The meeting was called to order at 7:30 P.M.

2. 21 York Road - 21 York Road LLC - Consideration
Mark Mustacato, the applicant's architect, stated that they wish to demolish the existing house
and propose to build a new house. The existing driveway is to remain, but they are proposing a
second curb cut for a circular driveway using some permeable pavers. Also there will be re-
grading to create a more usable yard. Benedict Salanitro, the applicant's engineer, and Anthony
Acocella the applicant's landscape architect, were also present to answer questions.
Ira Block asked if the foundation is to remain and Mr. Salanitro responded that it is to be
removed. Mr. Block also stated that the 26" oak tree should not be removed for the installation
of the driveway, as the tree must absorb a lot of water and Mr. Block also stated his concerns
regarding the 42" oak in the rear yard by the patio.
Mr. Mustacato stated that the rear tree is very close to the house and will probably not survive
construction. Mr. Salanitro added that all but one tree in the rear is being saved.
Mr. Salanitro stated that the proposed footprint is slightly larger than the existing residence, and
he viewed the property as vacant land for the storm water calculations. Although the property
has large rock outcroppings they propose to capture 100% of the runoff The water flow was
discussed. The Board discussed the proposed wall which will be installed 8 inches off the
property line so as not to interfere with the neighbor's water flow.

Ms. Weingarten stated concerns with the large amount of paving. Mr. Salanitro stated that they
would be willing to add more pervious pavers.
Mr. Wasp stated that the driveway must be at least 5 feet from the property line.
Ms. Hochman requested documentation of zoning compliance from the Building Inspector.
Mr. Block asked why two curb cuts were necessary. He further stated that the two previously
identified trees appear healthy and speculated that the only justification for their removal is
because they are too close to the driveway and patio.
Mr. Wasp explained that the impact of construction to a tree is determined by the tree's drip line.
Ms. Weingarten observed that the rear tree is very close to both the existing and proposed house.
Mr. Wasp requested that the maintenance of storm water system should be shown on the plan
and also the maintenance proposed for the pervious pavers.
Anthony Acocella described the proposed landscape plan.
Mr. Mustacato explained the proposed house including its interior and elevations. The board
discussed the height of the proposed house in relation to the neighboring houses.
Mr. Mustacato stated that the house is being built to the buyer's specifications.
At the applicant's request, the application was referred to Coastal Zone Management
Commission for their October meeting.

Mr. Block initially abstained stating that he wants more information about the trees.
Ms. Weingarten suggested that Ms. Paul could advise the board regarding the trees.
Ms. Hochman suggested that a public hearing can be scheduled for November but that does not
require the board to open the public hearing.
Mr. Block stated he wants an expert opinion regarding the removal of the trees.
Mr. Block agreed to allow the application to be scheduled for a hearing in November with the
understanding that such a hearing will not be opened unless sufficient information in regard to
the condition of the oak trees has been provided.
