Y. held September 7th, 1932 In the absence of the Supervisor the meeting was called to order by Justice Boyd at 8:40 P. Ifl. Present: Justices Boyd, Leeds, Town Clerk Varvin The presence was also Messersmith and Burbank noted of Counselor Gamble A communication dated August 22nd was received from lvlajor Franklin Brooks of Larchmont in reference to continuing the audit of the accounts of the Town. After discussion the Clerk was directed to reply that it is still the opinion of the Board to take no action regarding an audit pending receipt of the copy of the report recently made by tie State Auditors.. A communication dated August 22nd was received from the State Comptroller advising the Board that the Department of Audit and Control will sena the Board a copy of the report of the exam- ination of the Town as soon as possible. The communication was ordered receivea and placed on file. Counselor Gamble reportea on the terms of the proposed contract with the Chatsworth Oil ana Heating Company for installa- tion nstallertion of an oil burner, tank, etc. in the ;'leaver Street Fire House. He stated that the cost of the installation would be .x.731. and that the Company was willing to make the installation on a rental basis, to be paid t-..400. upon installation with the option to pur- chase the entire equipment upon payment of x-331. in January, 1933. Upon motion by Justice Igessersmith, seconded by Justice Leeds, it was unanimously FCESOLT.MD, that the terms of the proposed purchase of an oil burner, etc. at the Weaver ,Street Fire House as outlined by Counsel be and they hereby are approved; and be it further RFSOL77D, that the bidder prepare a contract along these line's and submit it to Counsel for his approval and that the Supervisor be and he hereby is authorized to sign such contract upon the approval of Counsel. A communication dated September 6th, 1932 from hark Wolff relating to the expense of the recent electric light rate reduction litibation was receivea and placed on file. _ The Clerk reported that he had been served with a summons and complaint in the Llatter of Faith S. Kelley vs. James M. Lynch, Town of hamaroneck, et. al., which involved the Town to the extent -- of certain taxes. The matter was ordered referred to Counsel. The Clerk reported that he had been served with a summons and complaint in the matter of Frank E. Hirshstein vs. Isiaore Srokamt Town of Yamaroneck, et. al. which involved the Town to the extent ,of;certain taxes. The matter was referred to Counsel. 265 Counsel reported that Frank E. Hirshstein had heretofore commenced a number of actions to foreclose tax liens in which the Town had been made a party and had been served and that these matters had been referrea to him at a prior meeting. He reported that he had filed.a notice of appearance in each action on behalf of the Town of Mamaroneck and that in a number of the actions the tax liens had been paid and the actions settled and discontinued and that he was advised by Posner & Posner, attorneys for the plaintiff that they anticipated that the other actions would be settled from time to time. He further stated that there was no liaoility in connection with the actions so far as the Town was concerned. Counsel reported progress in regard to the following matters: (1) Request of Zoseph Mercadante for refund of ;;5,000. deposit for installation of water mains in Maple Hills, Part 2; (2) Easement and right-of-way on Lester and Williams Place; (3) Action in regard to automobile "graveyard" on Palmer Avenue ; A claim was received from Theodore D. Slingman, Jr. for refund of taxes together with a communication from the Receiver of Taxes approving of same. The claim and communication were re- ferred to Counsel. A communication dated August 20th was received from the County Department of Health concerning the cutting of ragweed, a matter which the Town Board had previously referred to the Depart- ment of Health. The communication was referred to Counsel for an -- opinion as to the powers of the Town in the matter. A communication dated August 30th was received from the - County Department of Health regarding the cleaning of the Larcivmont Gardens Lake. The communication was ordered referred to the Supervisor. A communication dated Septeruoer 1st was received from the Larchmont Gardens Association enclosing copy of a resolution passed by the Larchmont Gardens Association requesting the Town to acquire the Larchmont Gardens club house, grounds and lake. The matter was ordered referred (Justice Messersmith not voting) to the Supervisor, Counsel, the Park Commission and the Sewer Commission. A communication dated September 2nd was received from the Community Drama Society requesting the use of the Town Hall for the rehearsals of a dramatic performance. The request was approved and permission was given to use the Town Hall on the dates specified. A cormaunication was received from the ILamaroneck American Legion Post requesting permission to use the weaver Street Fire House on October let. The cormaunication was ordered referred to the Fire House Committee with power. A communication dated August 5th was received from the Westchester County Chapter of the New York State Society of Professional Engineers, Inc. in regard to the Engineers' Practise Law. The communicauion was ordered referred to the Building Commission. The report of the Town Clerk for the month of August was ordered received and placed on file. The Town Clerk advised the Board that it was in order to set the salaries of the Election Inspectors whose terms of office began September ist. He recommended reducing the salary from :x,12.00 to X10.00 per day. He also suggested revising the rental paid for the use of Polling Places. 267 After discussion these matters were ordered laid over for further consideration when the entire Board could be present. The Clerk advised the Board that it was in order for the Board to designate the places for registering and voting during the coming year. After discussion, it was upon motion by the Clerk, seconded by Justice Boyd, unanimously RESOL==D, that in accordance with the provisions of Article 66 of the Flection Law, being Chapter 17 of the Consolidated Laws of the State of New York as amended, the Town Board of the Town of Mamaroneck hereby desig- nates the place in each election district in the Town at which the meetings for the registration of voters and elections and primaries shall be held in the year following the ensuing first day of October.
