Minutes The minutes of March 14, 2007 were approved 6-0, Marc Rosenbaum abstained since he was not present at this meeting. The minutes of April 11, 2007 were approved unanimously. The minutes of May 9, 2007 were approved unanimously. The minutes of June 13, 2007 were approved unanimously. The minutes of August 8, 2007 were approved unanimously. The minutes of September 11, 2007 were approved unanimously. The minutes of October 10, 2007 were approved unanimously. The minutes of November 14, 2007 were approved unanimously. 2. 2 Rocky Hollow Drive - Wetlands and Watercourses - Consideration Leonard Brandes, of Brandes Architects appeared and addressed the Board. Mr. Brandes stated that they were there because of a stop work order because of a problem with a permit that they have to build a pool. When digging out the pool instead of virgin soil it was basically fill. As they were digging out the pool they needed to dig an additional 7- 8 feet to get to solid soil. As a result there was piles and mud every where before they were able to stabilize the pool. The Board questioned whether or not anyone during that time thought that they reached the critical 10 % and needed to get a permit. Minutes 1/9/2008 page 2 Mr. Emanuel stated that there was a question as to the definition of disturbance. He believed that a temporary covering of the grass area and the area inside the buffer zone with mud and machinery did not constitute a disturbance of the buffer as it was not a permanent disturbance. The applicant stated that they would like to remove the dirt and debris and an additional tree well and restore the lawn area back to grade. Mr. Oliveri P.E., stated that since the project has exceeded the 10% threshold under Section 114-6B of the Town Code the application now has to be for the entire project, including the installation and legalization of the pool; updated erosion control, and the plans must show the entire scope of the project, all the disturbances including the fencing along the property line. The Board stated that the site needed to be stabilized with a silt fence and grass seed should be planted as soon as possible, and suggested that the Applicant work out the details with Mr. Carpaneto, who had issued the stop work order. The matter was referred to the Coastal Zone Management Commission at their next meeting January 22, 2008. The matter was adjourned to the February 13, 2008 Planning Board meeting. NEW BUSINESS The Board requested that in the future the professional staff furnish the Board with a short statement on any new matter coming before the Board explaining why a project must be reviewed by the Board (for example, if it is a review pursuant to the Code, stating what section of the Code requires it to be reviewed by the Board).
