Present: Marc Rosenbaum, Chairman,John Ortiz, Edmund Papazian, Ellen Dunkin,Virginia Picciotto, George Roniger. Absent: C. Alan Mason. Also Present: Lisa Hochman, Counsel,Anthony Oliveri P.E., Consulting Engineer, Elizabeth Paul, Environmental Consultant. Motion:To approve the minutes of July 13, 2011 Action:Approved with technical corrections. Moved by John Ortiz, Seconded by Virginia Picciotto. Vote: Motion passed (summary:Yes=5, No= 0,Abstain = 1). Yes: Ellen Dunkin, George Roniger,John Ortiz, Marc Rosenbaum, Chairman,Virginia Picciotto. Abstain: Edmund Papazian. Absent: C. Alan Mason. APPLICATION No.1 Case No.293 Bonnie Briar Country Club Consideration Mr. Ortiz recused himself. Ralph Mastromonaco, the applicant's engineer, addressed the Board, stating that they applied for a wetlands and watercourses permit to construct an infiltration gallery and piping to utilize water from the Sheldrake River to augment the irrigation system of the golf course. All work will be next to the river. A 50 foot long, 6 foot deep channel will be dug and filled with gravel to pipe the flow from the river to the upper pond,to irrigate the course. Ms. Paul asked about the impact the project will have on the plants the county planted in that area. The amount of water being used was discussed. Mr. Mastromonaco stated that he calculated they will need approximately 2%of the annual runoff or about 250,000 gallons per day for, on average, 138 days per year. Ms. Hochman filled the Board in on recent legislation that has been passed. Currently the law states that if water is to be withdrawn in eccess of 100,000 gallons per day there must be a report filed. The new law which will repeal the current law as of February 2012 changes the reporting to a permit being required. Mr. Oliveri stated that it should be checked as to whether the ponds were originally intended to be detention ponds. Ms. Paul asked about tree and rock removal, Mr. Mastromonaco, responded that they would try to avoid rocks when installing the utilities and the ditch will be as far away from the trees and the dam as possible. Mitigation was discussed and Ms. Hochman stated that 114-17 lays out the standards. There were no questions or comments from the public. It was stated that this is a Type 1 action and must be referred to CZMC for their 9/26/11 meeting. Ms. Paul needs packets by the 19tn Mr. Mastromonaco stated that the Sheldrake is a Class C stream and the DEC has no jurisdiction, also under a nationwide permit no ACOE permit is required. Mr. Oliveri stated the Board requires written answers from both the DEC and ACOE. The matter was adjourned to October 12, 2011 for a public hearing.
