Central Park Avenue Hartsdale, New York 10530 Francine Brill, Recording Secretary 1. Minutes The minutes of March 12 were not yet ready for discussion and therefore were not voted upon. The written Resolution from the March 12 meeting concerning the proposed amendment to the Town Law making the defense of a non-conforming prior use an affirmative defense in prosecutions for zoning violations was reviewed by the Board members and no changes were found to be needed. The Town Board therefore directed the Secretary to certify the Resolution and forward it to the Town Board. 2. Application of Robert Stavis, 211 Hommocks Road, for a Wetlands and Watercourses Permit PUBLIC HEARING On Motion of Mr. Ortiz, seconded by Ms. Picciotto the Planning Board voted to open a Public Hearing in the matter of the application of 2l lHommocks Road to rehabilitate and replace the existing dock. Daniel Natchez of Daniel S. Natchez and Associates, 916 East Boston Post Road appeared and addressed the Board. Mr. Natchez entered a four page packet of photos marked exhibit A. Mr. Natchez explained that the existing dock is in poor condition and is dangerous, the plan is to take the pier down leaving the rocks and stone stanchions Planning Board April 9, 2008 page 2 because they are considered by the DEC as habitat. The new pier will be placed on steel piles drilled and vibrated into into the rock ledge for support. The plan is to make the new pier slightly wider and longer to bring the float out into the channel further so that it would no longer sit on the bottom at low tide which is not good for the environment. By making the pier wider and elongating the gangway, the structure would be less steep and would be ADA compliant, even though such compliance is not required for permitting purposes. Mr. Natchez also stated that by lengthening the dock, the float will no longer be surrounded on both sides by outcroppings of rock, making docking much safer. The Board questioned the tides, mean low water and the constructions plans as to the relevance of the tides on construction. Mr. Natchez stated that the pier must be drilled at low tide but not necessarily the lowest tide of the year and the dock will be set a high tide. Mr. Natchez also explained that in order to go before the NYSDOS, the ACE and the DEC he must first be granted approval from the Town Planning Board Elizabeth Paul, Environmental Coordinator stated that CZMC has already reviewed the plans and have sent a letter dated April 1, 2008 stating that they found the proposal to be consistent with the policies in the Local Waterfront Revitalization Program. Ms. Paul also stated that the NYSDOS refers to the CZMC and asks for a consistency review. Mr. Natchez stated that in planning this particular pier and float they took into consideration the environmental impact, navigational impact, and the visual impact, the float although longer than the original is closer to shore than the surrounding neighbors' floats by at least 68 feet and both neighbors have no objections. The Board discussed this application and found that the Town Engineer has not had enough time to adequately review the application and get his findings to the Board, therefore they suggested an Adjournment.
