SP7CIAL MEETING OF THE TOWIT BOARD

held March 31st, 1932
at the Office of the Town Commissioner of
Public Welfare
141 Mount Pleasant Avenue
Mamaroneck, N. Y.
The meeting was called to order by the Supervisor at 8:50 P. M,`
Present: Supervisor Burton
Justices Boyd, Messersmith, Burbank
Town Clerk Marvin
The presence was also noted of Special Counsel J.. Henry
Esser, Town Commissioner of Public Welfare Bloomer and Deputy Town
Commissioner of Public `Welfare Scherff.
The Supervisor stated that the Board was meeting in accordance
with the terms of the resolution passed at the meeting on March 22nd
to hear the answer and report of the Town Commissioner and Deputy
Commissioner of Public Welfare concerning the petition presented to
the Town Board at its meeting on March 22nd. He stated he desired to
submit to the Board a mtatement, which statement declared he was
presenting to the Board the following:
1. "Communication from Mr. Bloomer and Mrs. Scherff."
2. 11Opinion of Attorney J. Henry Esser which I have asked
him for.'
3. "Proposed resolution which I will gladly offer and which
I recommend as outlining the proper course for this
Board to pursue."
The statement to the Board by the Supervisor was read by the
Clerk and ordered received and placed on file.
The communication from Mr. Bloomer and Mrs. Scherff, being
their answer and report concerning the petition submitted to the
Board on March 22nd was received and read by the Clerk and ordered placed
on files
The opinion of Attorney J., Henry Esser in the foam of a letter
to the Supervisor was read by the Clerk and ordered received and placed
on file.
The resolution referred to by the Supervisor in his statement
was moved by Justice Messersmith, seconded by Justice Boyd and unanimously
approved as follows:
WHFRH•AS, a petition -has heretofore been presented to this
Board asking for the removal of Mrs. Bessie Sc'nerff as Assistant Town
Public Welfare Officer, which was accompanied by a letter asking also
for the removal from that department of Mr. John J. Bloomer, and
WHERH'AS, said petition contains no facts showing any
dereliction of duty by either; and
`;7HTREAS, it is the intention of this -board to have the Public
Welfare Department of the Town at all times administered in an honest
and upright manner, with equal consideration for those who apply for
relief, as well as those who furnish the relief}
RESOLVED. that any applicant for relief to the
Public Welfare Department, whether he or she may
have signed the aforesaid petition or not, who
feels that relief has not been fairly given in
his or her case is hereby requested to day the
facts before the Town Board in affidavit form,
and any such facts so presented will receive due
and proper consideration.
communication dated Larch 25th vias received from Henry
R. Dillon, Receiver of Taxes, advising the Board that subject to its
approval, he had deputized Mr. William H. Yitzsimmons, an employee of
his office, to perform any and all of the duties of Receiver of Taxes
thereamong the duty of receiving tax money, giving proper receipt
therefor in his name and entering same upon the records andcepositing
the tax money in the bank as required by law; and also authorizing and
requesting the Supervisot to pay to Mt. Fitzsimmons his aalary and
compensation at the rate of E,�2,750.00 per year and charge the same
to the salary fixed for the Receiver of Taxes and agreeing to include
the same in the monthly.voucher to be verified by him.
Upon motion by Justice Boyd, seconded by Justice Messer -
smith, it was upon roll call unanimously
RESOLVED, that the action of Henry R. Dillon,
Receiver of Taxes, in deputizing lir. William
H. Fitzsimmons as above described, be and it
hereby is ratified, approved and confirmed.
The Supervisor advised the hoard that the roof of the 'i'own
Hall was in serious need of repair and suggested that the repairs
be made at an early date, in order to protect the ceiling of the build-
ing which had recently beer, repaired by order of this Board.
The Clerk was by resolution unanimously directed to obtain
estimates of the cost of repairing the roof.
A copy of a resolution from Counselor Gamble vias received
on the petition of Idamaroneck Post X90, American Legion, requesting
that the Legion's property at the southwest corner of -Palmer :Avenue and
Delancey St. be marked exempt, said resolution embodying his report
thereon.
The resolution vias moved by the Town Clerk, seconded by Justice
Boyd and upon roll call unanimously approved as follows:
WHEREAS a petition has been presented to this Board by
Hamaronedk Post #90 of the American Legion, requesting that the property
owned by said Post situated at the southwest corner of Palmer :avenue
and Delancey Street in the Village of ioamaroreck tuned by it since
March 1929 be exempted from taxation on the Assessment Roil of the Town
of Mamaroneck, which property is described on said Assessment Roll as
Lots 5 and 6 in Block 26, Section 9, and
WHEREAS, said property is entitled to exemption from taxation
under Section 4 of the Tax Law of the State of New York,
THEREFORE, BE IT RESOLVED, that the petition of Mamaroneck
Post No. 90 of the American Legion be granted;
PURTH17R R7SOLVFD,that the Supervisor and the Receiver of
Taxes and the Board of Assessors be and they hereby are
authorized, empowered and directed to exempt from taxation,
pursuant to Section 4 of the Tax Law of the State of New
York, the property of said Mamaroneck Post No. 909 des-
cribed on the Assessment Roll of the Town of Mamaroneck,
as Lots Nos. 5 and 61 Block 26, Section 9;
FLRTHFR RFSOLVED, that this resolution be effective as of
this date.
The report of the .supervisor for the month of February was
received, ordered spread upon the minutes and placed on file.

A petition was received from Louis Pourcade as agent of the
owner of property known as Section 1, ijIock 308, Lot 20 on the Town
Assessment map requesting cancellation of certain taxes.
The petition was ordered referred to Counsel.
At 11 P.M. the Board unanimously resolved to recess to meet
again at the call of the chair to take up such matters as might properly
come before it.
