JOSEPH PATERNO, 50 SHELDRAKE AVENUE BLOCK 221, LOT 41 The matter was adjourned at the request of the applicant. ELMCROFT ESTATES Wesleyan Ave and 1050 Old White Plains Road Preliminary Subdivision/Site Plan Public Hearing Fred Kelsh applicant's attorney appeared and addressed the Board, also appearing with him the owner/applicant of Comstock Development Eric Abraham and Joseph Rina of Site Design. Ms. Gallent, Counsel stated that the application was prematurely noticed as a public hearing and that the Board will treat the application as a consideration. Mr. Kelsh concurred. Mr. Riina addressed the Board and handed out revised plans, reflecting Mr. Oliveri comments. Mr. Riina described the site as one large residence with several out buildings surrounded on the north and west by Winged Foot Golf Course and on the opposite side by Old White Plains Road and Saxon Woods. Mr. Riina stated that it is the applicant's intention to renovate the original house and build 5 more houses. The lot sizes range from 28,000 to 47,000 square feet. Mr. Riina stated that they are currently in discussion with Winged Foot about a sewer easement. Mr. Riina also discussed stormwater management plans and the lessening of impervious surface in the plans. The Board discussed the road, access for emergency vehicles and if the road will be a Town road or private. Mr. Jeff Waldhuter of 7 Bruce Road stated he is concerned with drainage, during storms Bruce Road (a private road) residents experience flooding. The location of the pump station on Wesleyan and whether it is a private or Town or private was discussed. Mr. Waldhuter also questioned notification of the neighbors and Mr. Carpaneto will check if the neighbors were correctly notified even though this is not a public hearing. Mr. Johm Lyons of 2 Bruce Road stated that he is concerned about the control of runoff from the development. Ms. Reader explained the soil and erosion law, explaining that there can be no increase in runoff. Mr. Riina responded to the public's comments about the pump station and the Board discussed it. Ms/ Gallent suggested that the application remain as a consideration until particulars are worked out and Mr. Kelsh agreed. Ms. Reader stated the matter needs to be referred to CZMC but not until the plans are completed. It was referred to the Fire Department and Highway Department for their input. The matter was adjourned to March 9, 1005 for consideration CUSTOM CAR WORKSLTD/ GLEN A. HAZIM 630-636 Fifth Avenue Mr. Hazim of 6 Juengstville Road, Croton Hills, NY appeared and addressed the Board. Ms. Reader stated that this is a request for a special use permit where East Coast used to be and everything is to remain the same. Mr. Oliveri stated that the applicant must adhere to the EPA guidelines for the closure of the wells. Also CZMC asked that gravity pit must be closed and Ms. Gallent stated that could be a condition of approval. On motion of Mr. Rosenbaum the Public Hearing was opened Nun ProTunc. Mr. Parikh from Metropolitan Consulting NYC the applicant's engineer addressed the Board stating the manufactures brochure on the oil water separator was attached to the application. He explained that this particular unit is oversized to and there would be no water flowing outside from the building. Ms. Reader asked if there was any one had any comments or concerns. There was no response. The matter was adjourned to March 9, 2010 for continuation of the Public hearing. MERCEDES BENZ/CROCCO 2500 Boston Post Road Mr. Joseph Crocco the applicant's architect and Chris Tokarz from Mecedes Benz appeared and addressed the Board. Mr. Crocco stated that they have appeared before the CZMC since they were before the Planning Board last met. He stated that they are replacing the oil water separator as per the CZMC request and are also going before the Board of Architectural Review for aesthetics issues. Mr. Crocco stated the hours of operation for the show room are Monday thru Saturday 9am. to 9pm., Sunday 9am.- 5pm.; the service area will be in operation Monday thru Friday 7am to 8:pm. And Saturday 9am to 5pm and closed Sunday. On motion of Ms. Reader the Public Hearing was opened Non Pro Tunc. Ms. Paul the environmental coordinator stated that she needs information on parking, vehicle storage, and how the vehicles will be delivered to the site. Mr. Cocco stated that the cars will be delivered to their other location and driven to Boston Post Road. They will require approximately 35 employee parking spaces, 12 for sales and about 40 for the service department. Mr. Carpaneto asked how many cars would be in the show room and Mr. Tokarz responded about 40. I was suggested that Mr. Tokarz and Ms. Paul meet to work out the parking and storage issues so Ms. Paul can analyze the impacts of the proposal. The matter was adjourned to March 9, 2005 JIM JANG 2423 BOSTON POST ROAD SPECIAL USE PERMIT Mr. Jaing the applicant and Mr. Pauline the building's owner appeared and addressed the Board. Mr. Pauline stated that Mr. Jaing is before the board to renew his special use permit, Mr. Carpaneto corrected him stating it is the same restaurant but a different owner. Ms Gallent stated that it is a Type II action, transferring the ownership with no changes to the operation only a name change to Chen's Kitchen. Mr. Carpaneto stated that they are before the Board of Architectural Review for a new sign. The application was referred to the Westchester County Planning Board and DOT. The matter was adjourned to March 9, 2005 MARC CONTRACTING 33 MARBOURNE DR. WETLANDS AND WATERCOURSES Marc Castaldi the applicant appeared and addressed the Board stating that his engineer Mr. Salinitro was on his way. Mr. Castaldi stated that he has gone before the CZMC and they altered their plan as per CZMC recommendations. Mr. Salinitro stated that 6 months earlier they appeared before the Board proposing to construct a new residence and relocate the existing brook. They went before the CZMC who were opposed to the proposal as presented. Mr. Salinitro stated that CZMC wanted the house scaled down moved forward on the lot and the water course left alone. He further stated that they tried to meet the criteria set. Ms. Reader referred to the January 27th letter from the CZMC that the project was inconsistent with the LWRP. The location of the house and distance from the brook and buffer was discussed. Ms. Gallent stated that they need more information from the CZMC as to why they are against the proposal. The Board suggested that the applicant request a front yard variance and move the house further from the brook in the rear, limiting the disturbance to construct the house. The matter was taken off the calendar until the CZMC responded to the Planning Board questions. ADJOURNMENT The meeting was adjourned at 10:OOP.M Minutes prepared by Francine M. Brill
