HomeMy WebLinkAbout2019_11_20 Town Board Minutes November 20, 2019 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON NOVBEMBER 20, 2019, BEGINNING AT 5:00PM IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. King ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator Connie Green O’Donnell, Assistant Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION Additionally Present: Lindsey Luft On motion of Sabrina Fiddelman, seconded by Jaine Elkind Eney, the Work Session was unanimously opened at 5:00PM. Community Solar Project Additionally Present: Frank Owen Mr. Altieri began by summarizing that the Town has been negotiating an agreement for a community solar program for over a year. The Town Board reviewed a confidential memo from Mr. Altieri outlining the proposed plan and reviewing the key terms and conditions. The Town Board continues to struggle with the benefits versus the risks. The Town Board asked that an expert review the final agreement prior to the Town Board making a final decision. Mechanical Rock Removal Law Additionally Present: Rich Polcari Building Inspector and a number of residents of Colonial Avenue concerned about rock removal. Mr. Maker reviewed the drafted amendments. Councilman King asked that consideration be made with respect to bench marks for dust mitigation. Mr. Polcari will do additional research on dust mitigation. The Town Board discussed the need for a protocol to survey neighboring properties prior to rock removal. The Town Board will send this draft to the Land Use Boards. Mr. Polari added that the Planning Board has already seen a number of these amendments. Mr. Maker will work on a new draft incorporating what was discussed this evening and have it for the Town Board to review at the next worksession. Proposed 2020 Sewer District Rent Rate There was no discussion. The Town Board is prepared to set the public hearing. Comprehensive Plan The Town Board previously received a draft of the consultant’s scope of work. The Town Board stated that the document is not policy oriented, and not what the Town Board had asked for. Supervisor Seligson will let the consultant know of the Town Boards displeasure with the document. The Town Board is continuing to formulate the Steering Committee. On motion of Councilwoman Katz, seconded by Councilman King, the Board unanimously agreed to enter an Executive Session to discuss appointments to the Comprehensive Plan Steering Committee. 1 November 20, 2019 EXECUTIVE SESSION Appointments to the Comprehensive Plan Steering Committee On motion of Councilwoman Fiddelman, seconded by Councilman King, the Board unanimously agreed to resume the Regular Meeting. Presentation – Community Counseling Center (CCC) Additionally Present: Dr. Mark Levy Executive Director of the CCC and Pam Buchmueller Board Member. Dr. Levy was asked to update the Town Board on any new initiatives. Dr. Levy spoke of their involvement with RADAR in addressing the vaping issue. The CCC is always developing new parenting programs and is working on a more involved social media presence. Dr. Levy spoke of the loss of a significant private funding source, and that currently they have the largest deficit they have experienced in years. The CCC has not asked the Town for an increase in funding in six years and is now seeking an increase from all three municipalities. New Business The Town Board revisited the topic of whether to adjust the parking permits from a fiscal calendar to an annual calendar in order to conform with the Towns budgeting calendar. The Town Board asked for the current schedule of parking permit fees and an analysis of other municipalities, as well as input from the Town Comptroller on the fiscal implications, to be discussed at the next worksession. Councilwoman Elkind Eney reported that the controversial legislation affecting Fire Departments has not gone to the Governor's desk yet for signature. The Fire Department is working with State Senator Shelley Mayer and State Assemblyman Steve Otis on modifying the location of the emergency vehicle turnaround in I95. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:30 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents are welcome to attend. SUPERVISOR’S SUMMARY REPORT The Town Board and staff have continued to work on the Tentative Budget. We held a budget meeting last night to review the Highway and Building Departmental as well as the proposed th capital budget. The budget public hearing is scheduled for Wednesday, December 4, our next TB meeting, at 8:00 pm. th The “Love Your Food” program was launched on Saturday, November 16 at the Larchmont Farmers Market with food and fun in the frigid cold. The Love Your Food program is an outreach campaign to educate residents about reducing wasted food through better buying, sharing, eating and composting of food. Please visit the Love Your Food NY website. It is beautiful, fun and informative. There will be programs in schools for students, information in newsletters and websites. The semi-annual Town newsletter will be mailed to residents in the next week and there is an insert regarding the Love Your Food campaign. The Town Board heard from residents recently about the need to amend the rock removal law in the Town. We began working on changes to protect neighboring residents immediately. We reviewed a draft law in our work session prior to this regular TB session and are happy to move forward with setting a public hearing for the change in law. I met with the mayors of the Villages of Larchmont and Mamaroneck as well as the Director of the CRC, Jirandy Martinez, to coordinate efforts for the upcoming 2020 Census update. The count 2 November 20, 2019 update starts March 2020 and will run until July 2020. We look forward to a robust complete count in our community. Thank you to the Village of Larchmont for giving the Town their gazebo from Constitution Park. The Village is doing a wholesale renovation of Constitution Park and had no place for the gazebo. The Town quickly found a lovely home for it in Memorial Park. PRESENTATION – LMCTV Matt Sullivan Executive Director of LMCTV gave a PowerPoint presentation titled Building Community Through Media. He shared the podium with Mike Witsch an LMCTV Board Member. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board. Kevin Crowe, of the Larchmont Gardens Civic Association addressed the Town Board. Mr. Crowe th announced the upcoming community gathering and tree lighting on December 14 at 4:00 pm. Michael Katz, a resident of Larchmont Acres addressed the Town Board. Mr. Katz distributed photos of leaf piles which he believes take up much needed parking spaces along Palmer Avenue. He proposes the Town initiate a rule to bag leaves at the curb. He noted the litter along Boston Post Road near Weaver Street and would like the Town to address that with no littering signs. Mr. Katz addressed the dead end at Burton Road as a public safety issue and suggests a gate be installed. The Town Board addressed these concerns, specifically noting that Burton Road is a private road and the Town has no jurisdiction to install a gate. Supervisor Seligson stated that she herself abhors litter and makes a point of looking at the area on the Post Road that Mr. Katz mentioned. The head of the Highway Department has also looked at the area. There is bound to be some amount of litter with the amount of car and pedestrian traffic in that area. The Town will assess signage. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind Eney, seconded by Commissioner Katz, the Board of Fire Commissioners was unanimously declared open. Other Fire Department Business Commissioner Elkind Eney stated that State Senator, Shelley Mayer and State Assemblyman, Steve Otis met with the Town of Mamaroneck Fire Chiefs to address concerns about pending State legislation and highway access on I95. Commissioner Elkind Eney thanked them both for their time and efforts. There being no further business to come before the Commission, on motion of Commissioner Elkind Eney, seconded by Commissioner Katz, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Authorization – BidNet Direct Web-Based Solicitation and Bidding Services On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the agreement between the Town of Mamaroneck and BidNet to provide web-based solicitation system, providing on- line bidding services, including maintenance and support services, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said Agreement on behalf of the Town. Set Public Hearing – 2020 Sewer District Rent Rate On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, it was unanimously 4 November 20, 2019 RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the 2020 Sewer District Rent Rate for December 4, 2019 at 8:00PM at the Town Center, 740 West Boston Post Road, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said Notice, be posted. 3. Set Public Hearing – Installation of Yield Sign – Country Lane On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the installation of a yield sign at Country Lane for December 4, 2019 at 8:00PM at the Town Center, 740 West Boston Post Road, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said Notice, be posted. 4. REPORT OF COUNCIL The Town Board Members reported on their various activities and meetings since the last Town Board Meeting.
