Public Hearing
Paul Noto, applicant's attorney, addressed the Board. Mr. Noto stated that he met with
the Coastal Zone Management Commission for a site visit and, as a result, the applicant
was asked to record a video of the storm water system on the Oxford side of the property
and design a plan. The applicant has submitted a plan for review and the matter is to be
heard by the Coastal Zone Management Committee on October 25, 2010.
Clark Bailey of 10 Oxford Road questioned whether the storm sewer on Oxford can
handle increased flow from the proposed subdivision. Mr. Oliveri stated that the
applicant examined the state of the system but that the Town has to review the applicant's
determination. Bill Lachenauer of Hudson Engineering, Tarrytown NY, applicant's
engineer, gave a presentation explaining two alternative storm water management
systems for the proposed subdivision: (1) a 48-inch drain pipe and (2) a 42-inch pipe and
rain gardens on the proposed building lot.
Mr. Rosenbaum asked who will be responsible for the maintenance of the rain gardens.
Mr. Lachenauer stated that ultimately the property owner will be responsible.
Liz Quinn of 14 Oxford Rd., the immediate neighbor, stated that water flows down the
rock and onto her property and into her basement and questioned how the rain gardens
will improve that situation.
Mr. Oliveri stated that the rain gardens are optional but that the Town asked the applicant
to look into the use of them
Lois Scheffler, 8 Oxford Road, asked how much of property will be taken over for the
rain gardens. Ms. Scheffler expressed concern that the new owner may come back to the
Town with a hardship request to remove the rain garden.
Mr. Rosenbaum asked what enforcement mechanism would be required for maintenance
of the rain garden. Paul Noto stated that the approval could contain a condition that the
rain garden be completed before issuance of a Certificate of Occupancy. Maintenance
issues could be addressed by a condition requiring a deed restriction.
The Board discussed the pipe sizes and the proposed rain garden.
Paul Fitzgerald, 16 Avon Rd, expressed concern about the proposed patio and house and
the run off towards Avon. Mr. Lachenauer explained that the project must not increase
the peak rate of runoff. Paul Fitzgerald stated that there is flooding at the intersection of
Avon and Landsdowne Roads.
Chuck Utschig, engineer for three neighbors not including Mr. Bailey, stated that he was
given revised drawings a few days ago and would like more time to review. He stated
that the rain gardens are good for water quality but not a satisfactory solution to the
drainage problems on this site. He further stated that the soil absorption is poor and
neighbors have water in their basements. He recommended the 48-inch closed-pipe and
no rain garden.
Maintenance of the pipe was discussed.
Mr. Utschig stated that if the road gets paved and a bump is put in as appropriate by
certain neighbors' driveways, it would help prevent water from flowing onto their
properties.
Mr. Papazian stated that the two consultants should work with each other before the next
meeting.
