1. Minutes
The minutes of December 10,2008 were approved by motion of Mr. Ortiz, seconded by Dr. Mason,
unanimously 7-0.
2. Application of Rocky Hollow Site Plan/Wetlands and Watercourses Public Hearing
The applicant requested an adjournment in order to answer the letter from Creative Habitat Corp.re
assessment of mitigation plans dated January 5,2009.
3. Application of Winged Foot Golf Course Preliminary Subdivision Public Hearing
Public Hearing continued.
Lori Lee Dickson Esq.,of McCullough, Goldberger and Staudt.LLP, appeared on behalf of the
applicant and addressed the Board.
The Chairman stated that there was no response from Westchester County Board of Health regarding
the intention of the Planning Board to declare itself the lead agency.
On motion of Mr. Ortiz seconded by Dr.Mason the Planning Board declared itself lead agency,
unanimously 7-0.
On motion of Dr. Mason,seconded by Ms. Picciotto the Board voted to close the Public Hearing.
The Chairman read the Negative Declaration into the record.
On motion of Mr. Ortiz,seconded by Ms. Picciotto the Negative Declaration was accepted
unanimously 7-0.
The Chairman read the letter from Anthony Oliveri the Town Engineer dated January 14,2009,into
the record.
The Board discussed the application.
Ms. Paul stated that when the applicant comes in with a permit application that they would then be
referred to the Coastal Zone Management Commission.
The Chair asked for a motion.
On motion of Dr. Mason,seconded by Mr.Papazian the following resolution was proposed and
ADOPTED 7-0.
PRELIMINARY LAYOUT RESOLUTION
As Secretary of the Planning Board of the Town of Mamaroneck,
I hereby certify that the following is the Resolution unanimously adopted by the
Planning Board at the meeting held on January 14,2009
WHEREAS,Winged Foot Holding Corporation(the"Applicant")with an address at 851 Fenimore Road,
Mamaroneck,New York filed an application for a subdivision of certain unimproved real property located
between the addresses of 183 and 195 Griffen Avenue(Block 347,p/o Lot 1); and
WHEREAS,in support of the application,the Applicant submitted,inter alia: (i)a Preliminary
Subdivision of the Property,dated August 21,2007,prepared by Thomas C. Merritts,Land Surveyor,P.C.,
(ii)a Hydrological Analysis and Stormwater Management Plan,dated September 2008,prepared by
Kellard Sessions Consulting,P.C.,and(iii)a site plan dated September 18,2008 prepared by Kellard
Sessions Consulting,P.C.; and
WHEREAS,the Planning Board declared its intent to be Lead Agency pursuant to SEQRA and issued
notice to the other involved agencies and,receiving no objections after 30 days,thereby declared itself
Lead Agency for purposes of environmental review under SEQRA; and
WHEREAS,the Planning Board reviewed Part 1 of the Full Environmental Assessment Form submitted
by the Applicant in support of the application, sought and received comments from the Mamaroneck
Coastal Zone Management Commission,and based upon the information,determined that the proposed
subdivision did not have the potential to result in significant adverse environmental impacts and thereby
issued a negative declaration; and
WHEREAS,a public hearing on this application was conducted by the Planning Board on January 14,
2009 at the Town Center on West Boston Post Road,Mamaroneck,New York,after due notice; and
WHEREAS, Section 190-7 (Decision on preliminary layout)of the Code of the Town of Mamaroneck(the
"Code")provides that the Planning Board will communicate its comments on the preliminary layout in
writing to the subdivider; and
WHEREAS, Section 190-8(A)of the Code(Submission of final layout;certificate of approval)provides
that before the Planning Board accepts submission of the final layout of the subdivision plat,the subdivider
shall obtain the approval without qualification of the Westchester County Department of Health,
Westchester Joint Water Works No. 1 or any other agency having jurisdiction in the premises; and
WHEREAS,at the public hearing held on January 14,2009,the Town Engineer,Anthony Oliveri P.E.,
read into the record,in the presence of Applicant's representatives,a letter to Marc Rosenbaum,Chairman,
and Members of the Planning Board,dated January 14,2009,revised January 30,2009,containing
comments and an analysis of the application(the"Town Engineer's Letter"); and
WHEREAS,the Town Engineer's Letter noted that prior to the approval of the final layout of the
subdivision plat,the Applicant shall obtain approval from the Westchester County Department of Health,
Westchester Joint Water Works No. 1 or any other agency having jurisdiction in the premises; and
WHEREAS, following the closing of the public hearing on January 14,2009,the Planning Board
unanimously voted to deliver the Town Engineer's Letter to the Applicant as"comments"pursuant to
Section 190-7 of the Code.
NOW,THEREFORE,BE IT RESOLVED by the duly convened Planning Board of the Town of
Mamaroneck that
1. Pursuant to Section 190-7 of the Code of the Town of Mamaroneck(Decision on Preliminary
Layout),the communications of the Planning Board regarding the Applicant's preliminary plat are
hereby delivered to the Applicant via the Town Engineer's Letter,attached hereto and made a part
hereof; and
2. In accordance with the Town Engineer's Letter,the following requirements are hereby imposed as
preconditions to approval of the final layout:
a. The final subdivision plat shall have a note stating that the subject parcel is located in a
Critical Environmental Area and is subject to the provisions of the Code of the Town of
Mamaroneck.
b. The final subdivision plat should show the easement on the proposed lot in favor of
Winged Foot Holding Corp.
c. The Applicant shall obtain the unqualified approval of the Westchester County
Department of Health,Westchester Joint Water Works No. 1 or any other agency having
jurisdiction in the premises.
ADJOURNMENT
On motion duly made the meeting was adjourned 9:20 p.m.
If anyone wishes to review the audio tape of the meeting of January 14,2009 it will be available at
the Building department,after the certification is signed by the secretary and filed with the Town
Clerk.
A building permit is required before any work can begin on the aforesaid application.
