The meeting was called to order by Supervisor Burton at Present: Supervisor Burton Justices Boyd, Leeds and Burbank Town Clerk Marvin The presence was also noted of Special Counzelor Esser. Chairman Stevens of the Board of Sewer Commissioners of Sewer District No. 1 addressed the Board and explained the Commission*s request for a certificate of indebtedness in the amount of :,'x,;2,839.67, which request was presented to the Board at its meeting on the previous day. He said that the amount requested was for part of the cost of construction only and did not include anything for the easement which was presented to the Town without charge by the owner of the property, Mrs. Alice Tansey, who also paid part of the cost of construction. an motion by Justice Boyd, seconded by Justice Leeds, the following preamble and resolution were adopted: RESOLUTION AUTHORIZING TH^ ISSUANCE OF CERTIFICATES OF INDEBTEDNESS OF THE TOWN OF MAHARCYTCK, IN THE AMOUNT OF ,$2,839.671 TO PAY THE COST OF CONSTRUCTION OF A PORTION OF THE SEWER SYSTEM IN SF 7R DISTRICT #1 IN SAID TOWN. WHEREAS, the following report has been received from the Sewer Commissioners of Seger District #1 in the Town of Mamaroneck: February 27, 1930 The Town Board of the Town of Mamaroneck 8 Elm Street Mamaroneck, Yew York. Gentlemen: We beg to advise you that the total construction cost to be borne by this Commission of constructing the Sanitary Sewer Line from a point in Vine Place to Forest Avenue through an easement obtained and held by the Town of Mamaroneck, exclusive of engineers fees and incidental cost is :;$2,839.67, warrants in which amount have been signed by us on the certificate of our engineer. So that the Supervisor may be placed in funds with which to :rake payment of the cost of this construction work, we respectfully ask your Board to authorize the Supervisor to issue and sell Certif- icates of Indebtedness in said amount to cover the aforesaid construction cost. Now, therefore, be it RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMAROYFCQ IN THE COUNTY OF WESTCFIE'STFR, NEW YORK, AS FOLLOWS Section 1. To pay the estimated cost of the construction of a part or portion of the sewer system in Sewer District 1, of the Town of Mamaroneck, as en- larged and extended, the Supervisor is hereby authorized and directed to issue and sell a Certificate or Certificates of Indebtedness of said Town, not exceeding the maximum principal amount of $2839.64. Section 2. Said Certificate or Certificates of Indebtedness shall be payable as to both principal and interest in not exceeding twelve months; shall be in such denomination or denominations, shall bear such date, and such rate of interest not exceeding six per centum (6 per annum, as shall be determined by the Supervisor upon receipt of bids; shall be numbered consecutively commencing from the number of the last Certificates of Indebtedness of the Town, issued for such purposes, and shall be in sub- stantially the form set forth in a tesolution entitled: "Resolution determining the form of Certificates of Indebted- ness issued to pay the cost of the construction of the Sewer System in Sewer District #l, of the Town of Mamaroneck," duly adopted by the Town Board on August 28th, 1931. Section 3.. Said Certificate or Certificates of Indebt- edness may be sold by the Supervisor from time to time as the money may be needed at private sale for the best terms obtain- able, provided that said Certificate or Certificates of Indebtedness shall not be sold for less than their par value.. Section 4. Said Certificate or Certificates of Indebt- edness shall be general and unlimited obligations of the Town of Mamaroneck. The full faith and credit of said Town are hereby irrevocably pledged to the punctual payment of the principal and interest of said Certificate or Certificates of Indebtedness as the samd shall become due, and unless said Certificate or Certificates of Indebtedness are paid or payment provided for, an amount sufficient to pay the principal and interest thereof shall be included in the annual statement for tax purposes. The foregoing resolution was adopted by the following vote: Ayes: George W. Burton, Supervisor Walter R. Marvin, Jr. Town Clerk William A. Boyd Justices William D. Leeds I of the Walter C. Burbank) Peace Nays: None. The following communication was received from Santo Lanzg, Receiver of Taxes, ordered entered in the minutes, and filed. March lst, 1932 Town Board, Town of Mamaroneck, New York Gentlemen: v h1' This is to notify you that George F. Johnson has not reported at the office of the Receiver of Taxes since January 19th, 1932 and that he is no longer connected with this office. Very truly yours SANTO LAYZZA; Receiver of Taxes. The following communication was received from the Receiver of Taxes and ordered entered in the minutes, filed and the action of the Receiver of Taxes unanimously approved. February 29th, 1932 Town Board, Town of Mamaroneck, Few York Gentlemen: Subject to your approval I hereby deputize Mr. H. Rodman Dillon an employee of this office to perform any and all of the duties of the Receiver of Taxes, thereamong including the duty of receiving tax money, giving proper receipt therefor in my name, entering same upon the records and depositing the tax money in the bank as required by law. I further authorize and request the Supervisor, from and after this date, to pay to Mr. Dillon his: salary and compensation at the rate of X2,700.00 per year and charge the same to the salary heretofore fixed for the Receiver of Taxes, and I agree to include the same in the monthly voucher to be verified by me. Very truly yours (signed) SANTO LAYZA Receiver of Taxes Upon motion by Justice Boyd, seconded by the Clerk, it was upon roll call unanimously RT'S0LV7D, that the action of the majority of the- members hemembers of this Board an January 27, 1932, in employ- ing J. Henry Esser, Esq. as Special Counsel to protect the Town's interests in connection with the alleged shortage in the Receiver of Taxes' office, and matters incidental theretc 0e ratified, adopted and approved. Upon motion by Justice Boyd, seconded by the Clerk, it was upon roll call unanimously R7SOLV7D, that Special Counsel be and is authorized to procure a bond in the sum of $25,000. in suitable form to protect the Town by reason of Ur. Dillon's employment in the Receiver of Taxes' office. At 11:20 the Board unanimously resolved to recess to meet again at the call of the chair to take up such matters as might properly come before it. TownClerk
