REGULAR MEETING OF THE TOWN BOARD

At the Town Offices, 158 West Boston Post Road, Mamaroneck, 11. Y.
8 P. M.
The meeting was called to order by Supervisor McCulloch at
Present: Supervisor McCulloch
Councilmen Bates, Griffin, and Mandeville
Absent: Councilman Meginniss
The presence was also noted of Deputy Town Clerk Alice E.
Wheelock, Town Attorney Delius, Assessor Smith and Town Engineer
Foote.
The Supervisor asked the councilmen for their reports .
Councilman Griffin read the Public Welfare report for the
month of January, 1961, which shooed comparative figures for the
month of January, 1940, as follows:

He read a letter from Public Welfare Officer DeVinne
dated February 5, 1941, pointing out to the Town Board that during
the month of January the Public Welfare Department had been called
upon by the Selective Service Boards to make investigations on
draftees claiming dependents, which had increased considerably the
work of the case workers .
Councilman Bates reported that the work on the Oxford
Drain Project was progressing fairly well.
Councilman .Handeville commended the men of the Highway
Department for their work in removing snow from the roads after
the recent storm.
Supervisor McCulloch reported that he had attended a
meeting of the Superintendents of HighsAlays of Vestchester County,
at which Mdr. J. S. Bixby, District Engineer of the State Depart-
ment of Public Works, had made the statement that Westchester County
had the worst snow removal in the State . " The Supervisor stated,
however, that the Town of Mamaroneck had not been included in a
list of the towns which a State survey disclosed had done the poorest
jobs .
The Supervisor presented a report of a study he had made
of the assessments that are placed upon property in the Town of
,Mamaroneck as compared with the assessments placed upon the same
property located in the villages of Larchmont and Mamaroneck, which
study he had been requested to make at the last meeting. The report
was ordered filed.
A letter dated January 21, 1941, was received from Fire
Chief Wm. V. McCarthy, Jr. , in which he informed the Board that the
Fire Council recommended the appointment of Earl Mellor and Louis
Testa as paid drivers and permanent employees of the Fire Department,
since they have satisfactorily completed the probationary period.
On motion by Councilman Mandeville, seconded by Councilman
Bates, it was upon roll call unanimously
RESOLVED, that upon the recommendation of the Fire
Council the following men, having satisfactorily
completed their probationary period, are hereby
appointed paid drivers of the Fire Department:
Earl Mellor
Louis Testa
An application for a dance hall license was received from
the Chauffeurs ' and Domestic workers' Club of Westchester County,
Inc . of 4 Valley Place, Town of Mamaroneck. The application bore
the approval of the Building Inspector, the Fire Inspector and the
Chief of Police of the Town of Mamaroneck.
The Supervisor stated that he would like to make certain
that the club was not open to the general public before the Board
approved of the application and authorized the issuance of a dance
hall license without charging the fee of $100.00.
On motion duly made and seconded, it was unanimously
RESOLVED, that the application for a dance hall
license made by the Chauffeurs ' and Domestic Workers '
Club of Westchester County, Inc . of 4 Valley Place,
Town of Mamaroneck, be and it hereby is approved,
subject to the further approval of the Supervisor.
A letter dated January 29, 1941, was received from
Mr. Earl W. Quick, Business Manager of the Mamaroneck Chamber of
Commerce, Inc . , suggesting that the Town Board place an advertise-
ment in the 1941 local telephone directory published by the Chamber
of Commerce .
After discussion the Board directed the clerk to inform
Mr . Quick that the item for publicity purposes previously included
in the town budget had been discontinued and that they regretted
that there was no legal way in which they could authorize the
insertion of an advertisement in the directory.
Mr. Frank Richelson and ldorris Goldstein, attorney,
appeared before the Board to explain their reasons for requesting
an apportionment of the property owned by Hillandale Investors and
described as Section 9, Block 8, Lots 12 to 16 (903-459) . They
stated that the parcel is now assessed at $10,000 and they were
requesting that it be apportioned into two parcels, one assessed
at $4, 600 and the other at $5,400 in order that they might erect
four dwellings on the portion which faces Stanley Avenue. They
also requested permission to pay the tax arrears on this portion
at a reduced amount .
After a lengthy discussion Councilman landeville moved
and Councilman Griffin seconded the following resolution which was
unanimously adopted:
WHEREAS, the Assessor has presented a petition for
the correction of the assessment rolls for the years
- 1939 and 1940, taxes of 1940 and 1941, pursuant to
the provisions of Section 33 of Chapter 105 of the
Laws of 1916, as amended, known as the Westchester
County Tax Act; and
WHEREAS, after due consideration this Board finds it
desirable to grant said petition for the correction of
said assessment rolls;
NOW, THEREFORE, BE IT
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, empowered and directed
to accept payment of taxes for the years 1938 and 1939,
sales of 1939 and 1940, on Section 9, Block 8, Lots 14B,
15 and 16, the liens for which are held by the Toyn, in
the face amount of the liens, provided payment is made
within thirty days and provided the necessary affidavits
required under Section 39-b of the Zluestchester County
Tax Lave are filed with the Receiver of Taxes .
1dr. Richelson and Mr . Goldstein also requested that
another parcel of land owned by Brittany Homes, Inc . described as
Section 11 Block 57, Lots 16, 17, 61 and 62 be assessed as two
separate parcels, one facing Myrtle Boulevard and the other facing
Edge,,iood Avenue, in order that they may secure a mortgage and erect
a building on the parcel fronting on Myrtle Boulevard. They also
requested the Board to permit they, to settle the tax arrears at a
reduced amount.
On motion by Councilman Griffin, seconded by Councilman
Bates . the following resolution was unanimously adopted:

Councilman Griffin presented a third petition received
from the Assessor for the correction of the assessment roll so as
to permit the apportionment of taxes .
On motion by Councilman Griffin, seconded by Councilman
Mandeville, the following resolution was unanimously adopted:
WHEREAS, the Assessor has presented a petition for
the correction of the assessment rolls for the
years 1939 and 1940, taxes of 1940 and 1941, pursuant
to the provisions of Section 33 of Chapter 105 of the
Laws of 1916, as amended, known as the Westchester
County Tax Act; and
WHEREAS, after due consideration this Board finds it
desirable to grant said petition for the correction
of said assessment roll;

Town Attorney Delius presented for the consideration of
the Board a new contract between the Town of Mamaroneck and the
Larchmont Public Library. He explained that the first agreement
had been made on September 17, 1930 and had been modified by a
further agreement on February 2, 1937. Since the first agreement
and the modification the proportionate use of the library by the
residents of the unincorporated section of the Toren of Mamaroneck
has increased, he said, and the library is now asking the Town to
increase its appropriation to $5,520 a year, provision for which has
already been made in the 1941 budget of the Town. He recommended that
the Supervisor be authorized to sign the contract.
On motion by Councilman Mandeville seconded by Councilman
Griffin, it was upon: roll call (the Supervisor not voting) unanimously
RESOLVED, that the Supervisor be and he hereby
is authorized to sign the new contract between
The Larchmont Public Library and the Town of
Mamaroneck providing for the payment of $5,820
per year by the Town of Mamaroneck as its pro-
portionate sure for the use of the library by the
residents of the unincorporated section of the Town.
Town Attorney Delius presented and recommended the
approval of a resolution authorizing the issuance of $65,000 to
pay the cost of materials, labor and supplies to be borne by the
Town in connection with W . P . A. projects throughout the Town.
Councilman Mandeville introduced the following resolution:
RESOLUTION APPROPRIATING THE SUPT OF $65,000 TO
PAY A PORTION OF THE COST OF PUBLIC IMPROVEMENT WORK
RELIEF PROJECTS IN THE TOWN AND AUTHORIZING THE
ISSUANCE OF $65, 000. BONDS OF THE TOWN OF MAMVIARONECK
FOR SAID PURPOSES.
RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMARO-
NECK, IN THE COUNTY OF WESTCHESTER, NEW YORK, as follows :
Section 1. The sun of $8,850 , is hereby appropriated
to pay the portion to be borne by the Town of public
improvement work relief projects in the Town undertaken
through or by the authority of the Work Projects Admini-
stration or any other work relief agency of the Federal
Government, including the cost of furnishing labor,
materials, supplies and equipment for such projects and
incidental expenses in connection therewith, the said
public improvement work relief projects to include only
projects having a period of probable usefulness of at
least five (5) years, computed from October 1, 1940, the
date of the first indebtedness, whether temporary or
permanent, incurred to finance any portion of the cost
thereof. To meet said appropriation, bonds of the Towm
in an aggregate principal amount not exceeding $8,850.
shall be issued.
Section 2. The sum of $56,150. is hereby appro-
priated to pay the portion to be borne by the Town of
public improvement work relief projects in the Town
undertaken through or by the authority of the Work Pro-
jects Administration or any other work relief agency
of the Federal Government, including the cost of furnish-
ing labor, materials, supplies and equipment for such
projects and incidental expenses in connection therewith,
the said public improvement work relief projects to include
only projects having a period of probable usefulness of
at least ten (10) years, computed from April 1, 1940, the
date of the first indebtedness, whether temporary or per-
manent, incurred to finance any portion of the cost
thereof. To meet said appropriation, bonds of the Town
in an aggregate principal amount not exceeding $56,150.
shall be issued.
Section 3 . Said bonds shall be combined in
a single
issue, shall each be designated "General Bond of
1941,
Series I, " shall be dated

Said bonds shall bear interest at a rate not exceeding
six per centum (60) per annum, payable semi-arnually on
the first days of September and March in each year, to
be expressed in a multiple of one-tenth or one-quarter
of one per centum, the exact rate to be determined by
the Supervisor upon receipt of bids, shall be numbered
in order of maturity from 1 to 65, both inclusive, shall
be of the denomination of $1,000. each, shall be payable
as to both principal and interest in lawful money of the
United States of America, at the office of the First
National Bank of Mount Vernon, Lount Vernon, New York,
or at the option of the holder, at the principal office
of the Guaranty Trust Company of New York, in the City
and State of New, York, shall be coupon bonds, register-
able as to principal and interest, and shall be signed
by the Supervisor and the corporate seal of the Town vn
shall be affixed thereto and attested by the Town Clerk
and the coupons attached thereto shall be authenticated
by the facsimile signature of the Supervisor. Said
bonds shall be issued pursuant to the following laws of
the State of New. Yor , as amended: Chapter 782 of the
Laws of 1933, the Town Law, constituting Chapter 62,
and the General Municipal Law, constituting Chapter 24
of the Consolidated Laws .
Section 4. The faith and credit of said Town shall
be and are hereby pledged for the punctual payment of
the principal of and interest on said bonds, and a tax
shall be levied annually on all of the taxable property
in said Town in an amount sufficient to pay the principal
of and interest on said bonds as the same shall become
due.
Section 5 . Resolutions entitled: "Resolution
appropriating the sum of $32,000. to pay a portion of
the cost of public improvement work relief projects in
the Town and authorizing the issuance of $32,000. Bonds
of the Town of Mamaroneck for said purpose" , adopted
March 6th, 1940, "Resolution appropriating the sum of
$8,850. to pay a portion of the cost of public improve-
ment work relief projects in the Town and authorizing
the issuance of $8,850. Bonds of the Town of Mamaroneck
for said purpose" , adopted September 25th, 1940, and
"Resolution appropriating the sum of $8,650. to pay a
portion of the cost of public improvement work relief
projects in the Town and authorizing the issuance of
$8, 650. Bonds of the Town of Mamaroneck for said
purposell, adopted November 20th, 1940, and "Resolution
appropriating the sum of $2,500.00 to pay a portion of
the cost of public improvement work relief projects
in the Town and authorizing the issuance of $2, 500 .00
Bonds of the Town of Mamaroneck for said purpose,
adopted Jan. 4th, 1941, are hereby repealed, rescinded
and revoked to the extent of the appropriations and
authorizations herein contained, except that nothing
herein contained shall be construed to affect the
validity of any obligation issued in anticipation of
the bonds authorized by said resolutions .
Section 6. Said bonds shall be sold by the Super-
visor upon sealed proposals to be received on February 18,
1941, at 11 o' clock A. M. Eastern Standard Time, at the
Tom Offices, 158 Test Boston Post Road, in the Village
of Mamaroneck, in said Town, and the Town Clerk is hereby
authorized and directed to cause a notice of sale of
said bonds in substantially in the form hereinafter
provided to be published at least once in the "Daily
Times" , a newspaper published in the Town of Mamaroneck,
which is hereby designated as the official newspaper
of the Town for the purpose of such publication, not
less than five nor more than thirty days prior to the

date of sale, and also to cause such notice of sale
to be published at least once in the "Daily Bond Buyer" ,
a financial newspaper published in the City of New York.
Section 7. Said notice of sale shall be in sub-
stantially the following form:

GENERAL BONDS OF 1941, SERIES I
The Supervisor of the Town of Mamaroneck, in the
County of Westchester, New York, will receive sealed
bids at the Town Offices, 158 Vest Boston Post Road,
in the Village of Mamaroneck, in said town, on Tuesday
February 18, 1941, at 11:00 o'clock A. M. , Eastern
Standard Time, for:
$65,000 par value General Bonds of 1941, Series I
of said town, dated March 1, 1941, maturing $10,000
on March 1 in each of the years 1942 to 1945 inclusive,
and $5,000 on March 1 in each of the years 1946 to
1950 inclusive; denomination $1,000, coupon in form,
registerabie as to both principal and interest; purpose
and period of usefulness, to provide funds to pay a
portion of the cost of Public Improvement Work Relief
Projects having periods of probable usefulness of five
and ten years, authorized by Chapter 782 of the Laws of
1933 as amended. Interest September 1, 1941 and
semi-annually thereafter on the first days of March
and September in each year and at maturity, and principal
of said. bonds will be payable in lawful money of the
United States at the office of the First National Bank
of Mount Vernon, Mount Vernon, New York, or, at the
option of the holder, at the principal office of the
Guaranty Trust Company of New York in the City, County
and State of New York.
Bidders must state in their bids a single rate of
interest which all of the bonds are to bear, expressed
in a multiple of 1/1, or 1/10 of one per centum (1%) but
not exceeding six per centum (6%) per annum and must
state the price offered. The bonds will bear the lowest
rate of interest stated by any bidder in a duly acceptable
bid and will be awarded to the bidder stating such lowest
rate . If two or more bidders offer to take the bonds
at the same lowest rate, the bonds will be awarded to the
bidder offering to pay the highest price therefor .
No bid will be accepted for separate maturities or
at less than the par value of the bonds, or unless
accompanied by a certified check or bank draft upon
an incorporated bank or trust company, payable to the
order of the "Town of Mamaroneck, Nev; York" for $1300.00
being two per centum (20) of the amount of the bonds .
No interest will be allowed upon such check or draft.
Checks of unsuccessful bidder will be returned promptly
applied in part payment for the bonds or to secure the
Town against any loss resulting from the failure of the
bidder to comply with the terms of his bid.
The Town operates under the Town Law, constituting
Chapter 62 of the Consolidated Laws of the State of
New York.
All proposals together faith check or draft must
be enclosed in a sealed envelope endorsed "Proposal for
Bonds" and directed to Mr . Bert C. McCulloch, Supervisor,
Town of Mamaroneck, New York.

The right is reserved to reject any or all bids .
The bonds will be valid and legally binding obliga-
tions of the Town and the Town will have power and will
be obligated to levy ad valorem taxes upon all of the
taxable property within the Town for the payment of the
bonds and interest thereon, without limitation of rate
or amount. The opinion of Messrs . Sullivan Donovan
& Heenehan of New York City to this effect will be fur-
nished to the successful bidder.
The enactment, at any time prior to the delivery
of the bonds, of Federal legislation which in terms, by
the repeal or omission of exemptions or otherwise, sub-
jects to a Federal income tax the interest on bonds of
a class or character which includes these bonds, will,
at the election of the purchaser, relieve the purchaser
from his obligations under the terms of the contract of
sale and entitle the purchaser to the return of the amount
deposited with the bid.
No bid conditioned in any respect other than upon
this notice of sale will be accepted.
The bonds will be prepared under the supervision
of and authenticated as to genuineness by the First
National Bank of Boston and a duplicate-original legal
opinion and a certified photostatic copy of the transcript
of proceedings will be filed with the First National Bank
of Boston, where they may be inspected.
The bonds will be delivered on or about March 3 ,
1941 at the First National Bank of Boston, 67 dill Street,
Boston, Massachusetts, or, at the option of the purchaser,
at the principal office of The Nevi* York Trust Company in
the City and State of New York.

(The above statement of bonded debt does
not include the debt of any other sub-
division having power to levy taxes upon

financial situation of the Town will be submitted to any
interested bidder.

Section 8 . This resolution shall take effect
immediately.
On motion of Councilman Alandeville, seconded by Councilman
Bates, the foregoing resolution was adopted by the following vote:
