REGULAR MEETING OF THE TOWN BOARD
TOWN OF MAMARONECK, NEW YORK
HELD SEPTEMBER 17, 1941
At the Town Offices, 158 tigest Boston Post Road, Mamaroneck, N. Y.
The meeting was called to order by Supervisor McCulloch
at 8:00 P. Pd.
Present: Supervisor McCulloch
Councilmen Bates, Mandeville, Meginniss
Absent: Councilman Griffin
The presence was also noted of Deputy Town Clerk Alice E.
Wheelock, Town Attorney Delius and Assessor Smith.
The minutes of the meeting of June 18, 1941, were approved
as corrected.
Councilman Bates presented a letter from Town Engineer
Foote in regard to a request lie had received from the owner of
Parcel 188, Block 210, on Valley Stream Road, to make a sewer avail-
able for a new house which he plans to build. Mr. Foote explained
in his letter that a sewer extension could be made from the existing
severer on Crescent Road 125 feet from the lot at a cost of $500 or a
house connection could be laid across the brook to connect with the
existing county trunk line on the opposite side of the brook at a
cost of $250.
Upon motion by Councilman Bates, seconded by Councilman
Mandeville, it was unanimously
RESOLVED, that the Town Engineer be and he hereby
is authorized to construct a house connection
across Sheldrake River in order to make a sewer
available to property described as Parcel 188,
Block 210, on Valley Stream Road, at a cost of
$250, if and when a house is erected on the property.
Councilman Bates reported that work on the Bonnie Briar
Lane bridge was progressing.
Councilman Mandeville reported that the Highway Department
had completed seal coating several streets and that after discussing
the matter with the Supervisor, a top dressing had been put on
Harrison Drive from Iselin Terrace to Harding Court.
He informed the Board that garbage collections had been
"going along for about six weeks without complaint" and reported
that the Highway Department had cleaned up several vacant lots
which have been in bad condition and about which there have been
complaints .
He presented three petitions dated September 17, 1941,
received from the Assessor for the correction of the assessment roll
so as to permit the apportionment of taxes.
On motion by Councilman Mandeville; seconded by Councilman
Meginniss, the following resolution was unanimously adopted:
WHEREAS, the Assessor has presented petitions dated
September 17, 1941, for the correction of the assess-
ment roll for certain years, pursuant to the provisions
of Section 33 of Chapter 105 of the Laws of 1916, as
amended, known as the Westchester County Tax Act; and
WHEREAS, after due consideration this Board finds it
desirable to grant said petitions for the correction
of said assessment roll;
NOW, THEREFORE, BE IT

Councilman Meginniss presented the following financial
reports for the months of July and August, 1941, which were ordered
filed: (1) Statement of Budget Appropriations and Expenditures
(2) Statement of Estimated Revenues and (3) Summary of Receipts and
Disbursements.
Town Attorney Delius recommended that the following
resolution be adopted:
WHEREAS, this Board on the 6th of August, 1941,
adopted resolutions for the conveyance of certain
property now owned by the Town to John V. Baum,
which property is more particularly described in
said resolution; and
WHEREAS, said resolution was adopted subject to a
permissive referendum, as provided in Section 64;
sub-section 2 of the Town Law, and the Town Clerk
was authorized to give notice of the adoption of
the resolution, as provided in Section 90 of the
Town Law; and
WHEREAS, such notice has been given by publication,
proof of which is on file with the Town Clerk;
NOW, THEREFORE, BE IT
RESOLVED, that the Supervisor be and he hereby is
authorized to execute and deliver to John V. Baum,
a deed to the property described in the resolution
of August 6th, 1941, upon receipt from said John V.
Baum, of the sum of $45. together with the costs
and expenses of publishing the resolution first
adopted.
Upon motion by Councilman Mandeville, seconded by Councilman
Keginniss, the foregoing resolution was unanimously adopted, the
Supervisor not voting.
Town Attorney Delius presented an application dated
September 17, 1941, from Meighan and Necarsulmer for an extension
of time in which to pay the tax liens which were compromised by
resolution of the Town Board on August 6, 1941, on Section 9,
Block 74, Lot 13 .
The Supervisor stated that he had already approved of
payment of these tax liens and asked the Board to ratify his action
in granting the extension of time .
On motion by Councilman Mandeville, seconded by Councilman
Meginniss, it was unanimously
RESOLVED, that the action of Supervisor McCulloch
in granting an extension of time in which to pay
the tax liens on Section 9, Block 74, Lot 13, be
and it hereby is approved and the Receiver of Taxes
and Assessments is hereby authorized to accept
payment of the following taxes on Lot 13, at the face
amount of the tax, the liens for which are held by
the Town, provided payment is made within thirty days:

Town Attorney Delius reported that he had prepared the pro-
posed amendments to the town ordinances, but wished to delay action
on them until Town Engineer Foote returned from his vacation.
Town Attorney Delius informed the Board that there has been
a committee of municipal attorneys who are trying to testout in rem
foreclosures by simply advertising them and filing a list in the
County Clerks Office. He explained that such a method would not
require the foreclosure of every piece of property but that almost
everybody has doubted the constitutionality of such a procedure and
no title company will insure the property. He asked the Board whether
or not they wished to enter into a test case of this method of fore-
closure .
Following discussion the members of the Board decided that
it would be unwise to enter into such a test case and authorized the
Town Attorney to inform the attorneys of the Boards decision.
A letter dated September 6, 1941, was received from
Mr. and Mrs . Fred Plowman of Senate Place, Larchmont, thanking the
Highway Department for their cooperation in remedying a drainage
situation in order that the water during heavy rainstorms might be
diverted from their driveway. The Board expressed their appreciation
for the letter and ordered it filed.
The Deputy Town Clerk read a letter from the Town Park
Commission requesting the Town Board to renew the lease with the
Westchester County Park Commission covering a portion of the Pelham-
Port Chester Parkway used by the Park Department of the Town of
Mamaroneck for a nursery, which lease expires on October 31, 1941.
On motion by Councilman Mandeville, seconded by Councilman
Bates, it was upon roll call, the Supervisor not voting, unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized to sign the renewal of the lease for
one year with the Westchester County Park Commission
covering premises known as Parcel 45 and a portion
of Parcel 1B, Sheet 9, Pelham Port Chester Parkway
which is used by the Park Department of the Town of
Mamaroneck for a nursery.
A letter dated September 11, 1941, was received from
Chas . H. Sells, Commissioner of Public Works of Westchester County,
concerning the matter of securing to the Town the benefit of a State
contribution in the amount of $50.00 per mile for the removal of snow
from State highways .
After discussion on motion by Councilman Mandeville,
seconded by Councilman Meginniss, it was unanimously .
RESOLVED, that the Town Superintendent of Highways
be and he hereby is authorized to enter into an
agreement with the County of Westchester for the
purpose of securing to the Town the benefit of the
State of New York contribution for the removal of
snow from State highways in the Town of Mamaroneck
including State highways inside the Villages of
Mamaroneck and Larchmont.
The following reports were received and filed: (1) Report
of the Town Clerk for the month of August; (2) Report of the Receiver
of Taxes for the month of August; and (3) Report of Mamaroneck Health
Center for the month of August.
Supervisor McCulloch informed the Board that the Adult
Activities and Recreation Council had requested a further sum of
$125 .00 in order to purchase materials to carry on the recreation
program.
On motion by Councilman Mandeville, seconded by Councilman
Bates, it was unanimously
RESOLVED, that the Comptroller be and he hereby
is authorized to transfer from surplus funds
the amount of $125 .00 to provide funds to continue
the Recreation Project of the Town of Mamaroneck.
At 8:45 P. M. the Board unanimously resolved to adjourn.
