1. Minutes
The minutes of March 14, 2007 and April 11, 2007 were not discussed.
2. Dean and Odelya Vivola 30 Dean Place
Diane Neff(the applicant's architect)appeared and addressed the Board. Ms. Neff stated that
the applicant has addressed the four concerns that were presented at the April 11 meeting.
1. The project is in the 100 foot wetland buffer but not within the 100 year flood zone of the
river. It is actually in the 500 year flood zone.
2. A perc test, performed by Jim Lotto Landscape architect and did not encounter any
ground water.
3. The applicants will construct an 8 foot wide gravel tracking pad on the side of the
driveway.
4. In order to restore the wetlands area to it's natural state, the applicant has bought the
required plants and will use hay mulch to prevent erosion until the plants are established.
Excerpts of the Dolph Rotfield Engineering, PC letter, dated May 9, 2007 signed by Anthony
Oliveri, were read into the record.
In particular, the proposed action will not result in degradation of the existing watercourse or
reduce the river's capacity to: support desirable biological life, prevent flooding, control
sedimentation and/or prevent erosion, facilitate drainage, and provide recreation and open space
as it is located within the side yard of an already existing residence
The applicant, (Odelya Vivola) questioned whether she would be responsible to keep planting if
the plants do not survive.
Liz Paul (Environmental Coordinator)stated that she believes that the selected native wetland
plants should not have difficulty growing in the proposed area.
The Board discussed this issue and stated that the resolution would be drafted in a way to make
clear that the applicant would not have a continuing obligation to replant.
On Motion of C. Alan Mason, seconded by John Ortiz the Public Hearing was closed by a
unanimous vote.
The Board discussed this application and its findings revealed that there were little or no adverse
impacts on the neighborhood or community.
After review on motion of Edmund Papazian, seconded by George Roniger the following
resolution was proposed and ADOPTED 7-0.
WHEREAS, Dean and Odelya Vivola (Applicants) have applied for a Wetlands and
Watercourses Permit pursuant to the Wetlands and Watercourses Protection Law of the Town of
Mamaroneck (Local Law 6-2003)Town of Mamaroneck Code, Chapter 114 (the "Wetlands Law")
for the premises located at 30 Dean Place and known on the Tax Assessment Map of the Town
of Mamaroneck as Block 505, Lot 380; and
WHEREAS, the Planning Board of the Town of Mamaroneck ("the Board") has previously
determined that the proposed action is a Type II action under SEQRA and, accordingly, no further
review is required under SEQRA; and
WHEREAS, the Board conducted a Public Hearing pursuant to Wetlands Law§114-7(C)
on April 11, 2007 continuing on May 9, 2007;
WHEREAS, in accordance with Wetlands Law§114-7(D), and as set forth in the report by
the Town's Consulting Engineer(s) and /or other agent(s), which is attached hereto and made a
part hereof, the Board has reviewed and considered:
1. All plans and other documents submitted by the Applicant, including:
"Soil Sediment& Surface Water Control Plan, signed by JG
Lotto, Landscape Architect, dated 3/12/07, revised 4/30/07
Planting Plan prepared by Diane Neff Architect dated 4/3/07
revised 4/24/07
BE IT FURTHER RESOLVED, that the application of Dean and Odelya Vivola for a Wetlands and
Watercourses Permit is hereby GRANTED subject to the following terms and conditions:
1. This permit authorizes the work shown on the plans submitted by the
Applicant to the Board, last revised
2. Prior to the commencement of work pursuant to this permit, the Applicant
shall post a bond in an amount that is sufficient to cover the estimated cost of
the improvements within the buffer of the Wetlands and to ensure the
satisfactory completion of the project in accordance with the conditions and
limitations set forth herein and the rehabilitation of the affected or disturbed
area. An Engineers estimate shall be submitted and approved by the Town
Building Department.
3. At least five days prior to the commencement of the work authorized hereby,
the permit holder shall notify the Building Department of the date on which
the work is to begin.
4. Prior to construction, the Applicant must install all sediment and erosion
controls and clearly delineate the limits of disturbance by use of silt or other
fencing in the field subject to approval of the Building Department and Town
Engineer.
5. The applicant shall plant the native wetlands plants, but will not have a
continuing obligation to replant.
6. Work conducted pursuant to this approval shall be open to inspection at any
time, including weekends and holidays by the Board or its designated
representatives.
7. Within 30 days after completion of all work authorized hereby, the Applicant
shall notify the Director of Building of such completion.
8. This permit shall expire one year from the date of its issuance.
ADJOURNMENT
On motion made by Ellen Dunkin and seconded by Virginia Picciotto the meeting was adjourned
at 8:22PM.
