TOWN OF MAMARONECK, NEW YORK
HELD OCTOBER 2, 1940
At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y.
The meeting was called to order by Supervisor McCulloch at
8 P. M.
Present: Supervisor McCulloch
Councilmen Bates, Griffin, Mandeville, Meginniss
Absent: None
The presence was also noted of Deputy Town Clerk, To7rn
Attorney Delius and Assessor Smith.
The Supervisor stated that sealed proposals had been re-
ceived from six different companies for furnishing one new 5-ton truck
for the Highway Department in accordance with the specifications pre-
pared by Town Engineer Foote.
He thereupon opened the bids which were as follows :

After discussion the Board decided to postpone awarding the
bid until further consideration had been given to the proposals .
Councilman Bates reported progress on the Oxford Road drain
W. P. A. project.
Councilman Griffin presented the Public Welfare Department
report for the month of September, 1940, and pointed out that the case
load for September this year was 279 as against 340 for September
last year; that the number of individuals was 1132 this year and 1451
last year; that the amount expended for September this year was $11, 511. 57
as against $15,056.48 last year; and that the average cost per individual
per day , was $.36 this year and $.37 last year.
Councilman Griffin reported that the Park Department was
doing their usual work and that the machine that they had purchased
to assist in the tree work had resulted in a savings in labor of
approximately eighty per cent .
Councilman Griffin presented three petitions dated October 2,
1040 from the Assessor for the correction of the assessment roll So as
to permit the apportionment of taxes .
On motion by Councilman Griffin, seconded by Councilman
Mandeville, the following resolution was unanimously adopted:
WHEREAS, the Assessor has presented petitions
for the correction of tre assessment rolls for
the years 1939 and 1940, taxes of 1940 and 1941,
pursuant to the provisions of Section 33 of
Chapter 105 of the Laws of 19165 as amended, known
as the Westchester County Tax Act; and
WHEREAS, after due consideration this Board finds
it desirable to grant said petitions for the
correction of said assessment rolls;
be corrected as follows, in accordance with the
provisions of Section 33 :

Councilman Meginniss informed the Board that the auditors
for the year 1940 had not yet been appointe& He recommended the
re-appointment of the firm of Glick-Freedman of New Rochelle ®
On motion by Councilman Meginniss, seconded by Councilman

RESOLVED, that Messrs . Glick-Freedman, certified
public accountants of New Rochelle, Vew York, be
and they hereby are appointed auditors of the Towvvn
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll for
the year
1939, school taxes of 1940, and the assessment roll
for the year 1940, taxes of 1941, which shows pro-
perty now appearing on the roll as follows :

Councilman Meginniss informed the Board that the auditors

stipulated in the 1940 budget , namely, $1,000 .
Town Attorney Delius reported on the request of Mr. C . De
Witt Rogers that certain taxes amounting to $32 ,62 which had been
paid in error on property known as Section S. Block 21, Lots 14 and
15, be refunded to his client, Myra S . de Liebing, who owns Lots 16
and 17 adjoining this property. He explained that it had been a
voluntary payment of the taxes and the town therefore could not refund
the amount, but that there might be a possibility that the owner of
Lots 14 and 15 would be willing to reimburse Myra S . de Liebing for
the taxes paid. The Town Board directed the Town Attorney to call the
situation to the attention of the owner of Lots 14 and 15 .
The Town Attorney discussed informally with the Board the
possible settlement of four certiorari proceedings against the 1939
assessment instituted by certain property owners on Premium Point
all of whom are represented by E. Stanley Harks, attorney. After
a lengthy discussion the Board decided not to settle these certiorari
proceedings .
The Supervisor reported that a number of persons who had
purchased tax liens at the tax lien sale held May 22, 1940, and
had deposited twenty-five per cent of the amount of the lien, had not
yet paid the balance of the lien which was to have been paid within
ten days after the sale . He recommended the re-sale of these tax
liens on November 12, 1940.
On motion by Councilman Bates , seconded. by Councilman
Griffin, it was unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized, empowered and directed to re-sell
all tax liens purchased by individuals at the tax
sale held May 22, 1940, on which there are unpaid
balance, the date of sale to be November 12, 19405
and be it
FURTHER RESOLVED, that notice of the re-sale of these
tax liens be advertised in "The Daily Times" , the
official newspaper, on October 22, October 29, and
November 5, 1940 .
Councilman Meginn iss called to the attention of the Board
the necessity of collecting back taxes and suggested that some
definite plan be adopted by the Board to facilitate the settlement
of tax arrears .
A letter dated October 2, 1940, was received from William
Oosterhuis, Receiver of The First National Bank and Trust Company of
Mamaroneck, New York, requesting permission to pay the 1938 and 1939
taxes against property known as Section 9, Block 34, and Section 9,
Block 33, Lots 1, 2, 3, 4 and 5, at the face amount of the tax.
On motion by Councilman Mandeville, seconded by Councilman
Bates, it was upon roll call unanimously
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, empowered and directed
to accept payment of the following taxes on the follow-
ing described property at the face amount of the tax,
provided payment is made within sixty days :
