1. Minutes
The minutes of March 14, 2007 were not discussed.
2. David and Patricia Smalley 10 Wildwood Circle
Mr. Smalley appeared and addressed the Board. Mr. Smalley stated that he appeared before
the Coastal Zone Management Commission (CZMC)on April 5, 2007 and the CZMC found that
the request was neither consistent nor inconsistent
Rob Romano of All American Pools appeared and addressed the Board. Mr. Romano stated
that when the pool was being dug any soil that needed to be stock piled would be stored on the
driveway.
Tom Deick applicant's Landscape designer stated that they hoped that blasting would not be
required and that if it was the clients might not continue.
The Board asked for borings to be done.
Marc Rosenbaum read Dolph Rotfield Engineering letter of 4/10/07 into the record.
The Board stated that the following requirements are to be met, a silt fence is to be erected to
clearly delineate the disturbed area, a Bond is to be set by Ronald Carpaneto, and that the permit
is to be contingent on the requirements set forth in the 4/10/07 letter.
The Board discussed this application and its findings revealed that there were little or no adverse
impacts on the neighborhood or community
After review on motion of John Ortiz and seconded by Edmund Papazian, the following resolution
was proposed and ADOPTED 7-0
WHEREAS, David and Patricia Smalley("Applicants") have applied for a Wetlands and
Watercourses Permit pursuant to the Wetlands and Watercourses Protection Law of the Town of
Mamaroneck (Local Law 6-2003)Town of Mamaroneck Code, Chapter 114 (the "Wetlands Law")
for the premises located at 10 Wildwood Circle and known on the Tax Assessment Map of the
Town of Mamaroneck as Block , Lot 33; and
WHEREAS, the Planning Board of the Town of Mamaroneck (the "Board") has previously
determined that the proposed action is a Type II action under SEQRA and, accordingly, no further
review is required under SEQRA; and
WHEREAS, the Board conducted a Public Hearing pursuant to Wetlands Law§114-7(C)
on March 14, 2007continuing on April 11, 2007;
WHEREAS, in accordance with Wetlands Law§114-7(D), and as set forth in the report
by the Town's Consulting Engineer(s) and/or other agent(s), which is attached hereto and made a
part hereof, the Board has reviewed and considered:
1. All plans and other documents submitted by the Applicant, including
Surface Water, Erosion &Sediment Control Measures, signed Paul
Taormina last revised 2/1/07
2. Report from Costal Zone Management Commission dated April 5,
2007
BE IT RESOLVED, that the application of David and Patricia Smalley for a Wetlands and
Watercourses Permit is hereby GRANTED subject to the following terms and conditions:
1. This permit authorizes the work shown on the plans submitted by
the Applicant to the Board, last revised 2/1/07, and no other.
2. Prior to the commencement of work pursuant to this permit, the
Applicant shall post a bond in an amount that is sufficient to
cover the estimated cost of the improvements within the buffer of
the Premium River and to ensure the satisfactory completion of
the project in accordance with the conditions and limitations set
forth herein and the rehabilitation of the affected or disturbed
area. An Engineer's estimate shall be submitted and approved
by the Town Building Department.
3. At least five days prior to the commencement of the work
authorized hereby, the permit holder shall notify the Building
Department of the date on which the work is to begin.
4. The Applicant shall provide any documentation and manifests
with regard to the origin and composition of the fill materials to
be deposited on the project site for review and approval by the
Building Department and Town Engineer.
5. The Applicant shall submit percolation test results for the
proposed fill areas, once the fill has been placed and prior to
drywell installation, for review and approval by the Town
Engineer.
6. Work conducted pursuant to this approval shall be open to
inspection at any time, including weekends and holidays by the
Board or its designated representatives.
7. Prior to construction the applicant shall install all sediment and
erosion controls and clearly delineate the limits of disturbance by use
of silt or other fencing in the field subject to approval of the Building
Department and Town Engineer.
8. The Applicant shall perform percolation tests to confirm the assumed
percolation rates used for design in conformance with the CZMC's
findings.
9. In the event that high ground is found to interfere with the proper
functioning of the proposed drywells, an alternate method of
stormwater detention and/or water quality measure shall be utilized
in conformance with Section 95-8, Erosion and Sediment Control of
the Town Code and subject to approval by the Town Engineer.
10. Within 30 days after completion of all work authorized hereby, the
Applicant shall notify the Director of Building of such completion.
Upon such notification, the Building Department shall follow the
procedures set forth in Town Code § 114-9.
11. This permit shall be prominently displayed at the project site during the
undertaking of the activities authorized hereby
12. This permit shall expire one year from the date of its issuance.
3. Dean and Odelya Vivola 30 Dean Place
Diane Neff applicant's architect appeared and addressed the Board. Ms. Neff stated that they
appeared before the Coastal Zone Management Commission and the CZMC stated their findings
were the project was neither consistent nor inconsistent. The CZMC had some recommendations
that the drainage system be moved closer to the retaining wall; the applicant supply a planting
plan for the wetlands restoration and the installation of a gravel tracking pad during construction.
Ms. Neff stated that the installation of the gravel tracking pad would be onerous to the Applicant.
Liz Paul stated that possibly some other solution to the tracking pad could be explored.
Anthony Oliveri suggested that the area of the driveway that is to be removed could be made into
the tracking pad.
The Board discussed the matter and Adjourned the matter to May 9, 2007.
ADJOURNMENT
On motion made by John Ortiz and seconded by Virginia Picciotto the meeting
was adjourned at 8:36PM.
