REGULAR MEETING OF THE TOWN BOARD
TOWN OF MAMARONECK , NEW YORK
HELD AUGUST 6, 1941
At the Town Offices, 158 West Boston Post Road, Mamaroneck, N . Y.
at 8 P. M.
The meeting was called to order by Supervisor McCulloch
Present: Supervisor McCulloch
Councilmen Bates, Griffin and Mandeville
Absent: Councilman Megiinniss
The presence was also rioted of Town Clerk Payne, Town
Attorney Delius, Assessor Smith, Comptroller Luceno and Engineer
Foote .
The minutes of the meetings of June 18, June 28 and. July 2,
1911, were approved as presented.
The members of the Board inquired about Mr. Meginniss
wbo was home ill and they expressed their regret that he was not
present at the meeting .
Councilman Griffin presentednine petitions dated August 6,
1941 , received from the Assessor for the correction of the assess-
ment roll so as to permit the aplr)ortionment of taxes .
On motion by Councilman Griffin, seconded by Councilman
Bates, the follmriing resolution was unanimously adopted:
WHEREAS, the Assessor has presented petitions dated
-__ August 6, 1941, for the correction of the assessment
roll for certain years, pursuant to the provisions
of Section 33 of Chapter 105 of the Laws of 1916, as
—
amended, known as the tilestchester County Tax Act; and
WHEREAS, after due consideration this Board finds it
desirable to grant said petitions for the correction
of said assessment roil;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll for the year 1941,
taxes of 1942, which shows property now appearing on
the roll as follows :

Following a lengthy discussion, it was decided that there
was nothing in the 1941 budget that would permit the construction of
the Dronosed sidewalk. The Town Clerk was directed to advise the
petitioners by mail.
The Supervisor reported that pursuant to an earlier resolu-
tion authorizing him to settle tax arrears he had approved the payment
of certain taxes on Section 9, Block 105, Lots 7 and 8 and on Section 7,
Block 16C, Lots 18, 19 and 20 at a reduced amount.
The nle bens of tiie Board ratified the action of the Supervisor
with the following resolution, which was upon motion by Councilman
Mandeville, seconded by Councilman Griffin, upon roll call (the
Supervisor not voting unanimously adopted:
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, empowered and directed
to accept payment of the following taxes on Section 9,
Block 105, Lots 7 and 8, the liens for which are held
by the Town at the face amount of the liens, provided
payment is made within thirty days :

FURTHER RESOLVED, that the Receiver of 'Taxes and
Assessments be and he hereby is authorized, empowered
and directed to accept payment of the follovring taxes
on Section 7, Block 16C, Lots 18, 19 and 20, the liens
for which are held by the Town, at the face amount of

The Supervisor reported the following resolution which
was on motion by Councilman Bates, seconded by Councilman Mandeville,
unanimously adopted:
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, empowered and directed
- to accept payment of the follovring taxes on Section 9,
Block 7, Lot 8 13 ,14(Block 943, Parcel 184.) , the liens
for which are held by the 'Town, at the face amount of
the tax, provided payment is made within thirty, days :

The Tovm Attorney reported that he h-ad been able to induce
the Globe Indemnity Company, to accept $75 .00 in satisfaction of a
judgment obtained against Elizabeth R. Monahan as Administratrix of
Thomas F, Monahan. This judgment was the result of an action by her
against the Town for the wrongful death of her son Thomas F. Monahan
and after trial by jury resulted in a verdict for the Town and a judg-
ment for costs amounting in all to $12.70, to which amount the insurance
company is entitled by reason of their subrogation agreement as insurance
carrier for the 'Town. He presented a satisfaction of judgment prera.red
by the attorne;rs for the Globe Indemnity Company and upon notion duly
made and seconded, it was unanimously
RESOLVED, that the Supervisor be and he hereby
is authorized to sign and acknowledge the satis-
faction of judgment and deliver it to the insurance
company..
The 'Town Attorneys reported that at the meeting held June 18,
1941, he was directed to prepare an agreement by and between the 'Town
of and the City of New Rochelle granting permission to install
a sewer pipe line in the 'Town of Mamaroneck so as to provide house con-
nections for houses in New Rochelle on Beechtree Drive . He -presented
the agreement for the Supervisor' s signature, which was authorized in
a resolution at the above mentioned meeting .
The Town Attorney reported that at the meeting held June 18,
1941, he was requested to determine nether or not the Town could sell
a strip of property to the adjoining owner in the Larchmont Gardens
Section, He recommended that if the board was inclined to accept the
offer on file, the following resolution be adopted:
RESOLVED: That this board convey to John V. Baum
certain property now owned by the 'Town which is
bounded and described as follows: All that certain
parcel of land designated on the map of Larchmont
Gardens, ,filed in the office of the Register of
tidestchester County as Map No . 1949, as "reserve",
and shown on said map to be bounded as follows : on
the west by the easterly lines of lots 1 and 17 in
Block 424,; on the north by Edgewood Place; on the
east by the easterly line of the lands designated as
Larchmont Gardens on. said map; on the south by Little
Farms Road.
FURTHER RESOLVED: That this resolution is subject to
a permissive referendur:, as provided in Section 64,
subsection 2, of the Town Lava, and that the Town Clerk
is authorized and directed to give notice of the
adoption of this resolution as provided in section 90
of the 'Town Law.
FURTHER RESOLVED: That, subject to a permissive
referendum, such conveyance be made by quit claim
deed and that the Town Attorney be authorized to
prepare such a deed.
FURTHER RESOLVED: That the expense of giving
notice of the adoption of this resolution be paid
by the -purchaser, John V. Baum.
The foregoing resolution was on motion by Councilman
Mandeville, seconded by Councilman Griffin, upon roll call, unanimously
adoi,ted.
The Town Clerk vvas directed to have the public notice
published in "The Daily Times" , the official newspaper of the Town
of Mamaroneck in the issue of August 11, 1941.
The Town Attorney reported that he was prepared to submit
to several departments of the Town copies of the proposed amendments
to the Town ordinances , He said that he was trying to get some
reaction, so that all. recommendations could be considered at one time
by the Board.
Town Engineer Foote called to the attention of the Board the fact that Mr. Gerald Campbell
was completing on house and starting the construction of a second house fronting on the unnamed
street at the rear of the Larchmont Acres development. He said that at the meeting held June 4,1941
he was directed to submit estimates for the extension of the sewer main along the street so as to
provide service up to the property line of Ida O. Campbell. He reported that the approsimate cost would
be $1,200
Following some discussion it was on motion by Councilman Bates seconded by Councilman Griffin
unanimously
RESOLVED that the Town Engineer be and he hereby is authorized to extend the sewer main a distance
of approximately 210 feet along the unnamed street at the rear of the Larchmont Acres development said
street being that property which was deeded to the Town in two parcels one by Ida O. Campbell, Gerald J.
Campbell and C.B Campbell representing the Estate of Alexander C. Campbell the other by Morris Petigor
and Anne Petigr the cost of installation not to exceed $1200 and the charge to be made against the budget
of Sewer District No. 1 for the year 1941
The Supervisor announced that he had received a draft of a communication proposed by Chas. H. Sells
Commissioner of Public Works of Westchester County which might be sent to the Board of to the Town of
Mamaroneck. It suggested that a rental charge made by the county for the use of garbage space by the Town
in the amount of $1,866.67 be off set by a charge by the Town for pavement work along Palmer Avenue the
amount for which being $1970.38
Following some discussion the members of the Board on motion duly made and seconded instructed the
Supervisor to take the matter up with the Board of Supervisors of the County
The Town Clerk reported that as directed he had returned two of the three voting machines
rented from the Automatic Voting Machine Company for the last general election. He called to the
attention of the Board that action was deferred on the third machine in order to determine whether
or not it would be necessary to rent same for the 1941 elections
