Central Park Avenue Hartsdale, New York 10530 Marguerite Roma, Recording Secretary JOSEPH PATERNO, 50 SHELDRAKE AVENUE BLOCK 221, LOT 41 The applicant requested an adjournment to the next meeting May 11, 2005 ELMCROFT ESTATES 1050 OLD WHITE PLAINS ROAD BLOCK 345, LOT 1 Joe Cremelli Engineer from Site Designs addressed the Board and gave the following updates: 1) The sewer system would not be extended to service the residents on Bruce Road. 2) Each home would have a pump system to the main sewer line with its own holding tank sized separately for each home. 3) Mr. Lyons has agreed to allow the developer to work within the drainage easement on his property 4) Elmcroft has submitted a new drainage plan that will be discussed tonight. Mr. Cremelli explained how the new drainage plan addressed the overland flow from adjoining properties. He explained that the 12 inch drain line on Weslyan Ave was pitched improperly and is clogged which causes Weslyan to flood. The applicant will hire Fred Cook Inc to video for better results. The applicant has proposed to correct existing drainage conditions on Weslyan Ave. The applicant proposed a new catch basin on Weslyan to handle run off from Old White Plains Road. This will be run to Saxon Woods across Old White Plains Road. The applicant stated that the retention pond and all drainage structures, the cul de sac island and individual sewer systems will be home owner association responsibility. The Town is still not satisfied with the verbal report that Weslyan is a Town owned road. The applicant will engage Chicago Title to supply a title report. The drainage system is designed to reduce run off to the adjoining properties. The Planning Board according to law may request that the project be able to duce runoff by 20%. Neighbors were concerned with the possible flooding on Bruce Road. The neighbors do not want more water sent to them due to this project. The applicant stated that the proposal will not add water but reduce the runoff that presently exists. The applicant will have the Bruce Road storm system videoed to reveal the integrity and pitch of the lines. The applicant will also research the outflow from Winged Foots upper pond in respect to maintenance. The concern was what frequency is the outflow structure maintained and cleaned. The maintenance is critical in regards to flow to the down stream pond. FOREST CITY DALY MAMARONECK, LLC. Joel Sachs applicant's attorney appeared and addressed the Board. Mr. Sachs stated that they were there on referral from the Town Board regarding a zoning amendment to revise the BMUB District. The Town Board is the lead agency and there was a full DEIS and FEIS prepared. The proposal that is before the Board is a different proposal than the one originally filed. The applicant would like the Board to review the zoning amendment that is before the Town Board and give their thoughts on the matter. The Chairwoman stated that the Planning Board is only an advisory Board and will not be the permit issuer. Andrew Tung of Divney, Tung and Schwalbe, 1 North Broadway, White Plains appeared and addressed the Board. Mr. Tung stated that the BMUB was created by the Town Board in 1990, from a former "B" Zone. The project parcel is now 2.18 acres which makes up the greater part of the BMUB district. Mr. Tung stated that as a result of the meeting with the Town Board the number of units were reduced from 186 to 159 units. As a result of the discussions about the impact on the parking in the area, it was agreed that Forest City would provide assistance to the Town in the construction of a parking deck on lot 4 at the corner of Myrtle Blvd. and North Chatsworth. It was also discussed that FCD would incorporate 9 work force units among the 159 units proposed. The Board discussed the matter and the Chairwoman stated that if the Board agrees the Town lawyer will write a letter that the Chairwoman will sign. Mr. Maker the Town Attorney stated there is a forty-five day time frame within which the planning Board is to reply, but if the Planning Board writes the letter than the Town Board can set a Public Hearing.
