Central Park Avenue Hartsdale, New York 10530 Daniela Gerardi, Recording Secretary 1. 50 Sheldrake Joseph Paterno (applicant's architect)stated that the test pits and perk test were completed as of April 18, 2005. Mr. Paterno stated that he received the calculations from his own engineer as of April 29, 2005 and had submitted them to Anthony Oliveri. Mr. Oliveri determined they were correct and sufficient. On a motion made by Marc Rosenbaum, seconded by John Ortiz and unanimously approved by all members present, the Planning Board approved the Preliminary Subdivision and Site Plan application. CERTIFICATION As Chairman of the Planning Board of the Town of Mamaroneck I hereby certify that the following is the Resolution adopted by the Planning Board at a meeting held on August 10, 2005. 50 SHELDRAKE AVENUE PRELIMINARY SUBDIVISION/SITE PLAN APPROVAL WHEREAS, Joseph Paterno, has submitted an application for Preliminary Subdivision /Site Plan Approval for the property located at 50 Sheldrake Avenue (Block 221, Lot 417) in proper form and complying with all requirements of the Town, other municipal agencies, and the comments of the Consulting Engineer to the Town and this Planning Board; and WHEREAS,this Board held a Public Hearing on the application for Preliminary Subdivision and Site Plan Approval on November 10, 2004, and continuing on December 8, 2004, January 12, 2005, and August 10, 2005; Town of Mamaroneck Planning Board Minutes August 10,2005 Page 2 of 3 WHEREAS, the proposed action is an Unlisted Action pursuant to SEQRA and MEQRA; and WHEREAS, the Planning Board has adopted a Negative Declaration of environmental significance, a copy of which is attached hereto; NOW, THEREFORE, BE IT RESOLVED, that Preliminary Subdivision and Site Plan Approvals are hereby granted to Joseph Paterno for the property located at 50 Sheldrake Avenue, Block 221, Lot 417 pursuant to the application and subject to the following plans dated 8/10/05: Sheet A-1; Sheet A-2; Sheet A-3; Sheet A-4; Sheet A-5; Sheet A-6; Sheet A-7; Sheet A- 8; Sheet A-9; and to all terms and conditions set forth below: General Requirements The filing of the signed, final subdivision plat shall not be made until the Applicant has recorded in the Office of the Clerk of Westchester County a Declaration of Covenants and Restrictions, in form acceptable to the Counsel to the Planning Board. Special Requirements Water Retention and Drainage The applicant shall comply with the Town Surface Water, Erosion and Sediment Control Law so that the rate of runoff from the property is not increased after construction. Detailed design shall be consistent with the Storm Water Management Plan. Utilities The utility plans shall be coordinated with the landscaping plans to avoid interference with placement and subsequent growth of plantings and the conduct of repair and maintenance activities. Erosion and Sedimentation Control During Construction Erosion and sedimentation control shall be in accordance with the Town Surface Water, Erosion and Sediment Control Law, Erosion and sediment control plans shall be approved by the Town Consulting Engineer prior to commencement of construction. A sediment and erosion control plan shall be submitted which shall include a construction timetable and inspection schedule. Rock Removal All rock removal required in conjunction with construction of the roadway, utilities, and residences shall be by means approved prior to the commencement of any rock removal by the Director of Buildings. Trees Compliance with the Tree Preservation Law of the Town of Mamaroneck is required before a Building Permit shall be issued. Required Documents and Inspections Town of Mamaroneck Planning Board Minutes August 10,2005 Page 3 of 3 The applicant shall provide one Mylar reproducible set of approved drawings to the Town and one copy to the office of the Town Consulting Engineer. The applicant shall submit to the Town one Mylar reproducible set showing the "as built" conditions for utility and sewer connections prior to the granting of a Certificate of Occupancy for the residences to be constructed in this subdivision. Performance Bond 1. The applicant shall furnish to the Town a performance bond or cash deposit in the amount of $4,000 to be combined with the Erosion Sediment Control Permit bond to ensure satisfactory completion of the project and the rehabilitation of the affected or disturbed areas. 2. Westchester Car Wash Group, LLC Kevin Ryan (applicant's attorney) requested renewal of a special permit dated October 20, 2003. The Board closed the public hearing, but left the record open to receive comments from Westchester County Planning Board and adjourned the meeting to September 14, 2005 for the resolution. 3. Elmcroft Estates Joseph Cermele, engineer from Site Designs, addressed the Board regarding the proposed subdivision. Mr. Cermele stated that the applicant is working on an agreement with Winged Foot Golf Club whereby Winged Foot would use the excess water from the subdivision for irrigation of the course. The Board declined to schedule a public hearing until a firm drainage plan is arrived at by Elmcroft Estates and Winged Foot Golf Club. The Board adjourned the application to the next meeting on September 14, 2005. 4. Bonnie Briar Country Club This application was adjourned due to an error in the published notice in the newspaper. The Board rescheduled the public hearing for September 14, 2005 5. Winged Foot Golf Club Steve Worthy(USGA) addressed the Board about the USGA's proposal to have the 2006 United States Open Championship at Winged Foot Golf Club. He continued with an overview of the operational timeline with emphasis on construction requirements Pre-Championship, Championship week and post-Championship. He also discussed the potential impact on neighbors of the Club, the parking and traffic plan, security, potential environmental issues, and the Championship medical, evacuation, and fire plan. The Board scheduled the public hearing on the application for September 14, 2005. Adjournment Secretary to Planning Board
