Reader, Chairwoman Robert A. Cohen C. Alan Mason John A. Ortiz Edmund Papazian Virginia Picciotto Marc H. Rosenbaum Also Present: Judith M. Gallent, Counsel Ronald A. Carpaneto, Director of Building Antonio V. Capicotto, Consulting Engineer (?)Anthony Oliveri, P.E. Absent: Elizabeth Paul, Environmental Coordinator Nancy Seligson, Liaison Denise M. Carbone, Public Stenographers Carbone &Associates, Ltd. 111 N. Central Park Avenue Hartsdale, New York 10530 Marguerite Roma, Recording Secretary MINUTES The minutes were not discussed. JOSEPH PATERNO, 50 SHELDRAKE AVENUE BLOCK 221, LOT 41 Public Hearing Preliminary Subdivision/Site Plan Approval On motion of Marc Rosenbaum, seconded by John Ortiz the Public hearing was opened. Mr. Paterno appeared and addressed the Board. Mr. Paterno stated that they went before the Zoning Board of Appeals for a variance for the frontage February 5, 2004, back to the Planning Board for consideration and then back to Zoning. Mr. Paterno stated that the Zoning Board gave them approval with nine conditions. Mr. Paterno handed out revised drawings. The Zoning Board had approved a straight driveway with the garage above. The Board questioned the water and sanitary sewer connections and Mr. Oliveri stated that they have to get that permit from the D.E.F. the Department of Environmental Facilities. The Board discussed the number and placement of dry wells. Mr. Paterno explained that the dry wells will be StormTec Chamber System. The Chair asked if there were any questions. Mr. James Lawless, of 49 Sheldrake Ave. stated that he has had a progressive flooding problem and voiced his concern about more flooding as a result of the building. Mr. Oliveri stated that the applicant is required to have a zero net increase in runoff. Ms. Marion Reichman of 39 Sheldrake Ave. also stated her concerns about flooding. The Chair required the applicant too do a title search to make sure there are no restrictions on the title. Mr. Paterno agreed to do so. Dr. Richard Peter of 53 Sheldrake Ave. stated that he too was concerned about flooding. Mr. Paterno stated that he has been in the basement of the existing house and it has never flooded. Mr. Paterno stated that he does not want to make the problems the people across the street have with flooding any worse and is willing to do whatever is necessary to make the situation better. The Board discussed the application and adjourned the matter to the February 9, 2005 meeting. CUSTOM CAR WORKS LTD./GLEN A. HAZIN SPECIAL USE PERMIT The Matter was adjourned to February 9, 2005 MERCEDES BENZ/CROCCO 2500 BOSTON POST ROAD SPECIAL USE PERMIT Mr. Joseph R. Crocco of 4 MacDonald Avenue, Armonk, New York applicant's Architect appeared and addressed the Board. Mr. Crocco stated that his client would like to take over the Saturn dealership to become a Mercedes Benz dealership. Mr. Crocco stated that there will be between 12 -14 service bays and 2 prep bays. The Board discussed the application, and referred it to the Coastal Zone Management Commission, Westchester County, and New Rochelle.
