1. Minutes
The minutes of May 14, 2008 were approved by motion of Mr. Rosenbaum, seconded by Mr.
Ortiz, unanimously 6-0.
The applications were taken out of order.
2. Application of Take Two LLC, (Bellizzi) 1272 Boston Post Road Special Use
Permit Renewal
No one was present, matter postponed.
3. Application of Ink it up , 2423 Boston Post Road, Special Use Permit
On motion of Mr. Ortiz, seconded by Ms. Dunkin the Planning Board voted to open a Public
Hearing in the matter of Ink it up , 2423 Boston Post Road for a Special Use Permit
Don Mazin applicant's attorney appeared and addressed the Board. Mr. Mazin stated that
the applicant wants to operate a silk screen printing business between the hours of 8 A.M.
and 8 P.M.
Nick Ruggerio the owner appeared and addressed the Board, describing his business. Mr.
Ruggerio stated that he uses water based inks, will recycle boxes, there will be a minimal
amount of trash and noise.
The Board asked if there were any violations, The Director of Building answered no.
The Board discussed the application.
On motion of Ms. Dunkin, seconded by Mr. Ortiz the Board voted to close the Public Hearing.
The Chair asked for a motion.
On motion of Mr. Ortiz, seconded by Ms. Dunkin the following resolution was proposed and
adopted 6-0.
CERTIFICATION
As Chairman of the Planning Board of the Town of Mamaroneck,
I hereby certify that the following is the Resolution adopted by the
Planning Board at the meeting held on June 11, 2008
SPECIAL USE PERMIT
WHEREAS, Nicholas Ruggerio, Ink It Up ("Applicant") has applied for a Special Use
Permit for use of the premises at 2423 Boston Post Road and known on the Tax Assessment
Map of the Town of Mamaroneck as Block 505, Lot 463, to operate a store for the sale of
goods;
WHEREAS, a Public Hearing having been held on June 11, 2008 pursuant to notice;
WHEREAS, the Proposed Action is a Type II action pursuant to the State Environmental
Quality Review Act ("SEQRA") and the Town of Mamaroneck Environmental Quality Review
Law ("MEQRL") and therefore requires no further review under either;
WHEREAS, the Planning Board having considered the application for a Special Use
Permit, the plans submitted by the applicant, comments and responses to questions by the
applicant, the comments of the Consulting Engineer to the Town and having heard interested
members of the public;
NOW, THEREFORE, BE IT RESOLVED that this Board makes finding s of fact as
follows:
1. The proposed use as limited by conditions set forth herein is in general harmony with
the surrounding area and shall not adversely impact upon the adjacent properties
due to traffic generated by said use or the access of traffic from said use onto or off
of adjoining streets.
2. The operation in connection with the Special Use Permit will be no more
objectionable to nearby properties by reason of noise, fumes, vibrations, flashing of
lights or other aspects than would the operations of any other permitted use not
requiring a Special Use Permit.
3. The proposed Special Use Permit use will be in harmony with the general health,
safety and welfare of the surrounding area by the nature of its particular location. It
will not adversely impact upon surrounding properties or surrounding property values.
BE IT FURTHER RESOLVED, that this board APPROVES the application of Ink It Up
For a Special Use Permit to operate a store for the sale of goods subject to the following terms:
1. The hours of operation will be 8:00a.m. to 8:00 p.m. Monday thru Saturday.
2. Permit shall expire after two (2)years.
3. The applicant shall be responsible for the proper maintenance of any garbage
dumpsters used in connection with its business operations and shall comply with any
and all reasonable directives with respect thereto by the Director of Building.
4. The Special Use Permit is subject to the termination requirements set forth in Section
240-64 and 240-65 and the use restrictions set forth in Section 240-30 of the Zoning
Code of the Town of Mamaroneck.
4. Application of Mantu and Lopa Gupta, 4 Rocky Hollow Drive,Wetlands and Water
courses Permit
PUBLIC HEARING Continued
Joseph Cermele of Site Design appeared and addressed the Board. Mr. Cermele stated that the
tennis court is a Har-tru surface over a grade stone, topped with stone dust. They plan to use the
upper grade to fill the lower grade, putting a 3-4 inch trench drain around the court to contain any
sediment runoff from the court.
Anthony Russo, applicant's landscape specialist stated the mitigation plan is to remove invasive
species and add plants to further enhance the wetlands.
The Board discussed the application and stated that the matter must be referred back to the
Coastal Zone Management Commission for further review of the plans, referred to the Zoning
Board of Appeals and a new survey must be submitted. The Board also wanted clarification on
the difference between Wet Lands and the Wet lands buffer, as well as a created Wetlands. The
Board also wanted to know the type of soil and the filtration of the Har-Tru court.
Lisa Hochman raised the question of the easement's on the property.

The matter was adjourned to the July 9, 2008 meeting.
On motion duly made the meeting was adjourned 9:20 p.m.
If anyone wishes to review the audio tape of the meeting of June 11, 2008 it will be
available at the Building department, after the certification is signed by the chairman and
filed with the Town Clerk.
A building permit is required before any work can begin on the aforesaid application.
