TOWN OF MA,MARONECK, NEW YORK
HELD DECEMBER 30, 1941
At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y.
The meeting was called to order by Supervisor McCulloch
at 3 P. M.
Present: Supervisor McCulloch
Councilmen Bates, Griffin, Mandeville and Meginniss
Absent: None
The presence was also noted of Town Clerk Payne, Town Attorney
Delius, Comptroller Luceno, and Superintendent of Highways and Town
Engineer Foote.
The Supervisor presented his annual report of highway monies
for the year 1941.
On motion by Councilman Mandeville, seconded by Councilman
Griffin, upon roll call, it was unanimously
RESOLVED, that the Supervisor' s annual report of
highways monies for the year 1941 be and it hereby
is approved.
Councilman Mandeville, as chairman of highway matters, presented
the inventory of town machinery employed by the Highway Department as
of December 26, 1941, as signed by the Town Highway Superintendent,
A. J . Foote. The inventory was unanimously approved.
Councilman Mandeville presented the Town Highway Superin-
tendent ' s Estimate for Highway Purposes for the Year 1942 showing
the following amounts:

On motion by Councilman Mandeville, seconded by Councilman
Griffin, it was unanimously
RESOLVED, that the foregoing Town Highway Superin-
tendent' s Estimate for highway purposes for the year
1942 be and it hereby is approved; and be it
FURTHER RESOLVED, that the amount set opposite each
item under the column described as "Amount Approved
By Town Board" is the arnovnt which shall be raised
by tax for the specific purpose mentioned.
On motion by Councilman Mandeville, seconded by Councilman
Griffin, it was unanimously
RESOLVED, that the following bond is hereby
required pursuant to the Highway Law and approved
—.- as follows:
Bond, Bert C. McCulloch, as Supervisor of the
Town of Mamaroneck, conditioned for the faithful
disbursement and safe keeping and accounting of
highway funds received by him as such Supervisor
during the year beginning January lst, 1942, pur-
suant to Section 283 of the Highwav Law, upon which
the Globe Indemnity Company is surety, in the penal
sum of '$34,000 .
The Supervisor asked if there were any other matters in
connection with the Highway Department to be placed before the Board.
There being none, he suggested that the meeting proceed
with other business .
The minutes of the public hearing held December 10, 1941,
and. the Town Board meeting held December 12, 1941, were approved
as presented.
on motion by Councilman Griffin, seconded by Councilman
Meginniss, it was unanimously
RESOLVED, that the following bonds for elected
officials are hereby required pursuant to the
Town Law and approved as follows:
Bond, Bert C. McCulloch, as Supervisor of the Town
o.f Mamaroneck, conditioned for the faithful performance
of his duties including the payment of all school
moneys, pursuant to Section 25 of the Town Law, upon
which the Globe Indemnity Company is surety in the
penal sum of $25,000;
Bond, Henry R. Dillon, as Receiver of Taxes and
Assessments, conditioned for the faithful performance
of his duties including the collection of to-um and
school moneys, pursuant to the Town Law, upon which
the Globe Indemnity Company is surety in the penal
sum of $20,000;
Bond, Robert D. Payne, as Clerk of the Town of
Mamaroneck, conditioned for the faithful performance
of his duties including the depositing of all funds
- or moneys of the Town, received by him, pursuant to
Section 25 of the Town Law, upon which the National
Surety Corporation is surety in the penal sum of
$1,000;
Bond, Wesley M. Messersmith, Justice of the Peace
of the Town of Mamaroneck, conditioned for the
faithful performance of his duties including the
depositing of all funds or moneys of the Town,
received by him, pursuant to Section 25 of the Town
Law, upon which the Globe Indemnity Company is surety
at an annual penalty of $1,000.
On motion by Councilman ivlandeville, seconded by Councilman
Griffin, it was unanimously
RESOLVED, that the Receiver of Tares and Assessments
be and he hereby is authorized, empowered and directed
to accept payment of the following taxes on the
following described property, the liens for which are
held by the Town, at the face amount of the liens,
provided payment is made within thirty days:

On motion by Councilman Mandeville, seconded by Councilman
Griffin, it was unanimously
RESOLVED, that the Receiver of Taxes and Assessments
_ be and he hereby is authorized, empowered and directed
to accent payment of taxes for the following years
on Section 8, Block 94, Lots 12, 13, 30 and 31, the
- liens for which are held by the Tovm, at the face
amount of the liens plus interest computed at 6 per
cent per annum, provided payment is made within
thirty days :

A letter dated December 17, 1941 was received from the
Commission of Correction of the State of New York to the effect that
the Town lock-up was inspected and approved by the Commission. A
copy of the report was enclosed. The report was ordered received
and filed.
The following resolution was offered by Councilman Mandeville
and seconded by Councilman Griffin, and upon roll call was unanimously
adopted:
RESOLVED, that pursuant to the following provision:
"The Town Board may reject any or all bids or estimates
if it is deemed for the interest of the Town to do so",
which provision is part of the public notice and speci-
fications for estimates for the contract for the removal
and disposition of swill, garbage and ashes from build-
ings in Garbage District No. 1 of the Town of Mamaroneck,
all bids received for this purpose be rejected and that
the Town Clerk be authorized to return the bid checks to
the bidders .
The Supervisor stated that if there was no other business
to come before the meeting, he wished to say a few words to
Councilman IvIeginniss upon his retirement from the Town Board. He
started by saying, "I know the great sorrow that is in your heart
following the loss of your dear wife Mrrs . Meginniss, and it is hard
for me to wish you a happy New Year, nevertheless 1 do hope that in
some way it will be happy and bright." He went on to say that it had
been a pleasure to serve with Mr. Meginniss for the eight years that
they had been on the Board together and that he hoped that Mr. Meginniss
had enjoyed being with the members of the Board.
Councilmen, Bates, Griffin and Mandeville joined in to express
the same sentiments as the Supervisor and wished Mr. Meginniss the
best of health and happiness during his retirement.
Councilman Meginniss said that he was very much pleased to be
of service to the community and it was a pleasure to do the work;
also that he did enjoy working with all of the members of the Board.
At 3:45 P. M. the Board resolved to adjourn.
