TOWN OF MAMARONECK, NEW YORK
HELD MAY 21, 1941
At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y.
The meeting was called to order by Supervisor McCulloch
at 7:30 P. Dui.
Present: Supervisor McCulloch
Councilmen Bates, Griffin, Mandeville, Meginniss
Absent: None
The presence was also noted of Town Clerk Payne, Town Attorney
Delius, Assessor Smith, Comptroller Luceno and Town Engineer Foote .
The Supervisor suggested that the meeting proceed with reports
of the committees .
Councilman Griffin presented and read two petitions received
from the assessor and upon motion by Councilman Griffin, seconded by
Councilman Bates, the following resolution was upon roll call unani-
mously adopted:
WHEREAS, the Assessor has presented petitions for
the correction of the assessment rolls for the years
1939, 1940 and 1941, taxes of 1940, 1941 and 1942,
pursuant to the provisions of Section 33 of Chapter
105 of the Laws of 1916, as amended, known as the
Westchester County Tax Act; and
WHEREAS, after due consideration this Board finds it
desirable to grant said petitions for the correction
of said assessment rolls;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment rolls for the years 1939,
and 1940, taxes of 1940 and 1941, which shows property
not appearing on the roll as follows:

This affects property known as Section 9, Block 67, Lot 54
also known as Block 923, Parcel 31. For the tax .years
o ' 1937, 1935 and 1939 this property was assessed against
the H. M. Williams Corporation instead of to me, Elizabeth
H. Bohan. Therefore, I did not pay the taxes due.
In view of the fact that there was an error on the assess-
ment roll, I would like to pay the face amount of the
taxes .

Councilman Griffin also read a petition from the assessor
requesting the correction of the assessment roll in accordance with
the above letter .
On motion by Councilman Griffin, seconded by Councilman
Bates, the following resolution was unanimously adopted.:
WHEREAS, the Assessor has presented a petition for
the correction of the assessment roll for the year
1940, taxes of 1941, pursuant to the provisions of
Section 33 of Chapter 105 of the Laws of 1916, as
amended, known as the Westchester County Tax Act;
and
WHEREAS, after due consideration this Board finds it
desirable to grant said petition for the correction
of said assessment roll;
NOW, THEREFORE, BE IT

Gentlemen:
A
On the tax arrears books under Section 1, Block 62,
Lot 11 (old lot number 102 and new numbers Block 126,
Parcel 414 there appears a lien for the tax of 1883,
sale of 1884, amounting to $4.82, sold to Burdick.
Also under Section 1, Block 62, Lot 12 (old lot number
103 and new, numbers Block 126, Parcel 419) there appears
a lien for the tax of 1883, sale of 1884., amounting to
$9 .79, sold to Burdick.
These liens were erroneously shown against the above
_ lots . They should be against the Chatsworth :clap Lots
101 and 103 .

books on these items .

On motion by Councilman Bates, seconded by Councilman Griffin,
it was unanimously
RESOLVED, that the Assessor be and he hereby is
authorized to make the correction of the tax
records in accordance rrith the foregoing letter .
Councilman Griffin reported that he had presented the matter
concerning the honor roll to the Park Commissioners at their meeting
held. the previous week. He said that they were interested in seeing
the proposals and sketches before taking action on a site .
Supervisor McCulloch stated that he would be pleased to turn
the papers over to Mr . Griffin.
Councilman Meginniss presented the following financial
statements which were ordered filed: (1) Summary of Receipts and
Disbursements from January 1 to April 30, 1941; (2) Statement of
Budget Appropriations and Expenditures from January 1 to April 303
1941; (3) Statement of Estimated Revenues from January 1 to April 30,
1941.
Councilman Bates reported that the project for the installa-
tion of storm water drains in the Larchmont Ridge Section was complete;
also that the work had been started on the project for the reconstruc-
tion of the bridge at Bonnie Briar Lane .
Supervisor McCulloch informed the Board that the Receiver
of Taxes had called his attention to a tax bill which was being paid
by a taxpayer living on Turk' s Island., West Indies, and that because
of the time required for mailing it was almost impossible to keep the
records up to date . He explained that by the time that a tax bill
reached its destination an additional charge was already in effect .
ie recommended the follovring resolution wrhich was on motion by Council-
man Griffin, seconded by Councilman Bates, upon roll call unanimously
ado,ated:
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, empowered and directed
to accent payment of taxes for the year 1935, sale of
1939, on Section 1, Block 59, Lot 1, the lien for
which is held by the Town, in the face amount of the
lien, namely, $21.06 .
On motion by Councilman Griffin seconded by Councilman Btaes, it was upon roll
call unaimously
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, empowered and directed
to accept payment of taxes for the year 1939 sale of
1940, on Section 9, Block 21, Lot 2, the lien for
which is held by the Town, in the face amount of
the lien plus 6 per cent interest per annum, namely,
$305 .04, provided payment be made within thirty days .
The Supervisor informed the Board that Mrs . Rose M. Blake
had expressed her desire to retire from active duty and apply to the
New York State Employees ' Retirement System for a pension. All mem-
bers of the Board joined with the Supervisor in praising Mrs . Blake
for her long years of service .
On motion by Councilman Bates, seconded by Councilman
Griffin, it was upon roll call unanimously resolved
WHEREAS, Pairs . Rose 1. Blake has served the Town
of Mamaroneck during the past 27 years as custodian
of the Old Town Hall on Prospect Avenue, Mamaroneck,
New York; and
WHEREAS, Mrs . Blake has expressed her desire to
retire from active duty because of her age;
NOW, THEREFORE, BE IT
RESOLVED, that we accept Mrs . Blake' s resignation
with sincere regret, it being the opinion of this
Board that her work was most efficient and that the
Town will miss the services of such a faithful employee;
and be it
FURTHER RESOLVED, that we express to Mrs . Blake our
deep appreciation and best wishes for her happiness
during retirement; and be it
FURTHER RESOLVED, that this resolution be spread upon
the minutes of this Board meeting and that a copy of
same be sent to Mrs . Blake
Councilman Griffin moved and Councilman Meginniss seconded
the following resolution which was on roll call unanimously adopted:
RESOLVED, that Thomas Blake be and he hereby is
appointed to the position of janitor for the
Old Town Hall at a salary at the rate of $720
per ,year, the appointment to take effect June 1,
1941 and to continue at the pleasure of the Town
Board.
The Supervisor reported that he had received from the Board
of Education of Union Free School District No. 1 of the Town of Mama-
roneck a certified copy of the budget of the school district for the
ensuing school year.
On motion by Councilman Meginniss, seconded. by Councilman
Griffin, the budget was ordered entered in the minutes as follows:

The Supervisor also reported that he had received from
the Board of Education of Scarsdale School District No. 2, a part of
which is within the 'Town of Mamaroneck, a, certified copy of the budget
of the school district for the ensuing school year. The budget was
ordered entered in the minutes as follows :

A letter dated May 12, 1941, received from the County of
Westchester Department of Public Works, giving notice of a public
hearing on proposed rules and regulations for the reconstruction
and maintenance of county highiTrays was read. The time and place
was given as June 2, 1941 at 3 P.M. before the Board of Cupervisors
of Westchester County, White Plains, New York.
The Supervisor registered the Town Clerk to send, copies
of the letter to the members of the Board.
On motion duly made and seconded, it was unanimously
RESOLVED that the following, shall be the office
hours of t'fle Town of hlanaroneck offices during
the period June 1 to August 31, 1941:
Week days - 9 A. M. to 4 P . M.
Sa.turdays - 9 A. 11. to 12 noon
Following some discussion the members of the Board decided
that because of the amount of business before the Board this year,
they would change the summer schedule for Town Board meetings from
one meeting each month for June, July, August and September to one
meeting for each of the following months: July and August .
Upon motion made by Councilman Bates, and seconded by
Councilman Griffin, it was
RESOLVED, that the Town accept the portion of the
street knovrn as Durham Road, as shovrn on a map of
Larchmont Ridge, filed April 21st, 1931, in the
office of the Register of Westchester County as
Map #3762, described as follows :
ALL of that lot, plot or parcel of land known by and as the
northerly portion of Durham. Road as shown on map entitled
"Map of Larchmont Ridge Property of Fenimore Cooper Estates,
Inc. , Town of Mamaroneck, Westchester County, New York, Portion
of Section No. 3" as made by H. G. Johnston, April 14, 1931
and filed in County of Westchester Bureau of Land Records,
April 215 19,11, as Map No. 3762, said lot, plot or parcel,
being more particularly bounded and described as foilours:
BEGINNING at a point in the southerly line of Fenimore
Road (formerly Grand Park Avenue) which point is in the
northerly line of let 149 on above mentioned map and is the
westerly end. of a course with a bearing of N. 71 31' 20" W.
and a length of 95 .46 feet and running thence the following
courses and distances: N. 710 31' 20" W. along the southerly
line of Fenimore Road 1.35 feet to a point of curve, thence
continuing along the southerly line of Fenimore Road by a
curve deflecting to the right with a radius of 380.0 feet
a distance along the arc of 121.43 feet to a point in the
northerly line of property belonging to Edwin H. Richard,
thence in a general southerly direction along the westerly
line of Durham Road and the easterly line of Richard' s pro-
perty the following courses and distances by a curve de-
flecting to the right with a radius of 20.00 feet a distance

281 40" W. 97.35 feet to a point of curve, by a curve de-
flecting to the right with a radius of 573 .59 feet, a dis-
tance along the arc of 99.73 feet to a point of tangency
S. 23 26' 04" W. 202.24 feet to the southeasterly corner of
Richard' s property, thence in a southeasterly direction across
Durham Road on a continuation of Richard' s southerly property
line S. 61 58 24" E. 50.16 feet to a point in the easterly
line of Durham Road and in the westerly line of lot 160 on
above mentioned map, thence in a northeasterly direction along
the easterly line of Durham Road the following courses and
distances : N. 23 26" 0411 E. 163 .53 feet to a point of curve,
by a curve deflecting to the right with a radius of 20 feet
a distance along the arc of 31.42 feet to a point of tangency
in the southerly line of Ormand Place, thence across Ormand
Place N. 21 57' 34" E. 40 feet to a point of curve in northerly
line of Ormand Place, thence by a curve deflecting to the right
with a radius of 15 .0 feet a distance along the arc of 20.96
feet to a point of tangency in the easterly line of Durham
Road, thence continuing along the easterly line of Durham
Road N. 13 28' 40" E. 56.0 feet to a point of curve, thence by
• curve deflecting to the right with a radius of 116.0 feet
• distance along the arc of 46.95 feet to a point of compound
curve, thence by a curve deflecting to the right with a radius
of 256.0 feet a distance along the arc of 66.85 feet to a point
of compound curve, thence by a curve deflecting to the right

FURTHER RESOLVED that the Town Attorney be in-
structed to prepare and have executed the
necessary deeds and releases.
On motion by Councilman Griffin, seconded by Councilman
hleginniss, the following resolution was unanimously adopted:
WHEREAS in foreclosure proceedings instituted by the
Town of Mamaroneck against Hillside Holding Corp . ,
et als . , the referee duly appointed for that purpose
by order of the Supreme Court, sold to the Town of
Mamaroneck, property described as Section 1, Block 52,
Lots 17 and 18, on the Assessment Map of the Town of
Mamaroneck; and
WHEREAS the said referee has applied to the payment
of certain taxes, assessments and tax liens owned
by and due to the Town of Mamaroneck, together .°rith
interest and penalties thereon the date of sale, the
sum of $266.41 which taxes, assessmentsand tax liens
are required to be cancelled by the provisions of
Section 54 of the Westchester County Tax Act.
NOW,, THEREFORE, BE IT
RESOLVED that the following taxes, assessments and tax

Town Attorney Delius read a report which he had prepared
in regard to the inspection of the following buildings alleged to
violate zoning, fire prevention and building ordinances of the Town
of Mamaroneck:
1. 26 Hoyt Avenue, Section 1, Block 89, Lot 17
(Block 130, Parcel 118)
2. 32 Lester Place, Section 1, Block 51, Lots 24-25
(Block 130, Parcel 123)
3 . 30 Lester Place, Section 1, Block 51, Lots 26-27
(Block 130, Parcel 128)

On motion duly made and seconded it was unanimously
RESOLVED, that the Town Attorney be and he hereby
is directed to take such steps as are necessary
to cause the removal of these alleged violations.
Town Attorney Delius reported that he was in a position to
make a settlement on foreclosure proceedings by paying a small sum
for a deed to the following described property: Block 403, Parcel 238,
formerly known as Section 4, Block 11, Lots 17 and 20, property of
Larchmont Gardens Company.
On motion by Councilman Griffin, seconded by Councilman Bates,
it was upon roll call unanimously
RESOLVED, that the Town Attorney be authorized to
pay $1.00 for the deed covering the above described
property.
Comptroller Luceno requested that the Supervisor and he
be authorized to make certain transfers within the 1940 budget in
order to adjust accounts for the calendar year 1940.
On motion by Councilman Pdeginniss, seconded by Councilman
Griffin, the following resolution was unanimously adopted:
WHEREAS, there are certain unencumbered balances
and over-expenditures in the 1940 budget; and
WHEREAS, the Comptroller has requested the following
transfers within the 1940 budget to adjust accounts
to the end of the calendar year 1940;
NOW, THEREFORE, BE IT
RESOLVED, that the Comptroller and the Supervisor be
and they hereby are directed to make the following
transfers within the 1940 budget as of December 31,
1940:

The Town Clerk presented the contract between the Westchester
Shore Humane Society, Inc . , which had been prepared by the Town Attorney
for the year 1941 for the purpose of the capture and impoundage of all
dogs found unlicensed and running at large in the Town of Mamaroneck.
The amount of the contract was $1129 .87.
On motion by Councilman Griffin, seconded by Councilman Bates,
it was upon roll call, the Supervisor not voting, unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized, empowered and directed to sign the
contract between the Westchester Shore Humane
Society, Inc . and the Town of Mamaroneck for the
year 1941.
Councilman Mandeville reported that "Clean-Up Week" extended
over a two-week period and that there was a total of 283 requests for
the removal of rubbish; also that there was a survey of vacant lots
made by the Highway Department and it was reported that a number of
lots were in bad condition.
The Board requested. Superintendent of Highways Foote to
get the owners to cooperate in cleaning their property.
The Supervisor reported that the Defense Council had set
up their headquarters at the Vseaver Street Fire House and that it
was getting along quite well with the registration of civilians .
He mentioned that the residents were quite willing to register and
the response could be considered very good.
The Town Attorney presented a proposed agreement between
the Village of Mamaroneck and the Town of Mamaroneck in regard to
the property formerly assessed to H. M. Williams Corporation and
described as Section 9, Blocks 67 and 77, which had been acquired
by the Village of Mamaroneck through foreclosure . He recommended .
that the Supervisor be authorized to sign the agreement for the Town.
On motion duly made and seconded it was unanimously
RESOLVED, that the Supervisor be and he hereby
is authorized, empowered and directed to sign
the above described agreement between the Village
of Mamaroneck and Town of Mamaroneck.
The report of the Mamaroneck Health Center, Inc . for the
month of April was received and filed.
