single rate of interest which

one-quarter or one-tenth of one per centum, but not exceeding six per

RESOLVED, that the Board of Supervisors be and they
hereby are petitioned to support the enactment of an
amendment to Chapter 105 of the Laws of 1915, known as
the Westchester County Tax Act, whereby tax payments in
towns in Westchester County may be made in installment
Payments ; and be it further
RESOLVED, that the Board of Supervisors be and they hereby
are requested to approve such a plan, have an act immediately
drawn and forward it to Albany for introduction, and use all
honorable means to have this legislation enacted by the present
special session of the Legislature so that it may apply to
1933 school taxes and subsequent tax l4vies.
At 11:15 A. X. the Board unanimously resolved to recess to
meet again at the call of the chair to take up such matters as might
