FETING OF THE TOWN BOARD
TOWN OF MAMARCF7 CK, N. Y.
held May 3rd, 1933
At the Town Offices , 118 West Boston Post Rd. , mamaroneek, N.Y.
The meeting was called to order by Supervisor Burton at
9 -35 P. M.
Present: Supervisor Burton
Justices Leeds, Messersmith and Burbank
Town Clerk Marvin
The presence was also noted of Counselor Gamble.
There being several persons present who desired to address
the Board, the regular order of business was suspended in order to
hear them.
Andrew S. Derby, Attorney, representing Carmine, Tortorella,
requested the Board to call a public hearing on the application of
his client, heretofore filed withthe Board , asking a change in
zoning from Class C Business district to Class D Commercial, of Mr.
Tortorella•s property located at 175 Myrtle Boulevard. Mr. Derby
stated his client desired to erect a filling station and that, if the
Board so desired, he would be glad to accept a temporary permit,
revokable by the Town Board, for the-erection of a filling station.
After discussion the matter was referred to Counsel to take
up with Mr. Derby with a view, if possible, to preparing an applica-
tion for a filling station based on a temporary permit. Justice
Messersmith did not vote on this resolution, stating as his reason
therefor: that as an attorney, he had been engaged in litigation
concerning the zoning of this property.
John A. Kothe of 10 Dean Place addressed the Board and Ares-
ented a petition signed by five property owners on Dean Place,
requesting that the zoning of the property on the southerly side of
Dean Place in the unincorporatdd section of the Town of Mamaroneck,
be changed from Class A residential to Class A2 residential for two
family houses
After discussion Mr. Kothe withdrew his petition with the
intention of obtaining additional signatures and presenting it again
at the next meeting of the` Board.
Wallace Reynolds of 22 Dean Place addressed the Board to
request permission to erect a two-car garage on his property. He
stated that permission for the erection of this garage had been
refused by the Building Commission becuase of non-compliance with
set-back restrictions. The matter was referred to Counsel to take up
with the Board of .Appeals.
John H. 'Trwin addressed the Board to request a re-zoning of
his property at the southwest corner of Weaver Street and Nyrtle
Boulevard, in order that he might erect a filling station thereon.
After discussion Mr. Erwin was directed to submit plans for the
proposed filling station to the Building Commission.

Mr Jay Van Norden, Veteran Relief Officer of Mamaroneck
Post No. 1156, Veterans of horeign Wares addressed the Board, regarding
his claim in the amount of $225.00 , presented to the Board at its
meeting on March let, and at that time ordered laid over. The claim
was for services rendered as Veteran Relief Officer from March 1932
to December 1932, inclusive at the rate of x$25.00 a month.
The Supervisor advised the Board that he had been requested
by members of Post No. 1156 of the Veterans of Foreign -Wars to ask
the Town Board for the appointment of a full-time Veteran Relief
Officer at a salary of $100.00 a month, beginning May let and bonded
in the amount of $1,000.009, on the understanding that said Veteran
Relief Officer will cooperate fully with the Town Welfare Office.
The Supervisor stated that he so recommended to the Board.
Justice Leeds moved a resolution to this effect which was
not seconded.
Mr. Van Norden stated that he had requested in a letter
accompanying his claim above mentioned, that for the year 1933 he be
paid at the rate of $50.00 a month as Veteran Relief Officer.
Justice Messersmith stated that in his section of the town
there was extreme financial distress and that he was giving notice
that he would waive $50.00 a month of' his compensation beginning May
let, the money to be devoted to benevolent and charitable purposes.
Upon motion by the Clerk seconded by Justice . Burbank it was
upon roll call unanimously
RFSOLVPD, that the claim of Jay Van Norden in the
amount of $225.00 above described, be and it hereby
is referred to the Supervisor with power, subject to
the approval of Counsel.
There being no other persons present who desired to address
the Board, the regular order of business was resumed.
The report of the Receiver of Taxes for the month of March
was receiged and placed on file.
A letter dated April 28th from the Department of Audit and
Control of the State of New York, thanking the Board for its "very
flattering resolution" adopted April 15th, was received and ordered
placed on file.
A letter dated April 24th was received from Mamaroneck Post
No. 90, American Legion inviting the Board to participate in the
Memorial Day exercises. The letter was ordered received, acknowledged
with thanks and the invitation accepted, and all members of the
Board were urged to attend.
A letter dated April 26th was received from S. Roger Mitchell
and Company, Certified Public Accountants of White Plains, regarding
a municipal audit. The letter was ordered received and placed on file.
The Clerk inquired what action had been taken by the Super-
visor on the matter of engaging accountants to audit accounts of the
town, in accordance with the terms of the 1933 budget, which matter
had been referred to the Supervisor at a previous meeting.
The Supervisor advised the Board that he had engaged Fckes
and Dean, Certified Public Accountants of New York, to make quarterly
proof audits of the accounts of the Town at the rate of $12250, a year.
A letter dated April 17th was received from Mrs. May Siebert
regarding the assessment on her property at 132 Post Road, Larchmont.
The matter was referred to the Clerk to take up with the Board of
Assessors.

A letter dated May let was received from Tames F. Clark
of 17 Huguenot Drive, regarding a stone wall on the northerly side
of his property. The letter was ordered referred to Justices Burbank
and Leecls to take up with tie Super-intendent of Highways and the
Building Commission.
The Clerk advised the Board that a small quantity of gravel
or screenings would enhance the appearance of the front of the Town
Hall. He was directed to ascertain what could be done about it.
The Supervisor requested the customary authorization to
attend to the publication of the notice of sale of tax liens. The
matter was upon roll call unanimously referred to the Supervisor with
power.
The Clerk recommended the compilation of a list or roll of
unpaid taxes as a suitable work relief project at this, time. The
Supervisor stated that he favored the idea.
The Clerk reminded the Board that the 1933 budget contem-
plated dividing the 11th Election District into two parts' thereby
creating an additional district. He stated that since the law
required that a new district be created before July let, it would be
well to prepare for the step at once. The matter was referred to the
Clerk and Counsel for report back to the Board at the next meeting.
Upon motion duly made and seconded the -Clerk and Counsel
were upon roll call unanimously authorized with pores to prepare for
the Special Registration on May 13th and the Special Flection on May
23rd, to be held for the purpose of approving or injecting an amend-
ment to the Constitution of the United States, rescinding the 18th
Amendment.
The Clerk suggested that in view of the rise in commodity
prices , it would be well for the Board to consider making at this time
a contract for the fuel oil to be used at the Weaver Street Fire House
during the coming year. The matter was ordered referred to the Fire
House Committee.
At 12:15 A. FE. The Board unanimously recessed to meet again
at the call of the chair to take up such matters as might properly
come before it.
