HomeMy WebLinkAbout1993_02_11 Board of Ethics Minutes TOWN OF MAMARONECK Board of Ethics Minutes of February 11, 1993 A meeting of the Town of Mamaroneck Board of Ethics was held on Thursday, February 11 at 7:45 p.m. at the Town Center. Those present: John Herz, Carol Miller, Anna Reisman and Nina Recio, chairperson. The Board unanimously approved the draft opinion dated January 20, 1993 in which it was stated that § 24-5 of the Town Ethics Code was violated in the case of Peter Perciasepe, the Town's Fire Inspector and Secretary of the Fire Council of the Town of Mamaroneck Fire District, who also served at the same time as Treasurer and Acting Treasurer for the Town Republican Committee campaign. Nina Recio asked the Board's opinion as to whether she, as Assistant Town Prosecutor,could accept an appointment to the Town Zoning Board. The Board agreed that if she avoids prosecuting in a specific case connected with her service on the Zoning Board there would be no conflict. Conflict only arises in a specific case where she serves in a dual capacity. In response to a query from Stephen Altieri, Town Administrator, regarding disclosure of contributions to any Town political organization on the part of contractors and vendors doing business with the Town, the committee agreed that §24-6 E of the Town Ethics Code states the requirement for disclosure and that the means for securing disclosures proposed by Steven Altieri are acceptable. The next meeting of theEthics Board is tentatively scheduled for Wednesday, March 24th. The business of the meeting will be to examine disclosure forms of persons in sensitive position with the Town. You have advised us that Mr. Peter Perciasepe is a paid non-elected employee of the Town of Mamaroneck who serves, on a part-time basis, as the Town's fire inspector and who also receives a stipend frau the Town for serving as Secretary of the Fire Council of the Town of Mamaroneck Fire District. We are aware, also, that while Mr. Perciasepe has served in these capacities, he has served, simultaneously, as the Treasurer and Acting Treasurer for the Town Republican Committee Campaign. This is evidenced by the New York Board of Election Disclosure Statements. Section 24-5 F of the Town Code of Ethics prohibits any paid non-elected employee from contributing money, property or service to any town political organization, campaign or candidate. It is our unanimous opinion that, on its face, Mr. Perciasepe's conduct appears to violate the provisions of the Code of Ethics. N.
