MEETING OF THE TOWN BOARD

The meeting was called to order by, Supervisor Burton at 8:55 PIi.
Present: Supervisor Burton
Justices Boyd, Yessersmith, Burbank
Town Clerk Itarvin
The regular order of business was suspended in order to hear
those who desired to address the Board.
Mr. Edward C. Griffin, former ISa3wof Larchmont, spoke on
behalf of the Larchmont Unemployment Relief Committee, saying that the
operating expenses of the Committee had been very small and that the
Village of Larchmont had contributed $300.00 towards these expenses.
He requested the Town Board to appropriate a like amount for the same
purpose.
,After discussion it was on motion by Justice Messersmith,
seconded by Justice Boyd, upon roll call unanimously
RESOL TD, that the sum of $300.00 be and it
hereby is appropriated for immediate payment
to the Larchmont Unemployment Relief Committee
from funds otherwise unappropriated for the
purpose of defraying in part the operating
expenses of said Committee.
Mr. Griffin thereupon thanked the Board for its action.
Nr.. Jozeph Pittera of Lester Place addressed the Board in
regard to the matter of installing water and sewer mainX in Lester and
Williams Places in accordance with the terms of a petition heretofore
presented to the Board. After discussion he deposited $30.00 in cash
with the Town Clerk as part payment of the cost of having an engineer
stake out the street lines and the lines of the proposed water main
in order to give the Board a more definite idea of the location of these
streets.
Mr. Morton P. Saxfaty addressed the Board in connection with
a communication from the Estate of H. J. Douglas, Tnc., requesting
zoning classification on a piece of property on North Chatsworth Avenue

or the purpose of erecting a store building thereon. The matter was
ordered referred to the Building Commission and Counsel.
There being no other person present who desired to address the
Board, the regular order of business was resumed.
The report of the Town Clerk for the month of January was
ordered received and placed on file.
An invitation was received from St. Johnfs Vpisco. Church
of Larchmont inviting the Board to attend a community service of thanks-
giving commemorating the two hundredth anniversary of the birthday of
George Washington. The Clerk was directed to acknowledge the invitation
with thanks and to request that four seats be reserved for members of
the Board.
A communication dated lurch 3rd, was received from the Railroad
Co-operative Building and Loan Association in regard to refund of taxes
on property known as Section 12 Block 458, Lots 55, 56, 57, and 58. The
communication was ordered referred to Counsel.
A communication dated February 10th was received from 'a'mil
Zvirin suggesting that Cooper Lane be made a full stop street at the
point where it enters Weaver Street. The communication was ordered
received, placed on file and referred to the Police Department.
IVIr. H. J. Brewer, a Director of the Westchester County Commuters''
Association, presented a resolution calling for a changeAn the laws whereby
a municipality may have the right to take part in proceedings before the
Public Service Commission 'in regard to rates, etc.
After discussion, Justice Messersmith moved and the Clerk
seconded the resolution above described which was unanimously approved
by the Board and is as follows:
RESOL17D, that the members of the state Legislatureq
representing districts including any portion of
Westchester County, are hereby requested to take
the necessary steps, without delay, to cause the
adoption by the Legislature of the State of New York
and approved by the Governor, of an act, or a sub-
stantially similar act, as follows:
AN ACT to amend the public service law, in relation
to appearance by municipalities and consumers in
hearings or proceedings involving rates or service
of public utility companies.
The People of the State of New York, represented in
Senate and Assembly, do enact as follows:
Section 1. Chapter four hundred and eighty of the laws
of nineteen hundred tan, re -entitled by Chapter seven
hundred and eighty-two of the laws of nineteen hundred
thirty "An act relating to the public service of utility
companies, constituting chapter forty-eight of the
consolidated lavas", is hereby amended by inserting in
article six thereof, which was added by chapter seven
hundred and ninety-two of the laws of nineteen hundred
thirty, a new roection, to be section one hundred and
six, to read as follows®
106. Appearances of municipalities or consumers.
-Tach municipality shall have the right to appear as a
party in any action or proceeding before the commission or
before any court involving rates, service or other matters
affecting the municipality or any of its residents. Ind-
ividual consumers or associations of consumers may likewise
participate in all such actions or proceedings before
the commission or before a court, provided, however, that
the commission or a court may in its discretion group $le
interest of such individual consumers or associations
of consumers so as to assure orderly procedure.
2. This set shall take effect immediately; and be
it further
RFSOLVTD, that the Clerk sends a certified copy of this
resolution to Assemblyman Gamble, Senator lestall and
Mr. Brewer.
Justicd Idessersmith reported on the matter of the appropriation
by the Town Board to the Larchmont Public Library. He declared that
he had discussed the matter with the officials of the Department of
Fducation during a recent visit to Albany and that they had assured him
that such an appropriation was entirely proper and within the law. He
added that, in fact, there are two laws on which the Town may make an
appropriation, viz: the Town Law or the 7ducational Law. He declared he
would submit a written report on the matter.
Justice Idlessersmith reported on behalf of the Firehouse Committee
that the Committee obtained the voluntary services of 6ne of the leading
heating engineers in the country to advise the Committee concerning the
proposed changes in the heating plant at the 'leaver Street Firehouse®
Members of the Board expressed their gratification at this report..
The Supervisor advised the Board regarding the situation in
connection with Sewer Contract Pio. 20. He stated that the Board had on
April 22nd, 19309 authorized Certificates of Indebtedness to be issued
in the principal amount of $45,000. plus interest which may from time
to time accrue thereon, the proceeds of which authorization were to be
used to pay the cost of said Contract P7o. 20, and had on August 28, 19311
authorized the extension of Certificates issued on said Contract for an
additional period of time not exceeding eighteen months from the date
thereof.. He stated that it had been necessary to pay interest on maturing
Certificates of Indebtedness from time to time and it would be necessary
to pay additional interest on Certificates which would hereafter mature
and that an additonal Certificate had been issued for interest on this
Contract and others in the amount of*'10,000. and that through an error
in the resolution of August 28, 1931, the authorization of $459000. for
said Sewer Contract Yo. 20 should have read $551,000.
Upon motion., duly seconded, it was
RFSOLVrD, that the resolution of August 289 1931 be
and the same hereby is amended to the extent solely
that the authorization in subdivision numbered 1 of
said resolution shall read "Certificates of Indebtedness
in the principal amount of X55$000, for said Sewer
Contract No. 20 anal/or to borrow upon the faith and
credit of the Town of lAamaroneck a sur: of not to
exceed 855,000, for said Contract No. 201r, and the
same to be substituted for and instead of the $45,800.
for said Conttact No. 20 appearing in said resolution..
FURTHER RFSOLVEOp that the aforesaid resolution of
August 28, 19319 is hereby ratified and confirmed
except to the extent herein corrected and amended.
The foregoing resolution was adopted by the following vote.

Upon motion duly made and seconded the -board unanimously
resolved to recess at 10.45 P. Id. to meet again at the call of the
Chair, to take up such matters as properly come before the Board.
