TOWN OF MAMARONECK, NEW YORK
HELD DECEMBER 3, 1941
At the Town Offices, 158 Vilest Boston Post Road, Mamarcneck, N. Y.
at 5 P. 26.
The meeting was called to order by Supervisor McCulloch
Present: Supervisor McCulloch
Councilmen Bates, Griffin, Mandeville, Meginniss
Absent: None
The presence was also noted of Town Clerk Payne, Town Attorney
Delius, Assessor Smith, Comptroller Luceno and Town Engineer Foote.
The Supervisor stated that in accordance with notice duly
given it would be in order for the Board to receive bids for the
collection of garbage, swill, et cetera, from Garbage District No. 1
of the Torun of Mamaroneck.
The Torun Clerk presented the affidavit of publication of the
notice which was ordered filed.
The Supervisor asked if there were any persons who desired
to submit bids who had not already done so . There being none, he opened
the bids which showed as follows:

Following some discussion the Board decided to defer action
until the members had had an opportunity to compare the equipment
listed in the bid proposals.
The Supervisor suggested that the meeting proceed with the
regular order of business .
The minutes of the meetings of November 5, November 11,
November 13 and November 19, 1941, were approved as presented.
The Supervisor presented a post card with the following
message from the Association of Towns of the State of New York:
"On October 15th, our Association notified the supervisor
of each town of the proposed litigation to recover the
full amount of state aid for highways payable under the
Highway Law, and recommended, that former Senator Fearon
be employed to prepare, file, and prosecute the claims.
"Approximately 550 towns have heretofore employed Dir. Fearon
for such purpose ."
Following some discussion Councilman Mandeville offered
the following resolution and moved its adoption:-
RESOLVED, that George R. Fearon, of the law firm of
Costello, Cooney & Fearon, of Syracuse,Nevv York, be
and he hereby is employed for professional services
in preparing, filing, and prosecuting the claim of
this Town against the State of New York, for the

difference between the full amount of state aid
payable to this Town for the current fiscal year
pursuant to Section 279 of the Highway Law and the
amount actually received by this Town heretofore, and
FURTHER RESOLVED, that the Supervisor of this Town be
and he hereby is authorized and directed to pay to
Mr. Fearon immediately the sum of Ten Dollars ($10.00)
which shall be full compensation for all services
rendered or to be rendered and full payment of all
expenses incurred or to be incurred in the preparation,
filing, and prosecution of such claim, if such claim
is not upheld, and
FURTHER RESOLVED, that this Town will pay to Mr. Fearon
five per cent (5%) of the amount recovered by this Town
in the event that such claim is upheld either as a result
of the preparation, filing, and prosecution of such claim
or of a similar claim of the County or some other town
or county, and
FURTHER RESOLVED, that the Supervisor of this Town shall
forward to Mr. Fearon immediately, at 930 University
Building, Syracuse, New York, a certified copy of this
resolution, the sum of Ten Dollars ($10.00) hereinbefore
referred to, and such information as shall be required
for the preparation, filing, and prosecution of the
claim of this Town, and
FURTHER RESOLVED, that the Supervisor be and hereby is
authorized and directed to execute, on behalf of this
Town, the claim and such other papers, instruments, and
proceedings as may be necessary for the preparation,
filing, and prosecution of the claim.

The Supervisor asked the members of the Board if it would
be convenient for them to hold the meeting of December 12, 1941,
at 5 P. M. instead of 8 P. M. It was agreed and the Town Clerk
was requested to send out notices..
Councilman Bates reported that the estimate for the con-
struction of a sewer line for house connections in Garfield Street
was $500 . He recommended that the money be provided for the depart-
ment to start work immediately.
Upon motion by Councilman Bates, seconded by Councilman
Griffin, it was upon roll call unanimously
RESOLVED, that the Comptroller be and he hereby
is authorized to transfer from surplus funds
the amount of $500.00 to the Sewer Department
budget for the purpose of constructing a sewer
line for house connections in Garfield Street.
Councilman Bates also reported that the work on the Ferndale
Street drain was getting along quite well.
Councilman Mandeville stated that there was nothing to report
for the Highway Department. He commented on the bid proposals for the
collection of garbage by saying that they made the figures for costs
in the Garbage Department look very good.
Councilman Griffin presented and read the report of the
Welfare Department for the month of November, 1941, which showed as
follows :

Councilman Griffin presented two petitions dated December 3,
1941, received from the Assessor for the correction of the assessment
roll so as to permit the apportionment of taxes .
On motion by Councilman Griffin, seconded by Councilman
Bates, the following resolution was unanimously adopted:
WHEREAS, the Assessor has presented petitions
dated December 3, 1941, for the correction of the
assessment roll for certain years, pursuant to the
provisions of Section 33 of Chapter 105 of the Laws
of 1916, as amended, known as the Westchester County
Tax Act; and
WHEREAS, after due consideration this Board finds it
desirable to grant said petitions for the correction
of said assessment roll;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll for the years 1940
and 1941, taxes of 1941 and 1942, which shows property
now appearing on the roll as follows:

Councilman Meginniss presented the following financial
reports for the period from January 1 to October 31, 1941, which
were ordered filed: (1) Summary of Receipts and Disbursements;
(2) Analysis of Estimated Revenues and (3) Statement of Budget Ap-
propriations and Expenditures .
A letter dated November 22, 1941, received from Frank D.
Gironda of Cabot Road, Town, urging the Board to consider as Federal
Work projects the construction of two bridges near the Larchmont
Station, was received and filed.
A letter dated November 20, 1941, was received from John C.
Forrar asking the Board to consider his application for the position
of dog enumerator for the unincorporated area of the Town of Mamaro-
neck for the year 1942 .
The Supervisor asked if there were any other applications
for the position. There being none, he asked the members of the
Board what their pleasure was in the matter.
On motion by Councilman Bates, seconded by Councilman Griffin
it was upon roll call unanimously
RESOLVED, that pursuant to Section 108 of the
Agriculture and Markets Law of the State of
New York, John C. Forrar be and he hereby is
appointed enumerator of dogs for the unincor-
porated section of the Town of Mamaroneck for
the year 1942.
The Town Clerk informed the Board that he had received a
telephone call from Mr. George Mills requesting the Rotary Club of
Larchmont and Anthony Pelliccie, electrical contractor, be given
permission to erect Christmas decorations on North Chatsworth Avenue
between the railroad bridge and Myrtle Boulevard in the Town.
Upon motion duly made and seconded permission was granted
subject to the Town Attorney' s approval of the contractor' s insurance
coverage .
The following letter dated November 26, 1941, was read by
Town Clerk Payne:

BULLETIN
IMPORTANT DEFENSE MEETING
Mayor F. H. LaGuardia, United States Director of Civilian
Defense, has requested me to arrange a joint meeting of the
Defense Councils of the Counties of Orange, Dutchess, Rockland,
Putnam and Westchester.
I have conferred with the chairmen of the four other counties
and we have agreed to hold a meeting on Tuesday. December 9, at
three p. m. in the auditorium of the White Plains High School.
Mayor LaGuardia, who has been holding similar meetings
throughout the country, will attend this meeting and make the
principal speech.
We are anxious to have all county, city, town and village
officials, school officials, members of defense councils, police
officials, fire officials, and members of the Civilian Defense
Organization (auxiliary police and firemen, wardens, etc . ) as
well as representatives of patriotic societies, Red Cross, Boy
Scouts, Girl Scouts, American Legion, Veterans of Foreign Wars,
and citizens interested in defense, attend this meeting, and if
equipped with uniform, wear them.
The chairman of each local defense council is requested to
assume the responsibility of inviting all interested persons to
this meeting. Admission to the meeting will be by ticket and a
liberal supply of tickets will be furnished upon request. Ap-
plications for the tickets should be made as promptly as possible.
It is planned to have a massing of the colors during the
meeting and each local chairman is requested to arrange to get
as many colors as possible from the local organizations including
the Legion, D. A. R., Police and Fire Departments, Boy and Girl
Scouts . The color bearers should report at the White Plains High
School at 2:30 P. T1. on Tuesday, the 9th, so that they may
receive instruction. We should be advised of the number of colors
available not later than Friday, December 5th.
This meeting is one of the most important ones we will hold
and will help greatly to arouse interest in the Civilian Defense
Program. It is, therefore, urged that every effort be made to
insure a large attendance of interested persons .

The Supervisor directed the Town Clerk to have copies made
for all departments of the Town.
The following reports were received and filed: (1) Report
of the Receiver of Taxes for the Month of November; (2) Report of
the Building Inspector for the idonth of November; (3) Report of the
Plumbing Inspector for the Month of November; (4) Report of the County
of Westchester Department of Health for the Month of October.
At 5:¢0 P. M- the Board unanimously resolved to adjourn.
