TOWN OF MAMARONECK, NEW YORK
HELD OCTOBER 1, 1941
At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y.
at 8 P. M.
The meeting was called to order by Supervisor McCulloch
Present: Supervisor McCulloch
Councilmen Bates, Griffin, Mandeville, Meginniss
Absent: None
The presence was also noted of Town Clerk Payne, Town
Attorney Delius, Assessor Smith and Town Engineer Foote.
The Supervisor suggested that the meeting proceed with
the reports of committees.
Councilman Griffin, presented and read the report for the
Department of Public Welfare for the month of September, 1941, which
showed as follows:
Councilman Griffin presented three petitions dated October 1,
1941, received from the Assessor for the correction of the assessment
roll so as to permit the apportionment of taxes .
On motion by Councilman Mandeville, seconded by Councilman
Meginniss, the following resolution was unanimously adopted:
WHEREAS, the Assessor has presented petitions dated
October 1, 1941, for the correction of the assessment
roll for certain years, pursuant to the provisions
of Section 33 of Chapter 105 of the Laws of 1916, as
amended, known as the Westchester County Tax Act; and
WHEREAS, after due consideration this Board finds it
desirable to grant said petitions for the correction
of said assessment roll;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll for the year 1941,
taxes of 1942, which shows property now appearing on
the roll as follows :

Councilman Griffin presented three petitions dated October 1,
1941, received from the Assessor for the correction of the assessment
roll so as to permit the apportionment of taxes .
On motion by Councilman Mandeville, seconded by Councilman
Meginniss, the following resolution was unanimously adopted:

Councilman Mandeville stated that there was nothing to
report for his department.
Councilman Bates reported that the W. P. A. workers were
getting along quite well with the work on the Bonnie Briar Lane Bridge .
He also reported that a number of W. P. A. workmen had been assigned
to the Ferndale Street drain project.
Councilman Meginniss stated that there was nothing to
report for his department.
Town Attorney Delius reported that the proposed amendments
to the Town ordinances were ready except for a question about parking
regulations in the privately owned driveways in the Larchmont Acres
development. He said that it had been pointed out that unlimited
parking of cars would hamper the police and firemen in giving proper
protection to the buildings. He informed the Board that the problem
was being studied and that he thought that the proposed amendments
would be ready for consideration at the next meeting.
Councilman Mandeville stated that he thought that the
Board would be interested in hearing something about the new garbage
incinerator.
Supervisor McCulloch informed the Board that the new
incineration plant had been in operation for more than a month
and that to date not a single complaint had been received. He said
that the stack was sending off a very light smoke without any
noticeable odor and that the men in charge were doing a very good
job.
Councilman Mandeville recommended that it it was not already
done, one man be given full responsibility for the operation of the
plant.
A letter dated September 10, 1941, was received from
Posner and Posner, attorneys, requesting the Town Board to consider
a compromise on certain tax arrears on the property known as Block 901,
Parcel 92 and assessed to Jessie Bernstein.
Following some discussion it was on motion by Councilman
Mandeville, seconded by Councilman Bates, upon roll call
RESOLVED, that the Receiver of Taxes and Assess-
ments be and he hereby is authorized, empowered
and directed to accept payment of taxes for the
following years on Block 901, Parcel 92, the
liens for which are held by the Town, at the face
amount of the liens, provided payment is made
within thirty days:

The Supervisor stated that he had been informed by the
members of the Zoning Board of Appeals that they had selected
Clarence de Plitt Rogers, Sr.to represent them as counsel in the
matter of Maria De Bartolo against A. Stirling Smith, C. delitt
Rogers, Jr. , Frederick G. Smith, Orson A. Raynor and Clifford Cross
and that the question as to the amount of fee was referred to the
Town Board.
Following a lengthy discussion it was on motion by
Councilman Mandeville, seconded by Councilman Bates, upon roll call,
RESOLVED that the action of the Zoning Board of
Appeals in selecting Clarence delitt Rogers, Sr.
to represent them as counsel in the matter of
Maria De Bartolo against A. Stirling Smith,
C. del-Vitt Rogers, Jr. , Frederick G. Smith, Orson
A. Raynor and Clifford Cross; be and it hereby is
confirmed; and be it
FURTHER RESOLVED, that the total fee shall not
exceed $350, the sum of $100 shall be paid as a
retainer and the full amount shall be paid when
and if the case is taken to trial.
The Town Clerk inquired if the Board in accordance with
the provisions of Section 75 of the Election Law desired to publish
notices of registration and- election as has been done in years past.
On motion by Councilman Mandeville, seconded by Councilman
Griffin, upon roll call, it was unanimously
RESOLVED, that in accordance with Section 75 of
the Election Lati^a a notice be published in 'The
Daily Times" on October 3 and October 16, 1941
and in "The Larchmont 'Times" on October 9 and
October 16, 1941, giving a list of the places of
registration within the Town of Ulamaroneck, a
statement of the days and hours of registration
and a brief description of the boundaries of each
election district in the Town; and be it
FURTI3ER RESOLVED, that in accordance with the
same section of the Election Law notices be pub-
lished in "The Daily Times" on October 30 and
November 3, 1941, and in "The Larchmont Times"
on October 30, 191+1, giving a list of the polling
places, the day and hours of the election and a
brier description of the boundaries of each
election district.
A report from the Plumbing Inspector for the month of
September, 1941, was ordered received and filed.
At 9 P. M. the Board unanimously resolved to adjourn.
Town
