Alan Mason, Ellen Dunkin George Roniger Ellen Korn, Alternate Absent: John A. Ortiz Virginia Picciotto Edmund Papazian Also Present: Ron Carpaneto, Director of Building Kevin G. Minutes The minutes of July 9, 2008 were not discussed. 2. Application of 4 Rocky Hollow Public Hearing Adjourned to September 10, 2008 3. Application of John Lage (Car Wash) 2434 Boston Post Road, Consideration Special Use Permit Adjourned to September 10, 2008 4. Application of Ron Trucchio(Rita's Ice Cream Store) 1262 Boston Post Road, Consideration Special Use Permit Joseph Messina applicant's attorney appeared and addressed the Board. Mr. Messina states that his client has already received the Public Health certificate, but that they have not given to the Building Department. Mr. Messina stated that the only work to be done is some interior renovation. Ron Trucchio stated that there will be two areas, the front area will be counter space, custard machines and seating for 8. The back area is for general prep. Mr. Trucchio stated there Planning Board Minutes 8/13/08 page2 will be no cooking appliances installed. Mr. Trucchio stated the only exterior work will be the installation of a sign. Mr. Rosenbaum stated that the Board will require that all deliveries must enter and exit from Boston Post Road only. The Board referred the application to the Coastal Zone Management Commission, Board of Architectural Review, The Village of Mamaroneck, NYS DOT, Westchester County Planning Board, Traffic Committee, Town of Mamaroneck Police Department, and the Town of Mamaroneck Fire Department. The Matter was adjourned to September 10, 2008. Public Hearing 2. Referral from the Town Board Concerning a Proposed Local Law Changing Provisions of the Zoning Code with regard to the Calculation of Lot Coverage Public Hearing On motion of Dr. Mason, seconded by Ms. Dunkin the Public Hearing was opened. The Board discussed the August 12, 2008 memorandum of Mr. Ryan and Ms. Hochman to the Planning Board concerning the proposed amendments to the Zoning Code.. Fred Baron of 693 Weaver Street and a member of the Town Zoning Board appeared and addressed the Board with his concerns. Mr. Baron stated that it was his request that prompted this proposed amendment when he requested that the Town Board clarify what would be included in the lot coverage calculation. As discussed in the August 12 memo, Mr. Ryan concurred with Mr. Barron that the code is inconsistent with respect to what improvements should be included in the calculation of lot coverage and confirmed that this is what the amendment is supposed to clarify. The Board expressed concern that the proposed amendments could have unintended consequences and that additional information should be obtained with respect to (i)the prevalence of impermeable surfaces in residential and commercial zones before the enactment of a blanket rule of the type set forth in the proposed amendments, and (ii) whether changes to the current requirements are needed to solve actual problems created by the placement of ancillary structures (e.g., terraces, pools, etc.). On motion of Ms. Dunkin, seconded by Ms. Korn the Board voted to close the Public Hearing 5-0 On motion of Dr. Mason, seconded by Ms. Dunkin, the Board unanimously voted (1)to approve the Ryan/Hochman Memorandum, subject to certain changes as discussed during the public hearing, and (2)to require that such corrected Memorandum will be submitted to the Planning Board for review to confirm the changes at the next Planning Board meeting prior to transmittal of same to the Town Board as the advisory opinion of the Planning Board concerning the proposed local law.
