Y. 8 The meeting was called to order by Supervisor McCulloch at P. Pli. Present: Supervisor McCulloch Councilmen Bates, Brewer, Griffin, Mandeville Absent: None The presence was also noted of Town Clerk Payne, Town Attor- ney Delius, Comptroller Luceno, Assessor Smith and Town Engineer and Superintendent of Highways Foote. The Supervisor asked if there was any one present who wished to address the Board. Mr. Emil Zvirin, real estate broker, and Mr. Orson A. Raynor, attorney representing the Pine Brook Syndicate, appeared to request that the Board give further consideration to a compromise on tax arrears on vacant land known as Block 501, Parcels 345 and 296. Following a lengthy discussion during which Mr. Zvirin explained that the property was to be improved with four new dwellings and that the offer for settlement had been raised to the limit that would permit the project to be started, it was on motion by Councilman Griffin, seconded by Councilman Mandeville, upon roll call, unanimously RESOLVED, that the Receiver of Taxes and Assess- _ meats be and he hereby is authorized, empowered and directed to accept the sum of $667.06 in pay- ment of the following tax liens on Block 501, — Parcels 296 and 345 (old designation - Section 5, Block 2, Lots 2 to 8 inclusive) : Tax Sale Amount of Year Year Lien 1930 1931 $ 52.50 1932 1933 90.23 1933 1934 123 .27 1934 1935 174.93 1935 1936 137.48 1936 1937 143.71 1937 1938 148.24 1938 1939 165.30 1939 1940 159.69 1940 1941 161.21 FURTHER RESOLVED that the sum of $132.94 be accepted in payment of the following current taxes at their full value on Block 501, Parcels 296 and 345: 1941 State, County $93.50 and Town Tax 1941 School Tax 39.44 FURTHER RESOLVED, that the Supervisor be and he hereby is authorized, empowered and directed to cancel from the records in his office the difference between the amount paid and the amount of the liens outstanding on the books of the Receiver of Taxes. Assistant Village Attorney Sirlin of Mamaroneck appeared before the Board to present the proposed contract of sale for Block 902, Parcel 558 also known as 1 Depot Square, Village of Mamaroneck. The terms of sale showed as follows: 3,000 on signing the agreement, $3,000 a year for the following three years and $250 per month for the last year. Following some discussion it was on motion by Councilman Mandeville, seconded by Councilman Griffin, upon roll call, unanimously RESOLVED, that the proposition submitted by the Village of Mamaroneck for the sale of property known. as Block 902, Parcel 558, also known as 1 Depot Square, be accepted, provided appraisals are obtained, one from a qualified local appraiser and one from a qualified out-of-town appraiser, which are satisfactory to this Board and in their opinion support the sale of the property mentioned in the contract; otherwise the offer is to be rejected. A letter dated February 11, 1942, was received from Wm. H. Johnson, Village Manager of the Village of Mamaroneck, with which he enclosed a copy of the single bid received after public notice was duly given for the sale of property known as Section 9, Block 47, Lots 1 to 4 inclusive. The bidder, Frank J. McNamara, offered the following: Feb. 2, 1942 Mr. Vim. H. Johnson Village Manager Mamaroneck, N. Y. Dear Sir: I hereby submit bids for parcel of real property located at 525 Cortland Avenue, Mamaroneck, N. Y. as advertised Jan. 20, 1942 as follows: Sec. 9, Blk. 47, Lots 1-4 incl. Plot 200 x 125 ft. with house and garage for the sum of Three Thousand ($3,000) Dollars. -or- Sec. 9, Blk. 47, Plot 125 ft. on Delaney and 125 ft. on Cortland Ave. with house and garage for the sum of Three Thousand ($3,000) Dollars . McNamara Following a lengthy discussion on the condition of the ings and the possibilities of the property, it was on motion by Councilman Mandeville, seconded by Councilman Brewer, upon roll RESOLVED, that the Town Board of the Town of Mamaroneck does hereby consent to the sale of the following described property by the Village of Mamaroneck to Frank J. McNamara, providing that the transaction is in accordance with the bid of the purchaser dated February 2, 1942 Sec. 9, Blk. 47, Plot 125 ft. on Delaney and 125 ft, on Cortland Ave. with house and garage. The vote on the foregoing resolution was as follows: AYES: Councilmen Brewer, Griffin, Mandeville Supervisor McCulloch NOES: Councilman Bates build- call, A letter dated February 11, 1942, was received from Vim. H. Johnson, Village Manager of the Village of Mamaroneck in which he advised that the following described property was being advertised for bids by the Village of Mamaroneck: Block 928, Parcel 348, also known as 1127 West Boston Post Road. He asked that the Town Board give its opinion as to the sales value. The Town Clerk was requested to send to Mr. Johnson a copy of the letter mailed to Mr. Sansone, Village Attorney, following the last meeting of the Town Board. The letter provided for the procedure in such transactions. The Town Attorney stated that he recommended the settlement of the certiorari proceedings instituted by Larpeg Realty Corporation in the years 1939, 1940 and 1941, to review the assessments upon a parcel of property in the Town of Mamaroneck, known as Section 4, Block 49 (news number Block 417, Parcel 1) , on the basis of a reduction in the assessments for the respective years from $92,500 to $82,400. Councilman Bates introduced the following resolution which was seconded by Councilman Griffin: WHEREAS, heretofore and on or about the 29th day of September, 1939, a writ of certiorari was ob- tained by Larpeg Realty Corporation, owner of Sec- tion 4, Block 49 (new number Block 417, Parcel 1) in the Town of Mamaroneck, to review the assessment for the year 1939 (tax of 1940) ; a similar writ was obtained on the 26th day of September, 1940 to review the assessment for the year 1940 (tax of 1941) ; and another writ was obtained on the 14th day of October, 1941 to review the assessment for the year 1941, (tax of 1942) ; and WHEREAS, a return to the 1939 writ was duly filed by the assessor and Board of Review on or about the 15th of November, 1939, and no further proceedings have been taken; and a return to the 1940 ,^rrit was duly filed by the Assessor and Board of Review on or about the 15th day of November, 1940, and no further proceedings have been taken; and a return to the 1941 writ was duly filed by the Assessor and Board of Review on or about the 17th day of November, 1941, and no further proceedings have been taken; and WHEREAS, the Town Attorney and Assessor recommend to this Board that the proceedings be settled and discontinued upon the reduction of the assessment from $92,500 to $82,400 for the years 1939, 1940 and 1941 (taxes of 19401 1941 and 1942 respectively) NOW, THEREFORE, BE IT RESOLVED that the assessment for the years 1939, 1940 and 1941 (taxes of 19402 1941 and 1942 re- spectively) upon property known as Section 4, Block 49 (new.number Block 417, Parcel 1) assessed for $92, 500 be reduced to $82,400, provided the certiorari proceedings now pending in the name of Larpeg Realty Corporation, be discontinued without costs to the Town of Mamaroneck. FURTHER RESOLVED that the Town Attorney is hereby authorized and directed to sign the necessary stipulations to obtain orders of the Supreme Court providing for such reductions and the refund of any excess taxes paid. The foregoing resolution was adopted by the following vote: AYES: Supervisor McCulloch Councilmen Bates, Brewer and Griffin NOES: None NOT VOTING: Councilman Mandeville Councilman Bates stated that there was nothing to report for his departments. Councilman Mandeville stated that he did not have anything to report. Councilman Griffin reported that at a meeting of the Board of Park Commissioners held February 10, 19422 the problem of getting and retaining qualified tree men in the Park Department was discussed. He said that due to the lack of men Mr. Aitchison and Mr. Johnson have been working over-time steadily and that the Park Department believed that their salaries should be increased accordingly. He said that if it could be done, he would recommend it. A question was raised as to whether or not the law would permit anything to be added to their salaries, as the items were fixed items in the budget. The matter was referred to Attorney Delius to see if the law provided for payment for over-time work. Councilman Griffin presented a petition dated February 13, 1942, received from the Assessor for the correction of the assessment roil so as to permit the apportionment of taxes. On motion by Councilman Griffin, seconded by Councilman Mandeville, the following resolution was unanimously adopted: WHEREAS, the Assessor has presented a petition dated February 13, 1942, for the correction of the assess- ment roll for certain years, pursuant to the provisions of Section 33 of Chapter 105 of the Laws of 1916, as amended, known as the Westchester County Tax Act; and WHEREAS,- after due consideration this Board finds it desirable to grant said petitions for the correction of said assessment roll; -- NOW, THEREFORE, BE IT RESOLVED, that the assessment roll for the year 1940, taxes of 196.1, which shoves property now appearing on the roll as follows: Section Block Lot 9 16 5A,6A (902-1) Owner Lillie T. Chayer 31750 35750 (902-1) Councilman Griffin reported that Public Wlefare Officer DeVinne had returned from his trip. Councilman Brewer reported that he had attended the meeting of the Town Defense Council and that Mr. Mendes, Chairman, was to appear at this meeting of the Town Board. He said that there were some questions to clear up and that he thought that Mr. Mendes would be present. Mr. Brewer went over the items with the members of the Board and it was decided that Supervisor McCulloch, Councilman Brewer and Attorney Delius study the problems and report back to the Board. Councilman Brewer presented the following letter: February 14, 1942 Town Board Town of Mamaroneck, 158 West Boston Post Road, Mamaroneck, New York. Gentlemen: Because of the present emergency the Fire Department of the Town of Mamaroneck wishes to ask the Town Board for permission to install a siren at the corner of Crest Road and Holly Place . This alarm to be sounded when the fire whistle blows. The reason for this being that under certain weather conditions the fire whistle cannot be heard in this area. Since there are several active members of the Fire Department living in this locality the Fire Council feels that this siren is absolutely necessary. Respectfully yours, (signed) William C. Lindale GM/WL Chief He said that there was some talk at the Fire Council meeting about giving the exact location of the proposed siren but that it was rot mentioned in the letter. He recommended that the siren be installed and it was on motion by Councilman Brewer, seconded by Councilman Mandeville, on roll call, unanimously RESOLVED, that the Fire Department of the Town of Mamaroneck be and it hereby is authorized to install an auxiliary fire alarm siren near the corner of Crest Road and Holly Place, Town; FURTHER RESOLVED, that the exact location shall be determined by the Fire Council and the Town Attorney; - also that all costs in connection with this extension of the alarm system shall be a charge against the budget of the Fire Department; FURTHER RESOLVED, that the Town Board hereby retains the right to cancel the location and/or use of the auxiliary fire alarm siren upon sixty days' notice to all interested parties. am A letter dated February 13, 1942, was received from Miss Alice E. 'Wheelock, Secretary of the Police Pension Fund, in which . she advised that Mr. Rufus K. Allerton was re-appointed Treasurer of the Pension Fund. The Town Clerk presented Mr. Ailerton' s public official bond. On motion by Councilman Mandeville, seconded by Councilman Bates, on roll call, it was unanimously _ RESOLVED, that Globe Indemnity Company Bond No. A-315436, naming Rufus K. Allerton, Treasurer of the Police Pension Fund of the Town of Mamaroneck, as principal, in the penal sum of $2, 500, be and it hereby is approved, for the period ending December 31, 1942. A letter received by Town Engineer Foote from Mrs. Robert MacCallum requesting permission to use a vacant lot owned by the Town near the corner of Lafayette Road and Madison Avenue for a vegetable garden was read. On motion duly made and seconded the request was granted and the Town Attorney was directed to draw up an agreement which would protect the Town against liability. It was said that because of war conditions there would be other requests for the use of vacant land and that the same type of agreement could be used for all applicants . A letter dated February 13, 1942, was received from Mr. Louis Bleiweis, in which he made application to the Board for appointment to the office of Town Constable. He offered two letters of recommen- dation. During the discussion which followed it was pointed out that the law provided for two constables and only one had been appointed at the first of the year. It was on motion by Councilman Bates, seconded by Councilman Mandeville, upon roll call, unanimously RESOLVED, that Louis Bleiweis be and he hereby is appointed to the office of constable for the Town of Mamaroneck, New York, to serve without pay at the pleasure of the Town Board; FURTHER RESOLVED, that he qualify by filing a public official bond in the amount of $1,000 in a form satisfactory to the Town Attorney; also that he swear to and file the statutory oath of office in the Town Clerk' s office. The Supervisor presented the following financial statements which were ordered filed: (1) Analysis of Cash Receipts for January, 1942; (2) Analysis of Cash Disbursements for January, 1942; and (3) Highway Fund for January, 1942. The Supervisor reported that he had attended the meeting of town and village officials held February 11, 1942, to discuss with Mr. W. B. Folger, Personnel Officer of the County, the extension of civil service to the tovns and villages as provided for in the Fite Law. He said that they requested a copy of the complete payroll of the Town as of February 15, 1942; also that each employee complete a job description card and that one officer of the Town be designated to deliver to the employees, collect and return same to the Personnel Officer at White Plains. It was on motion by Councilman Brewer, seconded by Councilman Mandeville, upon roll call, unanimously RESOLVED, that the Town Clerk be and he hereby is designated to deliver, receive and return the job description cards in connection with civil service. Attorney Delius recommended and Councilman 'Mandeville intro- duced the following resolution: RESOLUTION AUTHORIZING THE ISSUANCE OF $7,804.12 CERTIFICATES OF INDEBTEDNESS OF THE TOWN OF MAMARONECK, IN THE COUNTY OF WESTCHESTER, NEW YORK, IN ANTICIPATION OF TAXES TO BE COLLECTED PURSUANT TO CIVIL SERVICE LAW SECTION 78. WHEREAS, the State Comptroller of the State of New York has heretofore certified under date of January 7, 1942, that the sum of $7,804.12 is payable by said Town to the said State Comptroller pursuant to Section 78 of - the Civil Service Law; and WHEREAS, when such amounts became due and payable, to wit, January 7, 1942, there were no funds available to make such payment: NOW, THEREFORE, be it RESOLVED by the Town Board of the Town of Mamaroneck, County of Westchester, as follows: Section 1. It is hereby determined that upon the certificate of the State Comptroller of the State of New York, dated January 7, 1942, there has become payable by the Town to the said State Comptroller the sum of $7,804.12, and that no funds are available to make payment thereof on the 7th day of January, 1942, and none are now available for such purpose. Section 2. Pursuant to the direction of said Section 78 of the said Civil Service Law the said Supervisor is hereby authorized to borrow said sum of $7,804.12 on the credit of the Town in anticipation of taxes to be levied and collected for the purpose of paying to the State Comp- troller the said sum of $7,804.12 certified by him to be payable pursuant to said Section 78 of the Civil Service Law. The Supervisor shall issue a certificate of indebted- ness in the name of the Town in the principal amount of such loan pursuant to Section 78 of the Civil Service Law. Section 3. Pursuant to said Section 78 of the Civil Service Laws there shall be included in the next annual bud- get of the Town of Mamaroneck an item in the sum of $7,804.12, the proceeds whereof shall be applied to the payment of the certificate of indebtedness hereinabove authorized. Section 4. The following matters in connection with said Certificates of Indebtedness are hereby determined: Date: March 2, 1942• Maturity: January 15, 1943. Denomination: $7,804.12 Interest rate: To be determined by the Supervisor, but not exceeding six percentum per annum. Numbers: To be determined by the Supervisor. Form: Substantially in accordance with resolution adopted January 43 1939. Said certificates of indebtedness shall be signed by the Supervisor, countersigned by the Town Clerk and shall have the Town seal affixed thereto. The Supervisor is hereby authorized and directed to determine all matters in connec- tion therewith not determined by this or subsequent resolu- tion, and to sell said Certificate of Indebtedness at private sale at not less than par, without advertisement or public bidding, and to deliver the same to the purchaser upon re- ceipt of the purchase price, plus accrued interest from the date of the Certificates of Indebtedness to the date of delivery. fim Section 5 . The faith and credit of the Town of Mamaroneck are hereby pledged for the punctual payment of the principal of and interest on said Certificates of Indebtedness, and, unless otherwise paid, or payment provided for, taxes shall be levied on all the taxable property in said Town in an amount sufficient to pay said principal and interest. Section 6. Said sum of $7,804.12 is hereby appro- priated out of the proceeds of said certificates for the purpose of paying to the State Comptroller the said amount certified by him and the Supervisor is directed to make such payment. On motion of Mr. Mandeville, seconded by Mr. Bates, the foregoing resolution was adopted by the following vote: AYES: Supervisor McCulloch Councilmen Bates, Brewer, Griffin, Mandeville NOES: None The following resolution was on motion by Councilman Brewer, seconded by Councilman Mandeville, upon roil call, unanimously adopted: WHEREAS, it is considered desirable to obtain an act of the Legislature amending Chapter 821 of the Laws of 1936, which is an act establishing the Fire Department in the Town of Mamaroneck, so as to make certain corrections and clarifications in said act and particularly to provide that the act shall super- sede any and all provisions of any general or special law; and WHEREAS, in order to make such amendments, the Town Attorney has drafted and presented to the Fire Council, a bill which has been approved by the Fire Council at its meeting held February 6th, 19/42, and such bill as - approved by the Fire Council, has been also presented to this Board; and WHEREAS, a bill has been introduced in the Legislature by Assemblyman Theodore Hill and Senator Pliny Williamson, which incorporates these amendments, NOW, THEREFORE, BE IT RESOLVED, that this Board hereby does approve the following bill so presented and in the form drafted by the Town Attorney and respectfully requests the Legis- lature of the State of New York to enact the same and respectfully requests the Governor of the State of New York to approve the same when so enacted; and be it FURTHER RESOLVED, that this Board consents to amendments being made by the Legislature of the State of iuew York, provided the same do not substantially or materially alter the provisions thereof. AN ACT to amend chapter eight hundred twenty-one of the laws of nineteen hundred thirty-six entitled, "AN ACT in relation to the creation, establishment and maintenance of a fire department in the town. of Mamaroneck outside incorporated villages in said town and validating the fire department of the town of Mamaroneck established under section three hundred eighteen-b of the former tovan law" . Section 1. Section one of chapter eight hundred twenty-one of the laws of nineteen hundred thirty-six entitled, "AN ACT in relation to the creation, establishment and maintenance dyfi of a fire department in the town of Mamaroneck outside in- corporated villages in said town and validating the fire department of the town of Mamaroneck established under section three hundred eighteen-b of the former town law" is hereby amended to read as follows: Sec. 1. The town board of the town of Mamaroneck may establish a fire department. The town board of the town of Mamaroneck in the county of Westchester may create, establish and maintain a fire department in a fire district (heretofore) established in that part of the town as is outside the limits of any incorporated city or village, for the extinguishment of fire in said town. Sec. 2. Section three of such chapter is hereby amended to read as follows: Sec. 3 . Election of company officers and delegates . At the annual meeting of the several companies whose members constitute the fire department of the town of Mamaroneck on the third Monday in January in each year, the members of each company shall elect by ballot from their own number, a captain, a first and second lieutenant, and one warden who must be approved by the town board and two delegates to the general convention of the fire department. The terms of office of delegates shall be one year, and any vacancies occurring shall be filled by election in like manner. Sec. 3 . Section ten of such chapter is hereby amended to read as follows: Sec . 10. The town board may appoint the members of a patrol company or patrol companies to regulate traffic, establish and maintain fire lines at the time of fire, and on other occasions when called upon for fire duty or other emergency, (and) as may be specified by the town board. Such members shall have the (same) rights and powers (as constables) of peace officers as provided (in the town) by law, except that they may be known as special fire police to distinguish them from constables and members of the town police department, and shall serve without pay. Sec. Mr. Section eleven of such chapter is hereby amended to read as follows; Sec . 11. This (section) act shall supersede any and all provisions of any general or special law, and shall be con- strued to extend the powers of the town board of the Town of Mamaroneck and not to limit them. Sec. 5. This act shall take effect immediately. Councilman Mandeville introduced the following resolution: RESOLUTION APPROPRIATING THE SUM OF '$5,000.TO PAY A PORTION OF THE COST OF PUBLIC ILIPROVEMENT WORK RELIEF PROJECTS IN THE TOWN, AND AUTHORIZING THE ISSUANCE OF $5,000. BONDS OF THE TOWN FOR SAID PURPOSE. RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMARONECK, IN THE COUNTY OF WESTCHESTER, NEW YORK, as follows : Section 1. The sum of $5,000. is hereby appropriated to pay the portion to be borne by the Town of public improve- ment work relief projects in the Town undertaken through or by the authority of the work Projects Administration of the federal government, or other work relief authority of the federal government, including the cost of furnishing labor, materials, supplies and equipment for such projects and incidental expenses in connection therewith, the said public improvement work relief projects to include only projects ME having a period of probable usefulness of at least ten (10) years, computed from February 13, 1942, the date of adoption of this resolution, It is hereby determined that no indebted- ness, whether temporary or permanent, has been incurred prior to said date to finance any portion of the cost thereof. To meet said appropriation, bonds of the Town in an aggregate principal amount not exceeding $" 5,000. shall be issued. Section 2. Said bonds shall be dated March 2, 1942, shall mature in the principal amount of $1,000. on March 1, in each of the years 1944 to 1947, both inclusive shall bear interest at a rate not exceeding six percentum (6% per annum, payable semi-annually on the first days of March and September in each year, shall be numbered, shall be in such form and of such denomination, shall be payable at such place or places, in such specie or other currency, and shall be sold at public sale in such manner and on such terms, but for not less than their par value, as shall hereafter be determined by subsequent resolution or resolutions of this Board. Section 3. On motion of Councilman Mandeville, seconded by Councilman Bates, the foregoing resolution was adopted by the following votes: AYES: Supervisor McCulloch Councilmen Bates, Brewer, Griffin, Mandeville NOES: None Councilman Mandeville introduced the following preamble and resolution: WHEREAS., a resolution entitled: "Resolution appropriating the sum of $5,000. to pay a portion of the cost of public improvement work relief projects in the Town, and authori- zing the issuance of $5,000. bonds of the Town for said purpose", adopted February 13, 1942, has become effective . Nov*, therefore, be it RESOLVED BY THE TOV4,N BOARD OF THE 'TOVV I OF LUMARONECK, IN THE COUNTY OF WESTCHESTER, NEW YORK, as follows: Section 1. For the purpose of temporarily financing the cost of permanent improvements provided for in said resolution, in anticipation of the issuance of bonds, the Supervisor is hereby authorized to issue a Certificate, or Certificates, of Indebtedness of the Toy^m of Mamaroneck in an aggregate principal amount not exceeding 45,000. Said Certificates shall each be designated "Work Projects Certificate of Indebtedness" . Section 2. The following matters in connection with said Certificates are hereby determined: Date: March 2, 1942• Maturity: March„3, 1943 . Denominations : 05,000.00 Numbers: W. P. A. #23 Form: Substantially in accordance with resolution adopted October 4, 1939 . Place of Payment: To be determined by the Supervisor. The Supervisor is hereby authorized to determine all matters in connection with said Certificates of Indebted- ness, the determination of which is not provided for bur this or subsequent resolutions, and his signature upon said Certi- ficates shall be conclusive as to such determinations . Said Certificates shall be signed by the Supervisor, shall have the corporate seal of the Town affixed thereto and attested by the Town Clerk. The Supervisor is hereby authorized to sell said Certificates at public sale or private sale at not less than par and to fix the interest rate thereof at not exceeding six per centum (6%) per annum, and to deliver same to the purchaser upon receipt of the purchase price, plus accrued interest from the date of the Certificates to the date of delivery. Section 3 . Any instrument issued pursuant to this resolution shall be a general obligation of the Torn of Mamaroneck, and the faith and credit of the Town are hereby pledged for the punctual payment of the principal of and interest on said obligations, and unless otherwise paid or payment provided for, a tax sufficient to provide for the payment thereof shall be levied and collected. Section 4. This resolution shall take effect immediately.
