REGULAR MEETTNG OF THE TOWN BOARD
TOWN OF MAMARONECK, NEW YORK
HELD APRIL 21 1941
At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y.
The meeting was called to order by Supervisor McCulloch at
8 P. Id.
Present: Supervisor McCulloch
Councilmen Bates and Mandeville
Absent: Councilmen Griffin and Meginniss
The presence was also noted of Town Clerk Payne, Town Attorney
Delius and Town Engineer Foote.
The minutes of the meetings of February 55 February 18,
March 1 and March 5, 1941, were approved as presented.
The Supervisor suggested that the meeting proceed with the
reports of committees .
Councilman Mandeville reported that everything in the High-
way Department was in fine order. He suggested that a week be set
aside for "Clean-up Week" and following some discussion, it was on
motion by Councilman Mandeville, seconded by Councilman Bates, unani-
mousI
RESOLVED, that the week beginning April 28th and
ending May 3rd be and it hereby is designated as
"Clean-up Week" for the unincorporated section of
the Town of Mamaroneck.
Councilman Mandeville presented three petitions received
from the Assessor for the correction of the assessment roll so as to
permit the apportionment of taxes .
On motion by Councilman Mandeville, seconded by Councilman
Bates, the following resolution was upon roll call unanimously adopted:
WHEREAS, the Assessor has presented petitions for
the correction of the assessment rolls for the years
1939 and 1940, taxes of 1940 and 1941, pursuant to
the provisions of Section 33 of Chapter 105 of the
Laws of 1916, as amended, known as the Westchester
County Tax Act; and
WHEREAS, after due consideration this Board finds it
desirable to grant said petitions for the correction
of said assessment roll;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll for the year 1940,
taxes of 1941, which shows property now appearing on
the roll as follows:

FURTHER RESOLVED, that the assessment roll for the
year 1940, taxes of 1941, which shows property
FURTHER RESOLVED, that the following described property
be removed from the assessment roll for 1940, taxes of
194,1, and that the taxes for 1939, 1940 and 1941 in the
amounts of $8. 59, $7.90 and $4.99 respectively, be and
they hereby are cancelled for the reason that the pro-
perty was ;out on the tax man in error and is assessed
with other properties of 0 . W. Birkhead and others:

Councilman Bates reported that the work
on the W. P. A. project for storra water drains in
Section. He also reported that progress on the
had beer, slowed down because there was a. shortage
on the project.

The Town Clerk read a letter dated April 1, 1941, received
from the Village of Larchmont, requesting that property referred to
in the Town of Mamarcneck tax bill No . 3462 be placed on the "exempt"
also that in
tax list; the parcel known as Birch Lane and Lot No . 4
as shown on the Negbar Subdivision be placed on the "exempt" list.
Town Assessor Smith informed the Board that the first parcel
mentioned was not transferred to the Village until December 18, 194,0,
which date was several months after the roll had been filed. He said
that the abstract showing transfer of the second parcel had not been
received by his office to date; also that both parcels would be con-
sidered when the new roll was prepared.
The members of the Board directed the Town Clerk to advise
the Village that the tax bill would have to be paid and that the
assessor vaould consider both parcels while preparing the nev, roll.
A continuation certificate and rider for the Supervisores
highway bond., increasing the amount from $39,000 to $40,000 to meet
the reouirements of the County for the year 1941 were presented for
the approval of the Board.
The Tovil Attorney examined the papers and recommended that
they be approved.
On motion by Councilman Mandeville, seconded by Councilman
Bates, it was upon roil call unanimously
RESOLVED, that the continuation certificate and
rider for the Supervisorls highv:ay bond, increasing
the amount from $39,000 to $4,000 for the remainder
of the period commencing January 1, 1940 and ending
December 31, 1941, are hereby approved and the Town
Clerk is hereby instructed to file copies with the
proper authorities .

A letter dated April 1, 1941, was received from Hillandale
Investors Corporation, in which they asked the privilege to pay
certain tax arrears at a reduced amount. The matter was referred to
the Supervisor.
Town Attorney Delius recommended that the application of
Emma D. Hansen for the re-zoning of 4 Boston Post Road, Town, be laid
over until record of the transfer of the property to Mrs . Hansen had
been filed with the Town.
The 'Town Attorney stated that in connection with the contem-
plated foreclosure against the several lots in Fenimore Cooper Park
nova owned by Birckhead-, , Heilman and Beaty, as Trustees for Certificate
Holders of Trust Estates known as Series 69-C, 25-F, 11-F and 9-F,
Westchester Title & Trust Company , the Title Guarantee & Trust Company
has agreed to make a search of the title to the property for the sum r Board.
of : 800 . and that they had requested an approval of this by the Bed.
Upon motion duly made by Councilman Mandeville and seconded
by Councilman Bates, it was
RESOLVED that the Title Guarantee and Trust Company
be authorized to make the search and that they be paid
therefor the sum of $800. out of the budget appro-
priation of the Department of Lank for such purposes .
Following some discussion on the equalization rates tentatively
fixed by the State Department of Taxation and Finance, it was on motion
by Councilman Mandeville, seconded by Councilman Bates, on roll call
unanimously
RESOLVED that the Supervisor be and he hereby is
authorized to sign on behalf of this Board, a
protest to the Department of Taxation and Finance
of the State of New York, protesting the equaliza-
tion rates tentatively fixed by the said Department
of Taxation and Finance, for the special franchise
tax in the year 1941 to be assessed against:

Westchester Lighting Company
New York, New Haven w Hartford Railroad Company
American Telegraph & Telephone Company
New York Telephone Company
in the Town. of Mamaroneck, as shown upon the notice
sent to the Supervisor and dated March 17, 1941, for
such special franchise, upon the ground that said rate
is not the true rate according to its percentage of
the full and actual value at which real property in the
Town of Mamaroneck is being assessed for the year 1941;
and upon the further ground that said equalization rate
is not the rate established for the Town of Mamaroneck
by the 'Tax Commission of Westchester County in its tabu-
lations and computations made in connection with the
1941 equalization table for the County of Westchester .
On motion by Councilman Mandeville, seconded by Councilman
Bates, on roll call, it was unanimously
RESOLVED, that Supervisor McCulloch, Town Attorney
Delius and Assessor Smith be and they hereby are
authorized to represent the Town of Mamaroneck at
the hearing before the State Tax Commission on
April 22, 1941, at Albany, New York; and be it
FURTHER RESOLVED, that they be -reimbursed for their
expenses out of Town funds set aside in the budget
for traveling expenses .
Town Attorney Delius reported that the attorney representing
Mrs . Shirley Stevenson had offered to settle certiorari proceedings
instituted to review the assessment upon the property known as Section 1,
N
Block 111, Lot 99 . He informed the Board as to the arrangement offered
by the attorney and following some discussion the members of the Board
denied the application.
The Supervisor presented a letter from Douglas L. Barrett,
County Right-of-Way Engineer, stating that it would, be necessary to
acquire 191 square- feet on the corner of Howell Avenue and Weaver
Street, for highway purposes because of inaccuracies in the old state
highway taking map Which did not include this area although it had been
used as a highway since 1927 . The letter further stated that the owner,
Mr. Howell C. Perrin, would accept $200. for damages including conse-
quential damages .
Upon motion made by Councilman Mandeville, seconded. by
Councilman Bates, it was
RESOLVED, that the acquisition of 191 square feet
as shown on may made by the Westchester County
Department of Public Works, dated March 19th, 1941,
County Block #3216, showing land to be provided for
reconstruction of Weaver Street, Part I, State Highway
1645, County of Westchester, be approved for the sum
of $200 .
The Supervisor stated that he had received a request from
the Adult Activities and Recreation Council for funds to carry on
their activities .
On motion by Councilman Mandeville, seconded by Councilman
Bates, it was unanimously
RESOLVED, that the Comptroller be and he hereby
is authorized to transfer from surplus funds
the amount of $100.00 to provide funds to continue
the Recreation Project of the Town of Mamaroneck.
The Supervisor stated that the Village of Mamaroneck had
questioned the right of the Town to make a rental charge for voting
machines used in the village elections . He pointed out that the
charge was instituted by a former board several years ago when the
first machines were purchased; also that from that time to date one-
half of the machines were used in the village districts over in the
Torn of Rye. He said that in the future elections they planned to
use machines owned by each town within the toms limits .
The Town Clerk informed the members of the Board that a
letter had been received from the Automatic Voting Machine Corporation
asking whether or not the 'Team intended to go through with the option
for purchase included in the rental agreement for three voting machines .
Following some discussion the 'Town Clerk was directed to return
two of the machines to the company and to keep one in storage for the
consideration of the Board when all are present.
Councilman Mandeville reported that Councilman Griffin was
up and around. The members of the Board expressed their pleasure in
hearing this news and stated that they looked forward to the time when
iir . Griffin would be with them again.
The following reports were received and ordered filed: (1)
The Report of the Receiver of Taxes and Assessments for the month of
March: (2) The Report of the Building Inspector for the month of
March; and (3) The Report of the Plumbing inspector for the month of
March.
At 9 P. L. the Board unanimously resolved to adjourn.
