TOWN OF MAMARONECK, NEW YORK
HELD OCTOBER 10, 1940
At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y.
The meeting was called to order by Supervisor & McCulloch
at 10 :30
Present: Supervisor McCulloch
Councilmen Bates, Griffin, Mandeville, Meginniss
Absent: None
The presence was also noted of the Deputy Town Clerk, the
Town Clerk and the Town Attorney.
The Board considered the postponement of the re-sale of the
tax liens purchased at the tax lien sale held May 22, 1940, on which
there are unpaid balances due, which re-sale had been authorized for
November 12, 1940.
On motion by Councilmian Bates, seconded by Councilman Griffin, it was
RESOLVED, that the resolution adopted by this
Board on October 2, 1940, authorizing the Super-
visor to re-sell on November 12, 1940, the tax
liens purchased at the tax lien. sale held May 22,
1940, on which there are unpaid balances due, be
and it hereby is rescinded; and be it
FURTHER RESOLVED, that the re-sale of these tax
liens be held on December 11, 1940, and that a
_ notice of such re-sale be published in "The Daily
Times'' on November 20, November 27 and December 4,
1940

A vote taken on the foregoing resolution resulted. as

NOT VOTING° Councilman Mandeville
Councilman Mandeville asked to be excused from voting because
of his interest in one of the pieces of property on which the 1940 tax
lien is unpaid.
Supervisor McCulloch informed the Board that at the last
meeting of the Board. of Supervisors a resolution had beer, received
from the City Council of ; New Rochelle urging Westchester County to
request Federal funds in order to build the Pelham-Port Chester
Parkway as a truck highway, and that upon his motion the request had
been tabled. He stated, however, that Mr. Haight of the Westchester
County Park Department had informed him that the Federal government is
considering the construction of the parkway as a military highway. He
suggested that since the construction of this parkway and its use as a
truck highway would greatly affect residential sections of the torn,
the Board adont a resolution urging the use of this road as a part as
if it is constructed, except in case of war or other emergency and send
copies of the resolution to the County Park's Cormiission, the County
Executive and Congressman Gamble ,
The follovring preamble and resolution was moved by Councilman
Mandeville and seconded. by Councilman Bates :
WHEREAS, information has reached this Board that the
Federal Government is considering the construction of
a military road along the route of the proposed Pelham.
Port Chester Parkway, which runs in part through the
Town of Mamaroneck; and
WHEREAS, the Federal Government, if such military
road is built, will in all probability, contact the
County of Westchester and its officials in connection
with the use or acquisition of the land already ac-
quired by the County of Westchester for the proposed
Pelham-Port Chester Parkmay; and
WHEREAS, such land as has been acquired by the County
of Westchester for the proposed Pelham-Port Chester
Parkway and particularly the lard acquired in the Town
of Mamaroneck, has been so acquired for the purpose of
constructing and operating a parkway; and
WHEREAS, heretofore plans have been proposed for the
construction of a Federal road for the operation of
trucks and military vehicles; and
WHEREAS, much opposition exists among the residents
of the Tovn, to the use of this road for any purpose
other than for a parkway.
NOW, THEREFORE, BE IT
RESOLVED that this Board indicate to the Park
COmmission, its opposition to the proposed military
road unless the Park Commission or County of tilest-
chester restrict and limit the use of such road under
normal circumstances, to parkway purposes, and allow
the use for purposes other than a parkway, only in
case of war or other emergency
A vote being taken upon this resolution resulted as follows :

Councilman Meginniss informed the Board that he had been
receiving complaints from property owners residing adjacent to and
near a house at the corner of Murray Avenue and Emerson Place, on
which certain alterations are being made . He stated that the neigh-
bors are fearful that the owner is planning to use the house as a three-
family house and is constructing a varage under the existing front
porch for his ice trucks . He explained that Building inspector
Cowham Lad indicated on the building permit that the premises can be
used only as a one-family house and that no trucks can be kept on the
premises .
Mr . Meginniss expressed the opinion that the construction
of a garage under the porch is the extension of a non-conforming use
and is a, clear violation of the zoning ordinance, and that Mr. A.
Stirling Smith, Chairman of the Board. of Appeals, concurred in this
opinion.
Town Attorney Delius informed the Board that up to that time,
in his opinion, there had been no violation of the zoning ordinance as
far as the use was concerned. He called attention to the fact that
the permit had been granted for alterations to be made on a one-family
house and that the storing of trucks in a one-family house would be
stopped if an attempt is made to use the garage for that purpose .
The Town Clerk reported that unusually heavy registration ,
in the Third and Ninth Election Districts would unreasonably crowd
the polling places already designated in those districts and recommended
that the polling places for those districts be changed as follows :
THIRD DISTRICT: From the Town Hall, Prospect Avenue,
Hamaroneck, to Mamaro Fire House, Palmer Avenue,
Mamaroneck.
NINTH DISTRICT: From 1967A Palmer Avenue, Larchmcnt,
to 1953 Palmer Avenue, Larchmont,
On motion by Councilman Mandeville, seconded by Councilman
Bates , it was unanimously
RESOLVED, that the polling place for the Third
Election District be changed from Town Hall,
Prospect Avenue, Mamaroneck, to Mamaro Fire House,
Palmer Avenue, hamaronech, and that the polling
place of the Ninth Election District be changed
from 1967A Palmer Avenue, Larchmont, to 1953 Palmer
Avenue, Larchmont ; and be it
FURTHER. RESOLVED, that the Town Clerk give notice
to each registered voter in the Third and Ninth
Election Districts pursuant to Section 66 of the
Election Law, at least five days before Election
Day.
At 12 noon the Board unanimously resolved to adjourn.
