HomeMy WebLinkAbout1940_11_06 Town Board Minutes REGULAR MEETNG OF THE TOWN BOARD TOWN OF MAMARONECK, NEW YOK HELD NOVEMBER 6, 1940 At the Town Offices, 158 Nest Boston Post Road, Mamaroneck, 11. Y The meeting was called to order by Supervisor McCulloch at 8 p.m. Present: Supervisor McCulloch Councilmen Dates, Griffin, Mandeville, Peginniss Absent: None The presence was also noted of the Deputy Town Clerk, Town Attorney Delius and Town Engineer Foote The minutes of the meeting of October 2, 1940, were approved as presented. Councilman Bates reported that the work on the Oxford Road drain was getting along fairly well. Councilman Griffin presented the report of the Public .Welfare Office for the month of October, 199.0 . He pointed out that the case load for October this year was 290 and 363 last year; that the number of individuals receiving relief for October this year was 1211 and 1541 last year; and that the total a.aount expended during October, 192,0 eras $12, 657.63 and $17,194.96 for the same month last year , Councilman Mandeville reocrted that the Highway Department had cleared ur the leaves on the streets and ras filling in the cracks in the pavements around. the Chatsworth. Avenue and Myrtle Avenue section before reinter sets in. The regular order of business was suspended in order to hear Mr. Frank E. Newman who addressed the Board concerning the erection of a proposed multi-family dwelling at the corner of Hurray Avenue and Leafy lane . He exhibited sketches of the proposal improvement and de- scribed it as an "AT' Residential, tvao and one-half story, one-family tyTre of house consisting of six joined units of six and one-half rooms each, which would use one--third of the plot of land on which, it is to be erected. He stated that he had. contacted _tro_jerty owners on Leaf;; Lane and none of them had voiced any objection to the projecto He informed the Board that he had already discussed the matter with several riembers of the Board of Appeals and realized that there were certain restrictions that would have to be overcome, but before ,going ahead IT with his plans, he wished to obtain the sentiment of th.e Totin Board toward the project The Supervisor suggested that Mr. Newman make a formal re- quest before the Board of Appeals for a variance in the zoning re- strictions, which could not be granted. until a public hearing had been held. He and the members of the Board expressed interest in the project but stated that they would have to be governed by the wishes of the people in file neighborhood of the property affected. A letter dated November 6, 1940, was received from Hargaret A. Merola, requesting permission to pay certain tax arrears at a reduced amount on property, described as Section S. Block 58, Lot 23 ® On motion by Councilman Mlandeville, seconded by Councilnan Bates , it was unanimously RESOLVF D, that the Receiver of Taxes and Assessments be and he hereby is authorized, empowered and directed to accept payment Of taxes for to the following years on Section 8, Block 58, Lot 2:, the liens for which are held by the Town, in the face amount of the lien, provided payment is made within thirty days : Tar Sale Amount of Year Fear Lien 1931 1932 49.81 1932 1933 54.35 1934 1935 95 .29 1935 1936 56001 1037 1938 64.49 1938 1939 70.01 60 .55 Councilman Meginniss stated that he thought that the Board should have some definite volicy in regard to settlement of tar arrears and recommended that the Supervisor be authorized to arrange these settlments with the individuals making the requests . Following discussion Councilman Pdandeville moved and Council- naan Bates seconded the following resolution which was unanimously- adopted: RESOLVED, that the Supervisor be and he hereby is authorized. to discuss with individuals request- ing a compromise of taa, arrears the terms of settlement and to present to the Board for approval and ratification his recon endation as to settlement . A request eras received from To,:M Engineer Foote that the week of November 2, 1940, be designated as "Clean-Up Week". On motion by Councilman Mandeville, seconded. by Councilman Bates, it was unanimously adopted: RESOLVED, that the week of November 25 , 1940, be and it hereby is designated as 'Clean-Up Week" A letter. dated October 18, 1940, vas received from Chas , H. Sells, Commissioner of Public Vorks of 'Westchester County, concerning the matter of securing to the Tovrn the benefit of a State contribution in the amount of $50.00 per mile for the removal of snow from State highways . Town Superintendent of Highways Foote stated that the total mileage of State highways outside of the villages in the Town amounted to 2 .75 stiles and including the villages would be 4.67 miles . He said that the Commissioner of Public Works requested that the Town indicate on the agreement whether or not it wished to remove the snow fro,a the State highways vaithin the villages . After discussion on motion by Councilman Ttandeville, seconded Councilman Griffln, 1t 7iras upon roll call unanimously RESOLVED, that the Town Superintendent of Highways be and he hereby is authorized to enter- into an agreement with the County of Westchester for the purpose of securing to the Town time benefit of the State of New York contribution for the removal of snow from State highvaays in the Town of Mamaroneck including State high-ways inside the Villages of Tamaroneck and Larchmont . ' „ A letter dated September 24, 1940, was received from William E. Thrasher, Superintendent Of Westchester Joint Water Works No. 1 enclo ing estimates of the cost of connectir!g services on Spruce Rood to the main pipe line and of replacing the service of the Page residence on Weaver Street, which was exposed. when Weaver Street was graded for pavement and now freezes each winter. On motion by Councilman Bates, seconded. by Councilman Mandeville, the following resolution was upert roll call unanimously adopted: 0 WHEREAS, an estimate dated September 24, 1940, has been received from Westchester Joint Vater Works , No . 1 in the amount of $210.09 of the cost of connecting old services on Spruce Road to the main pipe line; NOW, THEREFORE, BE IT RESOLVED, that the Westchester Joint Works No . 1 be and it hereby, is authorized, enpoarered and directed to install for the Town of Mararoneck the water connection above described and to charge to the Town the cost of the installation. On motion by Councilman Bates, seconded by Councilman Yandeville, the resolution was upon roll call unanimously adopted; WHEREAS, an estimate dated September 249 19605 has been received from westchester Joint Water Works, No.1 in the amount Of $385.90 of the cost of lowering the service at the Page residence On Weaver Street, which was exposed when Weaver Street was graded for pavement and which now freezes each winter NOW, THEREFORE, BE IT RESOLVED, that the Westchester Joint Water Works No . 1 be and it hereby is authorized, empowered and directed to lower for the Totin of Llamaroneck the vrater connection above described and to charge to the Tci rn the cost of the installation. A letter dated October 30, 1940, was received from Mildred S . Brown, foriaer case worlrer in the Welfare Office, thanking the Town Board for their best wishes and for the cooperation which she received from them while She was a member of the staff Of the welfare. Office . The letter ordered filed. The Town Attorne presented affidavits executed by John V. Daly, Filippo Guglielmo, Guiseppe Guglielmo and Harold. D. Toomey, setting forth that the transfer of tax lien affecting premises de- scribed as Section 1, Block 89, Lot 17, being lien No . 34 of the sale of May 28th 1930, in the amount of $65.68, purchased by John V. Daly, had been lost . He explained that Toomey and Toomey, Esos . , attorneys for John V. Daly had commenced foreclosure proceedings because of failure of Guiseppe Guglielmo to redeem this transfer of tax lien, and that during the pendency of tae foreclosure action the transfer of tax lien was redeemed and delivered by John V. Daly to Guiseppe Guglielmo, who either lost or destroyed the liens He stated that an indemnity agree- ment had been received from Filippo Guglielmo, present owner of the property indentifying. The Town of Mamaroneck against loss if for any reason the transfer of tax lien is ever found and presented to the Tommy He recommenddd that the lien be cancelled and that a duplicate tax lien be issued in accordance with the provisions of Section 54 of the Westchester County Tax On motion by Councilman Griffin, seconded by Councilman Bates, it was unanimously RESOLVED, that the Supervisor be and he hereby is authorized to issue a duplicate of said lien to the end that the same way be surrendered to the Receiver of Taxes, together with satisfaction and affidavit of John V. Daly, and cancelled. For the first half of the first year at the rate of $2,000.00 per annum For the second half of the first year at the rate of $2,100.00 per annum For the second year at the rate of $2,200.00 per annum For the third year at the rate $2,300.00 per annum For the fourth year at the rate of $2,400.00 per annum For the fifth year and thereafter at the rate of $2,500.00 per annum. On motion by Councilman Griffin, seconded by Councilman Mandeville, it was unanimously RESOLVED, that the changes in salary scale for patrolmen of the Town of Mamaroneck Police Department commencing on January 1, 1941, as submitted by the Board of Police Commissioners be and it hereby is approved; and be it FURTHER RESOLVED, that the Supervisor be authorized to countersign the copy of the resolutions adopted by the Board of Police Commissioners on November 2, 1940, to be submitted to the Civil Service Commission of the State of New York. The Supervisor informed the Board that because of the unusually large registration of voters for the General Election On November 5, 1940 it had been necessary for the Town to rent three additional voting machines at a cost of $125.00 per machine, this rental charge to be apploed toward the purchase price of the election inspectors of the unincorporated section had only two days of registration and were required to spend an additional day copying the names of voters in the registers, he recommend that they be paid for the additional that all Election inspecors and poll clerks who served on election day be compensated for the additional three hours they were required to serve on account of the extension of the hours of voting to 9p.m. He stated that the total expense would be approximately $1,100 and requested the approval of the Board for the expenditure of this amount. On motion by Councilman Mandeville, seconded by Councilman Bates, it was upon roll call unanimously RESOLVED, that the above expenditures in connection with the General Election held November 5, 1940, be and they hereby are approved; and be it FURTHER RESOLVED, that the Supervisor be authorized to pay these claims out of surplus funds. The Board then considered the birds received on October 2, 1940 on a new 5-ton truck for the Highway Department Councilman Maginnis pointed out that there was no provision in the 1940 highway budget for the purchase of a truck and recommend that if a truck were needed an amount should be included in the 1941 budget and the truck purchased at the first of the year Councilman Mandeville stated that if there should be a heavy snow before the first of the year, the Highway Department would be handicapped by not having the new truck. He recommend the purchase of either the Brockway truck or the Mack truck After further discussion, on motion by Councilman Rates, seconded by CouncilTflan Griffin, it was unanimously RESOLVED, that the bid of the Brockway Motor Company, Inc . , for a five-ton truck, in the amount of $2,852.00 be and it hereby is accepted and the contract awarded to said Brockway Motor Company, Inc . , payrrnent to be made after January 1, 1941 and the purchase price to be included in the 1941 budget , The following monthly reports for October, 194O were received and filed: 1)Plumbing Inspector's report; 2) Report of the Building Inspector, (3) Report of the Receiver of Taxes . The report of the Department of Health of Westchester County for the month of September, 1940 was received and filed. At 10:10 P.M. the Board unanimously resolved to adjourn Deputy Town Clerk
