HomeMy WebLinkAbout1940_09_25 Town Board Minutes N SPECIAL MEETING OF THE TOWN BOARD TOWN OF MAMARONECK, NEW YORK HELD SEPTEMBER 25, 1940 At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y. 8 P. M. The meeting was called to order by Supervisor McCulloch at Present: Supervisor McCulloch Councilmen Bates, Griffin, Mandeville Meginniss Absent: None The presence was also noted of Town Clerk Payne, Deputy Tovn Clerk Alice E. Wheelock, Town Attorney Delius , Assessor Smith, Town Engineer Foote and Comptroller Luceno. The minutes of the meetings of August 20, August 21 and September 4, 1940, were approved as presented. Councilman Mandeville reported that the work of the High- way Department was running smoothly. He suggested that when the Superintendent of Highways operates the snow plow on the Boston Post Road, rather than merely driving through the Village of Larchmont on the way to Dillon Park, he be authorized to plow the portion of the Boston Post Road which is within the incorporated village of Larchmont . After discussion it was agreed that this should be done . Councilman Bates reported that a lot of rock had been en- countered on the Oxford Road drain project . Councilman Griffin presented the Public Welfare Depart- - ment report for the month of August, 1940, which showed an improve- ment over the report for August, 1939. He reported that the total case load in August this year was 267 as against 320 last year and that the total amount of money expended this year was 110,627 .83 as against $13, 537 .14 last year during August. Mr . Griffin presented a letter dated September 13, 1940, from Public Welfare Officer DeVinne informing the Board. that IViiss Elizabeth Puglisi had resigned on September 15, 1940, as case worker in the Welfare Department and that Mrs . Catherine Gaul had been accepted to fill this vacancy for the remainder of the year . On motion by Councilman Griffin, seconded by Councilman Bates, it was unanimously, upon roll call, RESOLVED, that the resignation of Miss Elizabeth Puglisi as case worker in the Public Welfare Office as of September 15, 1940, be and it hereby is accepted with regret; and be it FURTHER RESOLVED, that Mrs . Catherine Gaul is hereby appointed as case worher in the Public Welfare Office to fill the vacancy created by the resignation of Miss Elizabeth Puglisi, at a salary not to exceed $1,200 per annum, the appointment to take effect October 1, 1940 and to be at the pleasure of the Town Board. Councilman Griffin presented six petitions dated Septem- ber 25, 1940, received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes . On motion by Councilman Griffin, seconded by Councilman Mandeville, the following 'resolution was upon roll call unanimously adopted: WHEREAS, the Assessor has presented petitions dated September 25, 1940, for the correction of the assessment roll for the year 1939, taxes of 1940, pursuant to the provisions of Section 33 of Chapter 105 of the. Laws of 1916, as amended., known as the Westchester County Tax Act; and WHEREAS, after due consideration this Board finds it desirable to grant said petitions for the correction of said assessment roll; NOW, THEREFORE, BE IT — RESOLVED, that the assessment roll for the year 1939, taxes of 1940, which shows property now appearing on the roll as follows : FURTHER RESOLVED, that the assessment roll for the year 1939, taxes of 1940, which shows property now appearing on the roll as follows : Section Bloch_ Lot Owner Land Imp. He also presented a report of the Highway Fund as of September 10, 1940 and of N. P. A. projects . The reports were ordered filed. Chief Wm. V. McCarthy of the Fire Department addressed. the Board concerning the appointment of two probationary drivers which will be required when the new apparatus is delivered. He reported that the Fire Council had held another meeting and had asked him- to inform the Board that the same two men, Mr. Louis Testa and Mr . Earl Mellor, were their choices for the positions . Plignarri $1,800 $1,800 (609-343) 6 40 28 Hillandale Investors 500 500 (609-22p1) Corp Councilman Meginniss explained that there was $600 available in the 1940 Fire Department budget for the payment of the salaries of these two men and suggested that they be appointed for the probationary period of three months at a rate of salary not to exceed $600 . He reported that a defect had been discovered in the ladders of the new aerial ladder truck and that it had been returned to Elmira for repairs . On motion by Councilman Ideginniss, seconded by Councilman Bates, it was RESOLVED, that upon the recommendation of the entire Fire Council, Louis Testa and Earl Mellor be and they hereby are appointed paid drivers of the Fire Department for a probationary period of three months at a rate of salary for the balance of the year 1940 not to exceed $600 available in the 1940 Fire Department budget, the date on which the probationary period is to commence to be left to the discretion of the Fire Chief. The Supervisor asked if the members of the Board wished to mane any comrients . Councilman Mandeville stated that he was opposed to the appointment of volunteer firemen to paid positions and that in his opinion the appointment of these two men would not make harmony in the derartrnent . He stated that these two men had not been the unanimous choice of the Fire Council. Councilman Meginniss explained that the qualifications of all applicants are studied very carefully by the Fire Council and that the two men recommended by the Fire Council had been chosen on their merits . Surervisor McCulloch asked Chief McCarthy whether or not there were any members of the Fire Council who were opposed to the selection of these two men. Chief McCarthy stated that he did not think so because they had not stated so . Councilman Mandeville moved and Councilman Griffin seconded the follovving resolution. follows : RESOLVED, that the matter of appointing two paid drivers in the Fire Department be laid over until the next meeting of the Board. A vote taken on the foregoing resolution resulted as AYES: Councilmen ilandeville and Griffin NOES: Supervisor. McCulloch and Councilmen Bates and Meginniss A vote taken on the resolution introduced by Councilman Meginniss and seconded by Councilman Bates, appointing Louis Testa and Earl DIellor as paid drivers of the Fire Department for a pro- bationary period of three months resulted as follows : AYES: Supervisor McCulloch Councilmen Bates and ileginniss NOES: Councilmen Mandeville and Griffin The resolution was declared carried. The Supervisor asked if there wras any one present who wished to address the Board. Dr. William H. Mills, Chairman of the Adult Activities and Recreation Council Of the Town of Mamaroneck, requested the Board to furnish the Recreation Council with additional supplies for recreation work at a cost of $250 including materials for Christmas toy work. The Supervisor informed. Dr . Hills that when the Town Board had appropriated a flxed amount in the 1940 budget for recreation, it was tie it understanding that it would be sufficient for the Re- creation Councilas needs during the entire year . Dr. Hills explained that the amount appropriated in the budget took care of supplies up until this spring. He asserted that the recreation budget is "extremely small and that the work is be- coming twice as difficult. Councilman Meginniss pointed out that the town budget is for the calendar year and the Recreation Council should budget their needs for that period. He stated that it was his understanding that the school budget had an appropriation for recreation work and asked Dr . Mills vahy that could not be used. Dr . Iaills explained that $3,000 had been appropriated by the Board of Education to carry on recreation work if and when the W.P.A. ceased. On motion by Councilman Mandeville, seconded by Council- man Bates, it was RESOLVED, that the Supervisor be and he hereby is authorized to appropriate out of surplus funds the amount of 250 for the purpose of purchasing materials and supplies for recreation work in the Town of Mamaroneck, this amount to include the materials necessary for the Christmas toy work. A vote taken on the foregoing resolution resulted as AYES: Supervisor McCulloch Councilmen Bates, Griffin, Mandeville NOES: Councilman Meginniss The Supervisor explained that without this additional appropriation recreation work in the town would have to stop and he was therefore in favor of granting the request . Councilman Meginniss stated that he was heartily in favor of recreation work and would be glad to contribute personally to a fund to purchase materials , but since there are no further. funds available in the 1940 budget for recreation work, he was com- pelled to vote against the resolution. to-wit: The following resolution was offered, moved and seconded, WHEREAS, pursuant to the resolution passed by this Board on August 21, 1940, $56,250 Incinerator Bonds of the Town of Mamaroneck have been duly advertised for sale or notice published in The Daily Times , the official newspaper of said Town, sealed proposals to be received by the Town Supervisor at 10 o'clock A.M. Eastern Standard Time (11 o'clock A.M. ➢Il. Daylight Saving Time) , on the 12th day of September, 1940; and WHEREAS, at the time and place fixed for the receipt of bids, the following bids were received for said bonds : WFEREAS, the highest and best bid complying viith the terms of sale, at such lowest rate of interest, was the bid of First National Bank of Mount Vernon, N. Y. who offered to purchase said bards at said rate of interest and to pay therefor par value, accrued interest and a premium of S None, and WHEREAS, the Town Supervisor, pursuant to the pro- visions of said resolution, has awarded said $56,250 Incinerator Bonds, bearing interest at the rate of 1.75 per centum per annum, to the said First National Bank of Mount Vernon, N. Y. at the price aforesaid; NOW THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Mamaroneck, that said award of said $56,250 Incinerator Bonds be and the same is hereby in all respects ratified, ap- proved and confirmed, FURTHER RESOLVED, that all proceedings of the Town Board of said Tovin authorizing the issuance and sale of said bonds be and the same are hereby ratified, approved and confirmed. RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMRONECK IN THE COUNTY OF' WESTCHESTER, NEW YORK, as follows : Section 1. The sum of $8,850 is hereby appropriated to Day the portion to be borne by the Town of public improvement work relief projects in the Town undertaken through or by the authority of the Works Progress Ad- ministration of the federal government, or other work relief authority of the federal government, including the cost of furnishing labor, materials, supplies and equipment for such projects and incidental expenses in connection therewith, the said public improvement work relief projects to include only projects having a, period of probable usefulness of at least five (5) years, computed from October 1, 1940, the date of adoption of this resolution and no indebtedness , whether temporary or permanent, has been incurred prior to said date to finance any portion of the cost thereof . To meet said appropriation, bonds of the Town in an aggregate principal amount not exceeding $8,850 shall be issued. Section 2 . Said. bonds shall be dated. April 1, 1941, shall mature in annual installments of principal, shall bear interest at a rate not exceeding six per centum (6%) per annum, payable semi-annually on the first days of April and October in each ,year, shall be numbered, shall be in such form and of such denomination, shall be payable at such place or places , in such specie or other currency, and shall be sold at public sale in such manner and on such terms, but for not less than their par value, as shall hereafter be determined by subsequent resolution or resolutions of this Board. Section 3 . Resolutions entitled: "Resolution appropriating the sum of $5,500 to pay a portion of the cost of public improvement work relief projects in the Town and authorizing the issuance of $5, 500 bonds of the Town of Mamaroneck for said purpose" , adopted. June 19, 1940, and "Resolution appropriating the sum of $3,350 to pay a portion of the cost of public improvement work relief projects in the Town and authorizing the issuance of $3,350 bonds of the Town of Mamaroneck for said purpose" , adopted Septem- ber 4, 1940, are hereby repealed, rescinded and revoked to the extent of the appropriations and authorizations herein contained, except that nothing herein contained shall be construed to affect the validity of any ob- ligations issued in anticipation of the bonds author- ized by said resolutions . Section 5 . This resolution shall take effect immediately. On motion of Councilman Mandeville, seconded by Councilman Griffin, the foregoing resolution was adopted by the following vote: ALES: Supervisor McCulloch Councilmen Bates, Griffin, Mandeville, Meginniss NOES: None Councilman Mandeville introduced the following preamble and resolution: WHEREAS, a resolution entitled: priating the sum of $82850 to pay portion of the cost of public improvement work in the Tom and authorizing the bonds of the Town of Mamaroneck adopted September 25, 1940, has Nova, therefore, be it "Resolution appro- iy a portion of the relief projects issuance of QP8,850 for said purpose", become effective . 05 RESOLVED BY TIE TOWN BOARD OF THE TOWN OF MAMARONECK, IN THE COUNTY OF WESTCHESTER, NEW YORK, as follows : Section 1. For the purpose of temporarily financing the cost of permanent improvements provided for in said resolution, in anticipation of the issuance of bonds, the Supervisor is hereby authorized to issue a Certificate of Indebtedness of the Town of Mamaroneck in an aggregate principal amount not exceeding $8,850 ® Said Certificate shall be designated "Works Project Certificate of Indebtedness" . Section 2m The following matters in connection with said Certificate are hereby determined: Date : October 1, 1940 Maturity: April 1, 1941 Denomination: $8,850 Number: W. P. A. 18 Form: Substantially in accordance with resolution adopted October 4, 1939. Place of Payment: The County Trust Company, Mamaroneck, N. Y The Supervisor is hereby authorized to determine all matters in connection with said Certificate of In- debtedness, the determination of which is not provided for by this or subsequent resolutions, and his sig- nature upon said Certificate shall be conclusive as to such determinations . Said Certificate shall be signed by the Supervisor, shall have the corporate seal of the Town affixed thereto and attested by the Torun Clerk, The Supervisor is hereby authorized to sell said Certificate at public sale or private sale at not less than par and to fix the interest rate thereof at not exceeding six per centum (6%) per annum, and to deliver same to the purchaser upon re- ceipt of the purchase price, plus accrued interest from the date of the Certificate to the date of delivery. Section 3 . kny instrument issued pursuant to this resolution shall be a general obligation of the Town of Mamaroneck, and the faith and credit of the To,am are hereby pledged for the punctual payment of the prin- cipal of and interest on said obligation, and unless otherwise paid or payment provided for, a tax sufficient to provide for the payment thereof shall be levied and collected. Section 4. This resolution shall take effect immediately. On notion of Councilman Mandeville, seconded by Council- man Griffin, the foregoing resolution was adopted by the following vote : AYES : Supervisor McCulloch Councilmen Bates, Griffin, Mandeville, Meginniss NOES: None Town Attorney Delius reported that the Town had completed foreclosure proceedings on property described as Section 1, Block 51, Lots 7, 10, 11, 12, 13, 14, 16, 17, 18 and 19, formerly owned by isilliams realty Company and on property known as Section 1, Block 80, Lots 1, 2, 3 , 4, 5, 9 10, 11, 12 and 13 , formerly owned by 'uigi Leone . He recommended that the Town Board cancel the taxes on this property. On motion by Councilman Mandeville, seconded by Council- man Griffin, the following resolution was upon roll call unanimously adopted: #+ 4 WHEREAS, in foreclosure proceedings instituted by Town against the Williams Realty Company, et al. , the referee, duly appointed for that purpose by, order of the Supreme Court, sold to the Town of Mamaroneck, property described as Section 1, Block 51, Lots 7, 105 11, 12, 13, 14, 16, 17, 18, and 19, on the Assessment Map of the Town of Mamaroneck; and WHEREAS, the said referee has applied to the payment of certain taxes, assessments and tax liens owned - by and due to the Town of Mamaroneck, together with interest and penalties thereon to the date of sale, the sum of $2, 576 .34 which taxes, assessments and tax -- liens are required to be cancelled by the provisions of Section 54 of the Westchester County Tax Act, NOW, THEREFORE, BE IT RESOLVED that the following taxes, assessments and tax liens are hereby cancelled: Section 1. The Town Attorney stated that he recommended the settlement of the certiorari proceedings instituted by William J. Forbes, to review the assessment upon a parcel of property in the Town of Mamaroneck known as Section 2, Block 8-aa, Lot 161, on the basis of a reduction in the assessment from $26, 500 to $25,000. Councilman Mandeville introduced the following resolution, which was seconded by Councilman Griffin: WHEREAS, heretofore and on or about the 29th day of September, 1939, a writ of certiorari was obtained by William J. Forbes, owner of Section 2, Block 8-aa, Lot 161, to review the assessment for the year 1939 upon premises owned by him; and WHEREAS, a return to such writ was duly fired by the Assessor and Board of Review on or about the 15th day of November, 1939, and no further proceedings having been taken; and WHEREAS, the Town Attorney and Assessor recommend to this Board that the proceedings be settled and dis- continued upon the reduction of the assessment from $26,500 to $25,000; NOW, THEREFORE, BE IT RESOLVED that the assessment for the year 1939 upon property known as Section 2, Block 8-aa, Lot 161, be reduced to $25,000, provided the certiorari pro- ceeding nova pending in the name of William J. Forbes, be discontinued without costs to the Town of Mamaroneck. FURTHER RESOLVED that the Town Attorney is hereby authorized and directed to sign the necessary stipula- tion to obtain an order of the Supreme Court providing for such reduction and refund of any excess taxes paid. FURTHEP RESOLVED, that if certiorari proceedings are brought to revievv the assessment for the year 1940, the Town attorney is hereby authorized and. directed to sign the necessary stipulations to obtain an order of the Court providing for the reduction of such assessment to $38,000, provided such proceedings are discontinued. The foregoing resolution was adopted by the following vote : AYES: Supervisor MicCulloch Councilmen Bates, Griffin, Idandeville, Meginniss NOES : None A letter dated September 13, 1940, was received from Mr. Joseph Pittera, 30 Lester Place, Larchmont, New York, requesting the Town Board to arrange to take title to Williams Place and Lester Place and to repair these streets before vainter. After discussion the letter was ordered filed. A letter dated September 24 , 1940, was received from the Village of Mamaroneck , enclosing a copy of a letter from Mr. John Greiner, 1438 East Boston Post Road, Mamaroneck, in which he commended the Town and Village police forces for their cooperation in apprehending burglars who had robbed his restaurant. The Supervisor was directed to forward the letter from Mr . Greiner to the Board of Police Commissioners of the Town and to commend. the Weaver Street Police force for their excellent work. A letter dated September 17, 1940, was received from C . Devitt Rogers, attorney, representing Myra S . de Liebing, requesting the Town Board to refund the 1939 school tales and the 1940 state, county and town taxes paid in error on Section S, Block 21, Lots 14 and 15, and amounting to $32 .62. The matter was referred to Town Attorney Delius for investigation. A letter dated September 30, 1940, was received from Peter F. Kane, Jr . , 21 Oak Avenue, Larchmont, requesting permission to pay certain tai, liens for the year 1938, 1939 and 1940 on property described as Section 7, Block 17, Lot lA at the face amount of the lien. On motion by Councilman Bates , seconded by Councilman Ileginniss, it was unanimously RESOLVED, that the application of Peter F. Slane, Jr. , be and it hereby is denied. A letter has received from Mrs . Margaret A. Merola, 218 High- view Street, Mamaroneck, requesting permission to pay certain Lax liens for the years 1932 to 1940 on property described as Section S. Block 53, Lot 23, at the face amount of the lien. On motion by Councilman Bates , seconded by Councilman Griffin, it was unanimously RESOLVED, that the application of Mrs. Margaret A. Merola be and. it hereby is denied. The question of the real estate signs of Gerald J . Campbell in the Waple Lulls Section was discussed and the Supervisor was in- structed to write to Parr . Campbell and ask him to comply with the under- standing reached at a previous meeting of the Town Board by removing tree name of Edward B. Fernschild from the signs . Town Engineer Foote presented revised plans for the proposed. v,). P. A. project covering the construction of a bridge over the Sheldrake River at Bonnie Briar Lane . On motion by Councilman Mandeviile, seconded. by Councilman Meginniss, it was upon roil call, unanimously ( the Supervisor not voting) , RESOLVED, that the Supervisor be and he hereby is authorized and directed to sign the following W.P.A. projects Bonnie Briar Lane Bridge Total estimated cost $27,085.00 Total estimated Federal contribution 16,693.00 Total estimated sponsor's contribution 10,392.00 Approximate cost to Town 7,800.00 FURTIR RESOLVED, that the project be submitted to the Federal government and if and dien it receives the approval of the Federal government, it be re- submitted to the Town Board for final action before work is started. Totivn Engineer Foote presented a rough estimate of the sponsor ' s contribution for a W. P . A. project covering the drainage, grading, curbing and paving for Holly Place, Hudson Place and Crest Avenue in Colonial Park and Harrison Drive . Or, motion by Councilman Griffin, seconded by Councilman Mandeville, it was unanimously RESOLVED, that the Town Engineer be authorized to prepare a W.P.A. project proposal for this work and to submit it to the Town Board for consideration. The following monthly reports were received and filed: (1) Report of the Building Inspector for the month of August, 1960; (2) Report of the Mamaroneck Health Center for the month of August, 1940. The Board thereupon went into executive session to discuss the law suit brought by Mrs . Lillian Caffall, 44 Valley Road, Larch- mont, against the Town of Mamaroneck for $1,000 for alleged damages sustained on the sidewalk near her home . On motion by Councilman; Mandeville, seconded by Councilman Qeginniss , the following resolution was adopted by the following vote: RESOLVED, that the Town Attorney be and he hereby is empowered to attempt to settle the suit for $100 and if unable to do so to defend the case .
