Members Present: Marc Rosenbaum, C. Alan Mason, John Ortiz, Edmund Papazian, Virginia Picciotto, George Roniger Also Present: Ronald Carpaneto, Director of Building, Lisa Hochman, Counsel, Anthony Oliveri P.E., Consulting Engineer. Absent/Excused: Ellen Dunkin, Elizabeth Paul, Environmental Consultant. Recording Secretary: Francine M. Brill MINUTES: OvE Motion: To approve the minutes of October 13, 2010 and November 10, 2010 Action: Approved Moved by John Ortiz, Seconded by C. Alan Mason. Vote: Motion carried by unanimous roll call vote (summary: Yes = 6). Yes: C. Alan Mason, Edmund Papazian, George Roniger, John Ortiz, Marc Rosenbaum, Virginia Picciotto. Absent: Ellen Dunkin. Application No 1 Case No. 276 19 Avon Road Subdivision Public Hearing The matter was adjourned to January 12, 2011. Application No. 2 Case No.273 Property formally known as 77 Cooper Lane Public Hearing Amendment to prior approved subdivision Steve Marsh, the applicant, addressed the Board explaining the revised drainage plan. Mr. Rosenbaum read into the record the letter from Coastal Zone Management Commission ("CZMC") dated December 7, 2010 and Board members discussed the recommendations in the letter. Mr. Oliveri stated that he has issues with CZMC letter. In particular, there was never a retention system proposed because of rock on the site and,because of the rocky conditions, the applicant can only provide detention and cannot use infiltrators. Mr. Oliveri stated that the proposed drainage line would adequately address flooding concerns in light of the unique conditions on the site. Ms.Picciotto inquired about downstream impacts. Mr. Oliveri explained that the theory is that the water would hit downstream before the peak flow hits. Motion: To open the public hearing nunc pro tunc Action: Approved Moved by John Ortiz, Seconded by Virginia Picciotto. Vie Vote: Motion carried by unanimous roll call vote (summary: Yes = 6). Yes: C. Alan Mason, Edmund Papazian, George Roniger, John Ortiz, Marc Rosenbaum, Virginia Picciotto. Absent: Ellen Dunkin. Bill Lachenauer, the applicant's engineer, explained the proposal. The Board discussed the application. Augustine DiFiore of 79 Cooper Lane stated that he supports the proposal because the new drainage line will eliminate the ponding of water across the street from the subdivision.
