Minutes The minutes of April 14, 2009 were unanimously approved by motion of Mr. Roniger, seconded by Mr.Papazian. Applications were taken out of order. 3. Robert Sickles 43 Bonnie Briar Wetlands and Watercourses Consideration Applicant requested an adjournment to the June 10, 2009 meeting. 4. Winged Foot Golf Club Public Hearing The applicant requested an adjournment to the June 10, 2009 meeting. 5. 52 Country Road Public Hearing Applicant requested an adjournment to the June 10, 2009 meeting. OLD BUSINESS The chairman, Mr. Rosenbaum stated that the advisory opinion, written by Mr. Ryan regarding the proposed change to the zoning code asked the Town Board to put the matter over to provide more time for the Planning Board to resolve its concerns. Mr. Ryan stated that there were concerns about parking pads and whether or not they would be permitted under the proposed change. He also raised the concern about cars blocking sidewalks. Mr. Rosenbaum asked Mr. Ryan to send a follow up letter addressing the Planning Board's concerns. 2. Rocky Hollow Public Hearing Public hearing continued. Joe Cermele, applicant's architect, appeared and addressed the Board. Mr. Celinele stated that they have (i)revised the plant list for the Wetlands area and mitigation area according to the list provided by Sven Hoeger of Creative Habitat, (ii)increased flood retention, (iii) made provisions for the oak tree near the proposed tennis court and(iv) indicated all of these changes, as well as the declaration of restrictions and covenants, on the revised plans. Mr. Oliveri stated that he found no problems with the revised plans and stated that Mr. Hoeger also had no problems with it. Mr. Rosenbaum asked if there were any questions or comments from the public. Hearing no response, he requested a five minute break for the Board and the applicant to review the draft certification. When the meeting resumed, Mr. Rosenbaum stated that on page 5 paragraph# 6,referring to the 5-year maintenance bond, the words—" to cover the value of replacement of the plantings" should be added, and also the $1,500.00 for the erosion bond should be added. On paragraph# 7 the words "in maintaining the tennis courts" are to be added at the end of the sentence. The hours of work are to be added to paragraph# 12, Monday thru Friday 8:00 am to 8:00 pm, Saturday 9:00 am to 6:00 pm and Sunday 9:00 am to 5:00 pm. Mr. Rosenbaum also stated that as far as the other blanks they will be filled in by the various staff responsible for the information. Mr. Rosenbaum stated that the Board received a letter dated 5/12/09 from Anthony Oliveri stating that the Town Engineer finds that,based upon his review, the plan is consistent with Chapter 114 of the Mamaroneck Town Code with respect to the Wetlands and Watercourses Law and as for the Waterfront Revitalization Law there is no reasonable alternative. Mr. Rosenbaum stated that the project would be an improvement over existing conditions. On motion of C. Alan Mason seconded by Ms. Dunkin the public hearing was closed, 5-0 On motion of C. Alan Mason, seconded by Ms. Dunkin the resolution was unanimously approved with the changes to paragraphs 6, 7 and 12,pursuant to earlier discussion. ADJOURNMENT On motion duly made the meeting was adjourned at 8:35 pm. If anyone wishes to review the audio tape of the meeting of May 13, 2009 it will be available at the Building department, after the certification is signed by the chairman and filed with the Town Clerk.
