MINUTES OF THE REGULAR MEETING OF THE
PLANNING BOARD OF THE TOWN OF MAMARONECK
NOVEMBER 10, 2010 IN CONFERENCE ROOM C, TOWN CENTER

CALL TO ORDER
The meeting was called to order at 8:00 p.m.

Also Present: Ronald Carpaneto, Director of Building, Kevin Ryan, Counsel, Anthony
Oliveri P.E., Consulting Engineer, Elizabeth Paul, Environmental Consultant, Ernest
Odierna, Liason to Town Board, Stephen Altieri, Town Administrator

Application No. 1 Case No. 273 19 Avon Road Public Hearing continued
Paul Noto, the applicant's attorney, addressed the Board. Mr. Noto stated that they have
been before the Coastal Zone Management Commission and the Commission found the
plan not to be inconsistent with the policies of the Local Waterfront Revitalization Plan.
William Lachenauer, applicant's engineer of Hudson Engineering and Consulting,
addressed the Board and explained in detail how, in his view, the recently submitted
plans address the concerns of the Board, of the Town's Consulting Engineer and of the
neighbors as previously voiced during the hearing on this application.
Mr. Rosenbaum asked whether Mr. Utschig, the neighbors' engineer, found the plan
acceptable. Mr. Oliveri stated that in a conversation he had with Mr. Utschig he appeared
to be in agreement with the applicant's plan and Mr. Lachenauer stated that he believes
Mr. Utschig is no longer working for the neighbors.
Mr. Papazian asked about rock blasting or chipping. Although Mr. Lachenauer stated
that they would probably use the chipping method, Mr. Carpaneto stated that blasting
would be the preferable method due to the location of the sewer lines and other utilities,
as well as the length of time that neighbors would be disturbed that chipping typically
involves.
There were no questions or comments from the public.
Mr. Ryan stated the Planning Board could vote to direct that Mr. Oliveri provide a
comment letter to the applicant

Motion: To direct Anthony Oliveri, the Consulting Engineer to forward a letter to the
applicant providing comments on the preliminary layout.
Action: Approved

IVm Application No. 2 Property formerly known as 77 Cooper Lane -
Consideration Amendment to Subdivision
Steve Marsh, the applicant, addressed the Board. Mr. Marsh stated that the project is
progressing smoothly and they have found an opportunity to improve drainage on Cooper
Lane. The applicant Mr. Marsh seeks approval to amend the prior approved subdivision
in order to install a 24 inch drainage line instead of the retention galleries on the property.
Mr. Lachenauer of Hudson Engineering, applicant's engineer, designed this plan.
Mr. Lachenauer described the proposed plan, stating that the new pipe will collect runoff
from the 100-year storm and improve drainage along Cooper Lane by reducing water to
the storm drain across the street.
Dr. Mason asked why this was not in the original plan and Mr. Lachenauer stated that it
is his understanding that at the time attenuation was required on site, but recent analysis
indicates that the proposed plan is the better solution, both for the subdivided property
and for Cooper Lane.
The Board discussed the proposed drainage plan.
Mr. Altieri stated that after Mr. Marsh finishes the Cooper Lane pipe line, the Town will
approach the owner of the home adjacent to the falls to seek an easement to divert the
water to the falls which leads to the duckpond.
Mr. Rosenbaum directed counsel to prepare and circulate a draft resolution for the
December meeting.
The chairman directed the secretary to refer the matter to the CZMC for its upcoming
meeting.
The matter was adjourned to December 8, 2010 for a public hearing.
