Roll Call.
Present: Marc Rosenbaum, Chairman,John Ortiz, Edmund Papazian, George Roniger, Stephen Marsh,

CALL TO ORDER
Mr. Rosenbaum called the meeting to order at 8:00P.M. and wished everyone a happy new year.

Motion:To approve the minutes of December 12, 2012 with technical corrections.
Action:Approved
Moved by Stephen Marsh, Seconded by John Ortiz.

APPLICATION NO. 2 CASE NO.296 1 Durham Road continuation of public hearing
Mr. Lachenauer the applicant's engineer addressed the Board stating since the last meeting they have
had a meeting with the Town staff, and answered Mr. Oliveri's concerns, and David Goessl the Towns
Civil Engineer's issues. Technical items were addressed and a Plat was prepared to be circulated to Mr.
Oliveri's office for review.

Mr. Oliveri summarized his memo of 1/8/2013, stating he is technically satisfied with plans;the wording
on the plat is to be worked out before it is sent to Health Dept. Once the Health Dept. is satisfied,the
applicant will come back to the Board for final subdivision approval
Ms. Hochman suggested the language in Mr. Oliveri's memo should be noted on the deed, as the
document will be recorded in Westchester County. The same language could be incorporated on the
Plat.
Mr. Rosenbaum read the memo into the record and stated the notation will be added to the Plat for the
record.
Enforcement of maintenance was discussed. Ms. Hochman stated that the Town Code allows for the
Town to fix any problem that is not taken care of by the property owner and attach the cost to the
property taxes.
There were no questions or comments from the Board.
Motion:to authorize the decision on the preliminary layout pursuant to Section 190-7 of the Town Code

Public Comments
Julie Kane, of 7 York Road, stated that she resides across from the neighbor who has granted the
applicant a drainage easement. She stated if something goes wrong there will be water in her front
yard, as she has had a problem from the Sether Woods development,which the Town remediated.
Ms. Paul stated the Town added catch basin and drain to alleviate the drainage problem.
Mr. Lachenauer explained the DEC storm water regulations, and that in doing the calculation they took
into account the deficiencies in the York Road drainage system and have reduce runoff rates towards
York. The easement was requested by the Town.
Mr. Ortiz asked if Mr. Oliveri would look at the previous engineers' plan for 7 Durham Road.
Mr. Rosenbaum stated that the applicant is required to have neutral runoff and questioned if without
the easement the situation would be better or worse.
Direction of the overflow runoff was discussed.

Mr. Oliveri explained no matter what storm event the rates and volume of runoff towards York Road are
reduced, although only rate is required, maintenance is also required by code.
Mr. Rosenbaum asked whether there will be more runoff during construction, Mr. Lachenauer
responded yes temporarily.
Ms. Hochman stated Chapter 95 of the Code will apply to maintenance of the cultecs.

APPLICATION NO. 3 CASE No.300 75 Howell continuation of public hearing
Jan Gould,the applicant's architect, addressed the Board, stating that he was given a copy of a 1937
easement between the Town and 65 Howell Avenue for a storm drain running from Palmer Avenue to
Howell Avenue. The Town map shows the connection but the system seems to have failed.
Mark Shapiro of 65 Howell stated it runs under his driveway.
Mr. Gould stated that 67 Howell has been sold the new owners have seen the plans and have stated
they will write a letter in support. As requested by staff the zoning chart has been placed on the plan.
Allan Pilch of Evans Associates stated that deep water test pits were conducted,ground water was
encountered in one location and that portion was eliminated from the storm water management plan.
All water from the proposed house will be directed toward Howell and Weaver streets. The peak rate of
runoff will be reduced.
The Board discussed the proposed erosion controls
Mr. Weismen of 1206 Palmer Avenue asked about the methodology of deep hole tests, showed the
Board pictures of standing water in location of the tests done 12/20/2012
Mr. Pilch stated that they are not putting a dry well where the test failed.
Mr. Shapiro stated that the area has an existing drainage system that doesn't work and doesn't want it
to get worse.

Mr. Oliveri stated that the point being missed is they are not putting drainage into failed system but
directing it toward Weaver St system. The fact the drain is not working might have to be addressed to
the Town.
The easement and the failure of the system were discussed and Ms. Katz and Ms. Paul stated they will
look into it.
Gail Heiler of 1 Meadow Place stated that if the pipe under the easement is not maintained now, how
will the maintenance of the proposed pipe be guaranteed in the future.
David Halpern of 72 Howell asked about maintenance of the proposed grass crete driveway.
Mr. Pilch stated that a sprinkler system is in place now and will be improved to keep the grass growing.
The length of the proposed driveway was discussed.
The matter was adjourned to February 13, 2013
APPLICATION No.5 CASE NO.308 529 Weaver Street Continued
Larry Nardeccia,the applicant's engineer, stated the parcel presently has a main house and a care takers
house,the applicant would like to subdivide for two buildable lots. After a meeting with Town staff he
modified the plans.
The main concern was runoff, on 3 sides there are no neighbors,there are 2 low points which result in
ponding. Mr. Oliveri had suggested the applicant pull as much of drainage to front of the property
toward Weaver Street. The ridge line was moved and 10 cultecs are planned in the front yard and 2 in
the rear.
Calculations show that the total runoff will be reduced from not only present conditions to future
constructions but from a virgin lot.
A swale will be used to prevent water from going onto Weaver Street during construction. After
completion the drywells will be installed.
Site distance was discussed.
Three test pits were dug and 2 are usable 1 must be moved.
Mr. Oliveri stated that at the peer meeting the applicant was pushed to reduce drainage from the rear
to the front, also there are other comments need to be addressed for next meeting.
Mr. Nardeccia responded no problem
