REGULAR MEETING OF THE TOWN BOARD
TOWN OF MAMARONECK, NEW YORK
HELD JULY 17, 1940
At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y.
The meeting was called to order by Supervisor McCulloch
at 8 P . P,I.
Present : Supervisor McCulloch
Councilmen Bates, Griffin, Mandeville, Meginniss
Absent: None
The presence was also noted of Tom Clerk Payne, Town Attorney
Delius, Comptroller Luceno and Town Engineer Foote .
The minutes of the meeting of June 11, 1940 were approved
as presented.
The Supervisor suggested that the meeting proceed with the
reports of committees .
Councilman Bates reported that refuse had been removed from
the open drain near Dillon Park.
Councilman Griffin reported that the Park Department employees
were quite busy repairing trees and carrying out other work of the
department. He stated that a number of complaints had been received
about shrubbery on private property near street corners .
He informed the Board that the Park Commission was favorably
disposed towards the project proposed by Mr. Frank Guadagnola; also
that some alterations were being made on a building at another location
on Vine Street.
He presented and compared the report of the Department of
Public Welfare for the month of June, 1940 with a report for the
same month last year, which showed as follows:

Councilman Griffin presented a petition dated July 15, 1940
received from the Assessor for the correction of the assessment roll
so as to permit the apportionment of taxes .
On motion by Councilman Griffin, seconded by Councilman
Bates, the following resolution was unanimously adopted:
WHEREAS, the Assessor has presented a petition
dated July 15, 1940 for the correction of the
assessment roll for the year 1939, taxes of 1940,
pursuant to the provisions of Section 33 of Chap-
ter 105 of the Laws of 1916, as amended, known as
the Westchester County Tax Act; and
WHEREAS, after due consideration this Board finds
it desirable to grant said petition for the correction
of said assessment roll;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll for the year 1939,
taxes of 1940, which shows property now appearing on
the roll as follows :

Councilman Meginniss presented the following financial
reports for the period January 1 to June 30, 1940: (1) Summary of
Receipts and Disbursements; (2) Statement of Budget Appropriations
and Expenditures; and (3) Analysis of Estimated. Revenues . He also
presented a report of W. P. A. projects and a report of the Highway
Yand as of June 30, 1940 . The reports were ordered filed.
Councilman Mandeville stated that he would make the reports
for his departments later during the meeting.
The Supervisor informed the Board that he had received a
letter from the New York, New Haven & Hartford Railroad Company
dated June 28, 1940, relative to the proposed filling in with refuse
of a portion of the railroad company' s property up to but not above
the grade of their adjacent roadbed near the site of the proposed
Larchmont-Mamaroneck joint incinerator plant. He presented the
agreement and blueprints showing the proposed project and asked the
members of the Board what they desired to do on the matter.
Following some discussion, it was on motion by Councilman
Bates, seconded by Councilman Meginniss, upon roll call, unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized to sign the agreement submitted by the
New York, New Haven & Hartford Railroad Company
and that a copy of same be placed on file in the
Torn Clerk's office of the Town.
The Supervisor informed the Board that he had received
a letter dated July 17, 1940 from Charles M. Baxter, Jr. , attorney,
for the Union Savings Bank of Westchester County concerning certain
certiorari proceedings brought by the bank.
He read the letter and following some discussion the assessor
stated that he and the Town Attorney recommended the settlement of
the certiorari proceeding instituted by The Union Savings Bank of
Westchester County, to review the assessment upon a parcel of property
in the Village of Mamaroneck) known as Section 8 Block 101, Lots 5,
6, 38 and 39 (new numbers, Block 825, Parcel 242 on the basis of a
reduction in the assessment from $9,200 to $7,950, for the year 1939 .
Councilman Mandeville introduced the following resolution
which was seconded by Councilman Griffin:
WHEREAS, heretofore and on or about the 30th day of
September, 1939, a writ of certiorari was obtained by
The Union Savings Bank of Westchester County, owner of
Section 8, Block 101, Lots 5, 6, 38 and 39 (new numbers,
Block 825, Parcel 242) to review the assessment for the
year 1939, upon the premises owned by it; and
WHEREAS, d return to such writ was duly filed b the
Assessor and Board of Review on or about the 15'h
day of November, 1939, and no further proceedings have
been had; and
WHEREAS, the Town Attorney and Assessor recommend to
this Board that the proceedings be settled and dis-
continued. upon the reduction of the assessment from
$9,200 to $7,950;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment for the year 1939 upon
property known as Section 8, Block_ 101, Lots 5, 63 38
and 39 (new numbers Block 825, Parcel 242) assessed
for $9,200, be reduced to $7,950, provided_ the certiorari
proceeding now pending in the name of The Union Savings
Bank of Westchester, be discontinued without costs to the
Town of Mamaroneck;
FURTHER RESOLVED that the Town Attorney is hereby
authorized and directed to sign the necessary stipulation
to obtain an order of the Supreme Court providing for
such reduction and refund of any excess taxes paid.
The foregoing resolution was passed by the following vote:
AYES: Supervisor L2cCulloch, Councilmen Griffin
and Mandeville.
NOES: Councilman Meginniss
NOT VOTING: Councilman Bates
The Assessor stated that he and the Town Attorney recommended

parcel of property in the Village of Mamaroneck known as Section 9,
Block 53, Lots 12a and 13a, (new numbers Block_ 915, Parcel 153) on the
basis of a reduction in the assessment from $11,750 to $11,000 for the
year 1939 .
Councilman Mandeville introduced the follovaing resolution
which was seconded by Councilman Griffin:
WHEREAS, heretofore and on or about the 30th day of
September, 1939, a writ of certiorari was obtained by
The Union Savings Bank of Westchester County, owner of
Section 9, Block 53, Lots 12a and 13a (new numbers,
Block 915, Parcel 153) to review the assessment for the
year 1939 upon the premises owned by it; and
WHEREAS, a return to such writ was duly filed by the
Assessor and Board of Review on or about the 15th day
of November, 19393 and no further proceedings have been
had; and
WHEREAS, the Town Attorney and Assessor recommend to this
Board that the proceedings be settled and discontinued
upon the reduction of the assessment from , 11,750 to
$11,000;
NOW, THEREFORE, BE IT
RESOLVED, that the Assessment for the year 1939 upon
property known as Section 9, Block 53, Lots 12a and 13a
(new numbers, Block 951, Parcel 153) assessed for $11,750
be reduced to $11,000 provided the certiorari proceeding
now pending in the name of The Union Savings Bank of
Westchester, be discontinued without costs to the To-�m of
Mamaroneck;
FURTHER RESOLVED that the Town Attorney is hereby
authorized and directed to sign the necessary
stipulation to obtain an order of the Supreme Court
providing for such reduction and refund of any excess
taxes paid.

The Assessor stated that he and the Town Attorney recommended

Savings Bank of Westchester County, to review, the assessment upon a
parcel of property in the Village of Mamaroneck known as Section 9,
Block 51, Lot 5, (new numbers, Block 912, Parcel 18) on the basis of
a reduction in the assessment from $24,500 to $21, 500 for the year
1939 .
Councilman Mandeville introduced the following resolution
which was seconded by Councilman Griffin:
WHEREAS, heretofore and on or about the 30th day
of September, 1939, a writ of certiorari was obtained
by The Union Savings Bank of Westchester County', owner
of Section 9, Block 51, Lot 5 (new numbers Block 912,
Parcel 1.8) to review the assessment for the year 1939
upon the premises owned by it; and
WHEREAS, a return to such writ was duly filed by the
Assessor and Board of Review on or about the 15th day
of November, 1939, and no further proceedings have been
had; and
WHEREAS, the Town Attorney and Assessor recommend to
this Board that the proceedings be settled and dis-
continued upon the reduction of the assessment from
$24 500 to $21,500;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment for the year 1939 upon
property known as Section 9, Block 51, Lot 5 (new
numbers Block 912, Parcel 18) assessed for $21., 500,
be reduced to $21, 500 provided the certiorari proceeding
now pending in the name of The Union Savings Bank of
Westchester, be discontinued without costs to the Town of
Mamaroneck;
FURTBER RESOLVED that the Town Attorney is hereby authorized
and directed to sign the necessary stipulation to obtain
an order of the Supreme Court providing for such reduction
and refund of any excess taxes paid.
The foregoing resolution was passed by the following vote:
AYES: Supervisor McCulloch, :Councilmen Mandeville
and Griffin
NOES: Councilman Meginniss
NOT VOTING: Councilman Bates
The Supervisor requested the Town Clerk to read the communi-
cations .

A letter dated July 17, 1940 addressed to the Town Assessor,
James M.Smith, received from William H. Johnson, Village Manager of
the Village of Mamaroneck, was read. Mr. Johnson asked that Sec-
tion 9, Block 59, Lot 1, known as the village dock, be exempt from all
taxes except the County Serer Department . He referred to the assess-
ment placed on the property and claimed that it should not be assessed,
as it was acquired for municipal purposes as part of the Harbor island
Park development.
Assessor Smith informed the Board that the matter had been
placed before the Board of Review during the hearings of 1939. He
- presented the minutes of the hearing and pointed out that Town Attor-
ney Delius asked the Village Attorney how the village acquired title
to the property. He stated that the question had not been answered
to date.
Following some discussion the members of the Board authorized
the Supervisor and the Town Attorney to take the matter up with
Village Manager Johnson and to report back to the Board.
A letter dated July 9, 1940 was received from Mary G. Riegel,
Secretary of the Civic Department of the Womants Club of Larchmont,
concerning a project carried out by the department during the past
winter, in which they made a complete survey of all street corners of
the Larchmont postal district to determine whether or not the planting
on corners was safe for traffic . Several sketches were submitted
with a resolution urging that Section 5 of the General Ordinances of
the Town be strictly enforced.
Following some discussion the members of the Board directed
the Town Clerk to forward the sketches sho,rsing the corners in question
to Mr . Clair V. Johnson, Chairman of the Board of Police Commissioners,
with the suggestion that his board meet with the Traffic Safety Committee
to discuss the matter with representatives of the 'Woman' s Club.
A letter dated July 3, 1940 was received from K. G. Van Sciver,
Clerk of the Board of Education of Union Free School District No . 1 of
the Town of Mamaroneck. He advised that Mr. David. C. Lynn, 46 Glenn
Road, Larchmont, was appointed Treasurer of the School District No. 1
at the annual meetin g of the Board of Education held July 2, 1940.
The members of the Board directed the Town Clerk to make
a copy of the letter and file same with Comptroller Luceno.
A statement dated July 91 1940 showing a list by sections
of unpaid 1940 state, county, town taxes, special assessments and
water arrears as of July 1, 1940, was received from Henry R. Dillon,
Receiver of Taxes and Assessments .
The following reports were received and ordered filed:
(1) Report of the Receiver of Taxes for the month of June; (2) Report
of the Town Clerk for the month of June; (3) Report of the Building
Inspector for the month of June; (4) Reports of the Plumbing Inspector
for the months of February, March, April and May; (5) Report of Mama-
roneck health Center for the month of June; and (6) Report of the
County of Westchester Department of Health for the month of May.
The Supervisor asked if there was any one present who ti'rished
to address the Board.
Mr . C. Stewart Comeaux, Chairman of the Board of Park Com-
missioners, appeared and referred to the $1,500 appropriation for the
care of trees injured during the sleet storm. He stated that the
employees of the Park Department were carrying out this work and that
the superintendent in charge had explained that by the purchase of
an electric hammer and drills at the cost of $131.00 considerable more
work could be done for the total appropriation. He asked that the
Board authorize the Park Commission to purchase the tools out of the
above mentioned fund.
On motion by Councilman Mandeville, seconded by Councilman
Bates, it was upon roll call unanimously

RESOLVED, that the Town of Mamaroneck Board of Park
Commissioners be and they hereby are authorized to
purchase out of the special tree repair fund such
tools as necessary to carry out the work of repairing
trees in the unincorporated section of the Town.
Mr . Francis Thurston of Rye, New York, appeared and requested
permission to paint house numbers on curbs throughout the unincorporated
section of the Town. He explained that he had offered to co-operate
with li}felfare Officer DeVinne to give work to people on relief.
Following some discussion it was upon motion by Councilman
Meginniss, seconded by Councilman Bates, unanimously
RESOLVED, that permission is hereby granted
Mr . Francis Thurston, 61 Palisades Road, Rye,
New York, to paint house numbers on the curbs
in front of homes throughout the unincorporated
section of the Town of Mamaroneck without any cost
to the Town, and that he be compensated by a volun-
tary contribution by the home owners or occupants
thereof; and be it
FURTHER RESOLVED, that this permission is given
with distinct understanding that any contribution
made is given at the sole discretion of the donor;
and be it
FURTHER RESOLVED, that Mr. Thurston agrees to co-
operate with Public Welfare Officer DeVinne in giving
employment on this project to persons on relief; and
be it
FURTHER RESOLVED, that Pair. Thurston agrees and guarantees
to save the Tovm of Mamaroneck free from any and all
damages and claims arising from the issuance of this per-
mit; and be it
FURTHER RESOLVED, that the license hereby granted is
revokable at will by the Town Board of the Town of

Mamaroneck, either for or not for cause, and the action
of said Board shall not be reviewable.
Assistant Town Attorney Schwartzreich presented and recommended
the approval of the follotring resolution which was on motion by Council-
man Eandeville, seconded by Councilman Griffin, upon roll call, unani-
mously adopted:
WHEREAS in foreclosure proceedings instituted by the
Town of Mamaroneck against James J. Hall, et al. ,
the referee, duly appointed for that purpose by order
of the Supreme Court, sold to the Toin of Mamaroneck
property described as Section 5, Block 7, Lots 1, 2, 3
and 4, on the Assessment Map of the Town of Mamaroneck;
and
WHEREAS the said referee has applied to the payment of
certain taxes, assessments and tax liens o7med by and
due to the Town of Mamaroneck, together with interest
and penalties thereon to the date of sale, the sum of
$779.38 which taxes, assessments and tax liens are re-
quired to be cancelled by the provisions of Section 54
of the Westchester County Tax Act;
NOW, THEREFORE, BE IT
RESOLVED that the following taxes, assessments and
tax liens are hereby cancelled:

Mr. Charles Guglielmo appeared and requested the Board to
cancel a tax lien on Section 8, Block 78, Lot 3 for the year 1875 .
Assistant Attorney Schwartzreich explained the matter and
following some discussion it was upon motion of Councilman Griffin,
seconded by Councilman Mandeville, unanimously
RESOLVED that the Receiver of Taxes and Assess-
ments be and he hereby is authorized, empowered
and directed to cancel the tax lease in the sum
of $3 .61 on property known as Section 8, Block 78,
Lot 3, for the year 1875, sale of 1876 .
Mr . Mervin C . Pollak appeared before the Board to make
application for the cancellation of certain tax liens .
Following some discussion, Assistant Attorney Schwartzreich
recommended the following resolution, which was on motion by Council-
man Griffin, seconded by Councilman Mandeville, unanimously adopted:
WTIEREAS, Mervin C. Pollak, purchased the following
tax liens against a lot on Rockland Avenue, then
assessed to Carroll-Ratner Corp. , for which Mr. Pollak
paid the sum of $297.64:

FURTHER RESOLVED, that this cancellation be made upon
the assurance of the owners that they will improve
the property by building thereon.
Fire Chief McCarthy of the Town of Mamaroneck Fire Depart-
ment informed the Board that the Fire Council had recommended that
two additional paid drivers be added to the department. He ex-
plained that five drivers now employed work ninety-six hours per
week each. He said that the new aerial ladder apparatus would be
delivered on or about September lst and that, it would require two
men to operate the truck. He pointed out that the department had
saved four months of the salary for one driver out of the budget
allovaance by not hiring the additional man provided for until May 1,
1940; also that other savings had been effected.
Following some discussion the members of the Board decided
to wait until Attorney Delius returned from his vacation so that
they could receive his opinion on the question as to whether or not
they could increase the number of men, as the approved budget provi-
ded for five men. They did, however, authorize the Fire Council
to proceed with the examination and selection for recommendation to
the Town Board of one man to be appointed at the time theaerial
truck was delivered.
Councilman Mandeville stated that some time ago the purchase
of a truck was being considered by the Board and that he recommended
the Mack Truck, while Mr. Poccia, the To,rrnos mechanic, recommended
a Dodge Truck. He said that he had learned that since then two
trucks had been purchased by the Town without the opinion of the mem-
bers of the Board.
Supervisor McCulloch asked Comptroller Luceno to explain
to Mr . Mandeville how the purchase was made .
Comptroller Luceno explained that George Osborne, driver,
who supplies Vd. P. A. jobs with tools, gasoline and materials, was
using a dump truck for this work and that Town Engineer Foote had
recommended that a pick-up truck be purchased so that the dump truck
could be used to better advantage . He pointed out that two old
trucks had been discarded. He said that the pick-up truck was a
used truck marked down in price and purchased for $300 out of Vd. P. A.
funds . The other truck purchased was an old Mack truck on rental
and used on the Fenimore Road quarry job, and after study it was
decided that the Town would save money by the purchase of the same
because the truck could be used elsewhere. Following the completion
of the quarry job, he said that the Mack truck was purchased for $400
out of W. P. A. funds .
The Supervisor explained that when the W. P. A. projects
were approved it was assumed that he, the Town Engineer and the Comp-
troller could go ahead and operate so long as they did not exceed the
appropriation for the projects . He pointed out that the purchase
of a truck for the Highway Department had been provided for in the
budget and so long as it was a budget item, it should be approved by
the members of the Board. He added that if the members of the Board
wanted the purchase of equipment for the W. P. A. projects to come
before the Board, it would be done .
Councilman Mandeville stated that he thought that the trucks
purchased were "good buys" but that the Town had purchased a Mack
truck after Mr. Poccia had recommended another type . He said that
he was told that a relative of Mr . Poccia sold the truck to the Town.
He continued by stating that ultimately the trucks would revert to
the Highway Department and that so long as he was chairman of the
Highway Committee, he would like to know everything affecting that
department.
Councilman Meginniss stated that Mr. Mandeville ' s request
was a reasonable one .
Councilman Mandeville referred to the purchase of road
materials for the Fenimore Road W. P. A. project and stated that
he would like to have at least expressed his opinion on such tran-
sactions .
The Supervisor stated that he had discussed the matter
sometime before the purchase with Mr. Mandeville .
Mr. Mandeville stated that he was not informed of the
Supervisor' s decision when the purchase was made .
Supervisor McCulloch explained that Town Engineer Foote
and County Engineer Sells were consulted before the purchase was

Councilman Meginniss recommended that the details in
connection with all W. P. A. projects be presented to the Town
Board for approval. It was agreed that this would be the pro-
cedure hereafter .
Comptroller Luceno reported that the funds for the under-
ground survey project were running out and that $150 would be re-
quired to continue the project until the end of the year.
On motion by Councilman Griffin, seconded by Councilman
Bates, it was unanimously, upon roll call,
RESOLVED, that the Comptroller be and he hereby
is authorized to transfer from surplus funds
the amount of $150.00 to provide funds to continue
the underground survey project.
The Supervisor informed the Board that the bids received for
the construction of the joint incinerator plant exceeded the amount
estimated by Engineer Taylor and set up as the appropriation for the
work. He said that the commission had eliminated certain work to
bring the cost within the above appropriation and that they planned
to have another meeting to re-advertise for bids .
He said that there were some old unpaid bills for printing
the specifications for the incinerator and that there were no-
funds available in the Joint Garbage Commission' s treasury. He sug-
gested that the Town advance $300 to the Commission to pay these bills .
On motion by Councilman Mandeville, seconded by Councilman
Meginniss, it was unanimously
RESOLVED y that the Supervisor, as the Town' s
representative on the Larchmont-Mamaroneck
Joint Garbage Incinerator Commission, be and
he hereby is authorized to advance from surplus
funds of the Town of Mamaroneck the amount of
$300 to the Joint Garbage Incinerator Commission
in order to pay these old bills .
Comptroller Luceno presented for the consideration of the
Board a W. P. A. project for the erection of a garage building and
the pavement of the yard area at the Village of Larchmont yard on
the Boston Post Road.
On motion by Councilman Mandeville, seconded by Councilman
Griffin, it was unanimously
RESOLVED, that the Supervisor be and he hereby
is authorized to sign the following W. P. A.
project proposal on the condition that it meet
with the approval of the bonding attorneys :
Total estimated cost x$33,288.00
Total estimated Federal contri-
bution 195908.00
Total estimated Sponsor' s contri-
bution 133380.00
Approximate cost to the Town 4,950.00
FURTHER RESOLVED, that if and when the above project
proposal receives the approval of the Federal Govern-
ment, the same be re-submitted to the Town Board for
final action before work is started.
Comptroller Luceno reported that Village Engineer Richards
had contacted the W. P. A. officials to find out whether or not they
could get their approval for a curbing project throughout the Village
of Larchmont, that Mr . Richards had been advised by the officials
that a. curbing project for the Town of Mamaroneck had been approved
and was under Dray and that so long as it was operating no other pro-
ject for curbing could be commenced.
Councilman Meginniss presented a letter dated February 26, 1940
from Edward A. Keeler, the Town' s insurance broker, concerning work-
men' s compensation coverage for volunteer firemen. He stated that the
Superintendent of Insurance had authorized the State Insurance Fund to
extend coverage to volunteer firemen under workmen' s compensation in-
surance .
Following some discussion it was decided to continue the
workmen' s compensation insurance policy in a commercial company with
the same underwriters as in the past.
Councilman Griffin referred to the report of the Town auditors
for the year 1939 and suggested that at sometime in the future the
members of the Board discuss certain items in the report.
At 11:30 P. M. the Board unanimously resolved to adjourn.
