BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. King ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator Connie Green O’Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the Work Session was unanimously opened at 5:00PM. Additionally present: Steve Lipkin, local Journalist Road Dedication - Highclere Court Additionally Present: Andrew Saines of Highclere Court LLC The Town Board reviewed a memo from the Town Engineer discussing the recommendation to accept Highclere Court as a Town Road. A Town Board member asked for certification of clear title. Mr. Maker will add that verbiage to the resolution. This approval is on the regular agenda for this evening. Discussion - Comprehensive Plan Supervisor Seligson noted that she has an update on the Steering Committee development, that the Board should discuss in executive session. Winged Foot Golf Club Sewer Rent Appeal Connie Green O’Donnell reviewed her previous memo to the Board dated October 8, 2019. Ms. Green- O’Donnell confirmed what was presented in her previous memo, that the Town calculate a refund based on when the local law creating the three year exemption was adopted and the date that Winged Foot Golf Club asked for an exemption. Mr. Altieri will verify the date Winged Foot Golf Club first appealed their sewer rent, and will report back at the next worksession. 2020 Larchmont Mamaroneck Joint Garbage Commission Budget The Town Board reviewed the 2020 Preliminary Commission Budget. Supervisor Seligson noted that at the last Commission meeting there was discussion about major structural changes for allocation of costs and that this could not be completed in time for the Town’s 2020 budget. The next step would be to decide how a study would be done and to consider working with a consultant, paid for by the Commission. Mr. Altieri noted the new Treasurer for the Commission, Irene Glauber. Establishing Effective Dates - Parking Lot Permit The Town Board reviewed a memo from the Town Clerk dated November 1, 2019, revisiting a previous discussion of amending the renewal date of parking lot permits to coincide with the Town’s fiscal budget year. The Town Board is not opposed to making this change, but would like to receive input from the Town Comptroller as to the fiscal impact of such a change. If the Town were to move forward, a seven month 1 November 6, 2019 permit would be issued that would be effective June 1, 2020 and expire on December 31, 2020. Permits would then be sold for a full year effective January 1, 2021 and expiring December 31, 2021. New Business Supervisor Seligson explained that she was contacted by County Executive George Latimer’s Office regarding a request to adopt legislation to end the practice of drag racing on municipal streets. Although the Town Board is sympathetic to the issue, it does not see this as a concern on the streets in the Town. No further action was taken. Supervisor Seligson and Mr. Altieri reported on a recent meeting with residents of Colonial Avenue. The residents are very upset over rock removal and chipping. The outcome of that meeting was a list of possible amendments to the Mechanical Rock Removal Law which the Town Board reviewed. Mr. Maker and Mr. Altieri will prepare draft legislation for review. On motion of Councilwoman Elkind Eney, seconded by Councilman King, the Board unanimously agreed to enter into an Executive Session to discuss appointments to the Comprehensive Plan Steering Committee as well as the employment history of a particular person. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:15 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents are welcome to attend. PUBLIC HEARING – “Parking Prohibited on Certain Sides of Certain Streets at Certain Times” Law. The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, a Public Hearing will be held on November 6, 2019 at 8:00 PM or as soon thereafter as is possible at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider: “Parking Prohibited on Certain Sides of Certain Streets at Certain Times” Law. Purpose The Town Board finds that the proliferation of parked cars in the section of Town that lies within walking distance of the Larchmont Metro-North Train Station has caused congestion on the streets. To establish control to this area of Town, the Town Board enacts this local law that amends the current law to prohibit parking for one hour of each weekday on each side of certain sections of North Chatsworth Avenue and Rockingstone Avenue and on each side of Maple Hill Drive, Mountain Avenue and Overlook Terrace. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK Published: October 23, 2019 On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, the Public Hearing was unanimously opened. The following residents addressed the Town Board: Robert Herbst, 76 North Chatsworth Avenue, stated he was in favor of this legislation. Dane Emery, 34 Mountain, is not in favor of this legislation Dara Gordon, Maple Hill Drive, sees no need for this legislation on Maple Hill Drive. Eileen Jabart, Maple Hill Drive, stated that Emerson should be added to the law. Arthur Katz, 18 Orsini Drive, stated that Maple Hill Drive should be included in the law. Rich Testa, 15 Mountain Avenue, is in favor of this legislation. Jan Northrup, 80 N. Chatsworth Avenue, is in favor of a two tiered parking lot. Steve Carlucci, 85 N. Chatsworth Avenue, asked for ticketing of only non-residents’ cars. Megan McCarthy, 42 N. Chatsworth Avenue, asked for the next steps in adopting this law. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Public Hearing was unanimously closed. On motion of Councilwoman Elkind Eney, seconded by Councilman King, the following Local law was approved: Local Law No. 11 - 2019 This local law shall be known as the “Parking Prohibited on Certain Sides of Certain Streets at Certain Times” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: The Town Board finds that the proliferation of parked cars in the section of Town that lies within walking distance of the Larchmont Metro-North Train Station has caused congestion on the streets. The above resolution was put to a roll call vote: King Aye Fiddelman Aye Elkind Eney Aye Katz Aye Seligson Aye 9 November 6, 2019 SUPERVISOR’S SUMMARY REPORT Congratulations to Councilwoman Abby Katz, Councilman Jeff King, Town Clerk Christina Battalia and Town Justice Jean Marie Brescia on their reelection this past week. Congratulations also to Mayor Tom Murphy, Trustee Nora Lucas and Trustee Kelly Wenstrup on their elections in the Village of Mamaroneck. Finally, congratulations to County Legislator Catherine Parker on her reelection. st The Town’s new plastic bag law will go into effect December 1. The law bans single-use, carryout plastic bags in the Town of Mamaroneck. Dry cleaners will be allowed to offer plastic bags and restaurants will be allowed to provide plastic bags for takeout food. There will be a five cent fee for paper bags. Those people on federal assistance programs will be exempt from the fee. Please remember to bring your reusable bags for shopping. The Town will be distributing some reusable bags to stores and residents may obtain a reusable bag from the Town at the Town Center or Senior Center. Organic trash collection has ended and leaf collection is in motion. The Town has paved Country Club Drive, Ridgeway and the Hilltop neighborhood. Murdock Woods will begin on Friday. If the weather holds we hope to complete the repaving of Fenimore Road as well. There will be a launch of the “Love Your Food” program at the Larchmont Farmers Market th Saturday November 16. “Love Your Food” is an outreach program to help reduce wasted food for which we received a grant from NYS DEC. The effort will stress buying appropriate amounts of food, sharing the food you don’t use and composting the scraps. The Council of Governments, a group of representatives from the County Administration and legislature and members of the Westchester Municipal Officials Association met to discuss County-wide issues and share information. The TMFD Inspection Dinner was a lovely event where the crew and apparatus looked great. The Mamaroneck Historical Society gave a presentation on the restoration of the Delancey Cemetery on Palmer Avenue. The Town helped fund some of the restoration. It is a great improvement. The Town Board held two budget thth meetings; one on Saturday, October 26 and one on Monday, November 4. The next budget th meeting will be on Tuesday, November 19. All budget meetings are open to the public. I had the pleasure of greeting and addressing the second graders of Murray Avenue School on their class trip to learn about their local government. I attended a Con Ed presentation on storm preparedness and they have made great improvements to their storm preparations. I also attended the VLFD Inspection Dinner, another fine event. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board. George Talt, Larchmont Gardens’ Civic Association, addressed the Town Board. Mr. Talt stated that the Association is ever thankful for the Town’s continued support. Mr. Talt noted the successful Halloween Parade, then asked for an update on the sidewalk along E. Hickory Grove Drive. He then announced that th the tree lighting will be held sometime around December 15. George Roniger, Larchmont Gardens’ Civic Association, stated that resident Luke Brussel has initiated a project of planting native plantings along the Brook. Residents have been supporting him and helping to plant as well as removing invasive plants. He is working with the Environmental Planner, Liz Achieson and the Sustainability Collaborative on addressing other areas in Town where native plants can be developed. Commissioner Elkind Eney thanked the Fire Department for another wonderful Inspection Dinner. AFFAIRS OF THE TOWN 1. Road Dedication – Highclere Court On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the following was approved, WHEREAS, the subdivision known as Durham Road Subdivision was approved by Planning Board resolution at its meeting on November 13, 2013, and WHEREAS, construction of new roadway and related sewer infrastructure improvements to Town of Mamaroneck specifications by Highclere Court, LLC was included as a condition for the approval of the subdivision, and WHEREAS, the intention was for Highclere Court, LLC to dedicate said infrastructure to the Town of Mamaroneck upon completion; and WHEREAS, the Town has received such documentation including as-built surveys, subdivision plans, utility plans, public and private easements agreements, Westchester County Board of Health Approval Letters, Homeowner’s Agreement Policies, Inspection Records and Material Certifications, and WHEREAS, the Engineering Department and Highway Department have performed final inspections on all public improvements for Highclere Court and now deem it to be in proper condition for dedication, and WHEREAS, the Town will hold a maintenance bond in the amount of $35,000 for a period of two years in the event that any public improvements should fail during that period. NOW THERFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby accepts dedication of Highclere Court as Town Road, but only if Highclere Court, LLC furnishes the Town (a) with a statement from a reputable title company licensed to do business in the State of New York certifying that upon acceptance of a deed from Highclere Court, LLC, the Town will have title to the road(s) depicted on the subdivision plat filed in the office of the Westchester County Clerk as subdivision plat #28764, free and clear of any liens, other than easements for utility lines and (b) 12 November 6, 2019 a properly executed deed, recorded in the office of the Westchester County Clerk, that transfers title to the road(s) to the Town, and BE IT FURTHER RESOLVED, that the Town Administrator hereby is authorized to execute on behalf of the Town such deed and the other documents that must be executed in order for such deed to be recorded. Authorization – New York State Snow and Ice Removal Contract On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the 2019-2024 Municipal Snow and Ice Agreement between The People of the State of New York, acting by and through the Commissioner of Transportation of the State of New York, and the Town of Mamaroneck for reimbursement to the Town of Mamaroneck for snow and ice removal on New York State roadways located within the Town of Mamaroneck, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town.
