HomeMy WebLinkAbout1940_06_19 Town Board Minutes REGULAR MEETING OF THE TOWN BOARD TOWN OF MAMARONECK, NEW YORK HELD JUNE 19, 1940 At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y. The meeting was called to order by Supervisor McCulloch at 8 P. M. Present : Supervisor McCulloch Councilmen Bates, Griffin, Mandeville, Meginniss Absent: None The presence was also noted of Town Clerk Payne and Town Attorney Delius, Comptroller Luceno, Assessor Smith and Engineer Foote . The Supervisor suggested that the Town Clerk read the com- munications. A letter dated June 14, 1940, was received from the County of Westchester Board of Elections signed by Ernest F. Eilert and James H. Sullivan, Commissioners, calling to the attention of the Town Board the fact that the registration and number of votes cast in Election Districts Nos. 14 and 15 of the Town during the last three general elections were close to the statutory limit of 950 per district . They pointed out that each succeeding presidential elec- tion registration of voters surpassed the previous high mark and re- commended that any district exceeding the limit be altered. The Supervisor asked the Town Clerk if the limit had been exceeded in any district . The Town Clerk stated that it had not been exceeded. The letter was placed on file pending the outcome of the next general election. A letter dated June 18, 1940, was -received from Harold B. Payne, requesting the extension of the water main in front of his property known as Section 1, Block 44E, Lots 53 to 56 on Lafayette Road, Town. Following some discussion, on motion by Councilman Bates, seconded by Councilman Mandeville , it was unanimously RESOLVED, WHEREAS an estimate dated June 18, 19405 has been received from Westchester Joint 'Water Works No. 1 in the amount of $229. 09 of the cost of the installation of 39 feet of 6-inch transite pipe to be extended from the existing main in Lafayette Road; NOW, THEREFORE, BE IT RESOLVED, that the Westchester Joint Water 'Works, No . 1 be and it hereby is authorized, empowered _ and directed to install for the Town of Mamaroneck the water main above described and to charge to the Town the actual cost of laying the pipe , the Town -- to do the trenching and backfilling. A petition dated June 18, 1940, registering a complaint against an alleged public nuisance at 82 Murray Avenue in the form of numerous chickens and three large dogs, was received from the following residents ; Edward R. Holt 69 Edgewood Avenue John McGrath 6 Leafy Lane T. E . Ronan 67 Edgewood Avenue 0 Caroline C. Steer Mrs . H. H. Arming J. T. M cTarnahan 90 Murray Avenue 7 Leafy Lane 11 Leafy Lane Mr. and Mrs. Holt appeared and asked the Board to take some action to relieve the neighborhood of the alleged nuisance. Following some question on the Town's ordinances, the matter was referred to Attorney Delius for study and to report back to the Board. The Supervisor asked if there was any one else who wished to appear before the Board. There being no one, he suggested that the meeting proceed with the reports of committees. Councilman Mandeville reported that the Highway Department had re-surfaced Winged Foot Drive and Woody Lane; also that the ballast or trap rock received from the railroad property was being stored at the town yard. Councilman Bates reported that the open drain near Dillon Park was cleaned out about six or eight weeks ago and that it would be necessary to do so again because refuse from surrounding properties had been thrown into the opening. Councilman Griffin stated that he had nothing to report . Councilman Meginniss introduced the following resolution: RESOLUTION APPROPRIATING THE SUM OF $31, 000 TO PAY A PORTION OF THE COST OF PUBLIC IMPROVEMENT WORK RELIEF PROJECTS IN THE TOWN AND AUTHORIZING TIE ISSUANCE OF $31,000 BONDS OF THE TOWN OF MAMARONECK FOR SAID PURPOSE . RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMARONECK, IN THE COUNTY OF WESTCHESTER, NEW YORK, as follows; Section 1 . The sum of $18, 000 is hereby appropriated to pay the portion to be borne by the Town of public improve- ment work relief projects in the Town undertaken through or by the authority of the Work Projects Administration or any other work relief agency of the Federal Government, including the cost of furnishing labor, materials, supplies and equip- ment for such projects and incidental expenses in connection therewith, the said public improvement work relief projects to include only projects having a period of probable useful- ness of at least five (5) years, computed from October 1, 1939 the date of the first indebtedness, whether temporary or permanent, incurred to finance any portion of the cost thereof. To meet said appropriation, bonds of the Town in an aggregate principal amount not exceeding $18,000 shall be issued. Section 2. The sum of $13, 000 is hereby appropriated to pay the portion to be borne by the Town of public improve- ment work relief projects in the Town undertaken through or by the authority of the Work Projects Administration or any other 'work relief agency of the Federal Government, including the cost of furnishing labor, materials , supplies and equip- ment for such projects and incidental expenses in connection therewith, the said public improvement work relief projects to include only projects having a period of probable useful- ness of at least ten (10) years, computed from July 15, 1939, the date of the first indebtedness, whether temporary or permanent , incurred to finance any portion of the cost thereof.To meet said appropriation, bonds of the Town in an aggregate principal amount not exceeding ; $13,000 shall be issued. Section 3. Said bonds shall be combined in a single issue, shall each be designated "General Bond of 1940, M Series I", shall be dated July 15, 1940, and shall mature in annual installments of principal as set forth in the following schedule; Said bonds shall bear interest at a rate not exceeding six per centum (6%) per annum, payable semi-annually on the fifteenth days of January and July in each year, to be expressed in a multiple of one-tenth or one-quarter of one per centum, the exact rate to be determined by the Supervisor upon receipt of bids, shall be numbered in order of maturity from 1 to 31, both inclusive, shall be of the denomination of $1,000 each, shall be payable as to both principal and interest in lawful money of the United States of America, at the office of the First National Bank of Mount Vernon, Mount Vernon, New York, or, at the option of the holder, at the principal office of the Guaranty Trust Company of New York, in the City, County and State of New York, shall be coupon bonds, registerable as to principal and interest, and shall be signed by the Super- visor and the corporate seal of the Town shall be affixed thereto and attested by the Town Clerk and the coupons attached thereto shall be authenticated by the facsimile signature of the Supervisor. Said bonds shall be issued pursuant to the following laws of the State of New York, as amended: Chapter 782 of the Laws of 1933, the Town Law, constituting Chapter 62, and the General Municipal Law, constituting Chanter 24 of the Consolidated Laws. Section 4. The faith and credit of said Town shall be and are hereby pledged for the punctual payment of the principal of and interest on said bonds, and a tax shall be levied annually on all of the taxable property in said Town in an amount sufficient to pay the principal of and interest on said bonds as the same shall become due. Section 5. Resolutions entitled; "Resolution appropriating the sum of $6, 062 to pay a portion of the cost of public improvement work relief projects in the Town and authorizing the issuance of $6, 062 bonds of the Town of Mamaroneck for said purpose U, adopted July 12, 1939, "Resolution appropriating the sum of $22,199 to pay a portion of the cost of public improvement work relief pro- jects in the Town and authorizing the issuance of 022,199 bonds of the Town of Mamaroneck for said purpose". adopted October 4, 1939, and "Resolution amending a resolution entitled: " Resolution appropriating the sum of 022,199 to pay a portion of the cost of public improvement work relief projects in the Town and authorizing the issuance of $22,199 bonds of the Town of Itamaroneck for said purpose" , in relation to the title, amount of the appropriation and ' maturities of the bondst, adopted April 17, 1940, are hereby repealed, rescinded and revoked to the extent of the appropriations and authorizations herein contained, except that nothing herein contained shall be construed to affect the validity of any obligations issued in anticipation of the bonds authorized by said resolutions. On motion of Councilman Meginniss, seconded by Councilman Griffin, the foregoing resolution was adopted by the following vote; AYES: Supervisor Councilmen NOES; None McCulloch Bates, Griffin, Mandeville , Meginniss Councilman Meginniss introduced the following preambles and resolution: RESOLUTION AUTHORIZING THE ISSUANCE OF $28, 000 GENERAL BONDS OF 1940 SERIES II, TO PAY NOT EXCEEDING 8O% OF THE LOCAL SHARE OF A SUPPLEMENTAL APPROPRIATION FOR HOME RELIEF FOR THE FISCAL YEAR COMMENCING JANUARY 1, 1939. RECITALS: WHEREAS, pursuant to a resolution entitled; "Resolu- tion determining that the aggregate of the sums appropriated and amounts available and authorized to be expended by the Town of Mamaroneck for home relief for the year 1939 are less than the amount required for said year, making a supplemental appropriation for home relief in the amount of $59,000 and authorizing the issuance of a certificate of indebtedness to finance the local share ", duly adopted on December 7. 19393 a supplemental appropriation for home relief for the fiscal year commencing January 1, 1939 was made in the sum of $59,000; and WHEREAS, it was determined in said resolution that - the estimated amount of State aid to be received on account of the expenditure of said appropriation is $23, 600, and that the local share of home relief included in said appropriation, computed as provided by section 49 of the Public Welfare Law, is $35,400; and WHEREAS, pursuant to Section 49 of the Public Welfare Law, taxes are required to be levied in the current fiscal year to meet at least twenty per centum (20%) of the local share of said supplemental appropriation for the fiscal year commencing January 1, 1939, and.. said statute authorizes the issuance of bonds to the extent of the percentage of such local share not so required to be raised by taxation; and WHEREAS, no bonds have heretofore been issued to finance any portion of the local share of said supplemental appropriation. Now, therefore, be it RESOLVED BY THE TOWN BOARD OF TEE TOWN OF MAMARONECK- IN THE COUNTY OF WESTCEESTER. NEW YORK, as follows; Section 1 . Bonds of the Town of Mamaroneck in the aggregate principal amount of 28,000 shall be issued, to provide funds .to pay not exceeding eighty per centum (80%) of the local share of the supplemental appropriation for home relief for the fiscal year commencing January 1, 1939 referred to in the recitals hereof. Each of said Pi bonds shall be designated "General Bond of 1940, Series Il . Section 2. Said bonds shall be dated July 15, 1940, shall mature in the principal amount of $4,000 on July 15, in each of the years 1941 and 1942, $3, 000 on July 15 in each of the years 1943 and 1944, $4, 000 on July 15 in each of the years 1945 to 1947, both inclusive , and $2,000 on f a July 15, 1948, shall bear interest at a rate not exceeding six per centum ( 6%) per annum, payable semi- annually on the fifteenth days of January and July in each year, to be expressed in a multiple of one-tenth or one-quarter of one per centum, the exact rate to be determined by the Supervisor upon receipt, of bids, shall be numbered in order of maturity from 1 to 28, both inclusive, shall be of the denomination of 11, 000 each, shall be payable as to both principal and interest in lawful money of the United States of America, at the office of the First National Bank of Mount Vernon, Mount Vernon, New York, or, at the option of the holder, at the principal office of the Guaranty Trust Company of New York, in the City, County and State of New York, shall be coupon bonds, registerable as to principal and interest, and shall be signed by the Supervisor and the corporate seal of the Town shall be affixed thereto and attested by the Town Clerk and the coupons attached thereto shall be authenticated by the facsimile signature of the Supervisor. Said bonds shall be issued pursuant to the following laws of the State of New York, as amended: the Public Welfare Law, being Chapter 42, the Town Law, constituting Chapter 62, and the General Municipal Law, constituting Chapter 24 of the Consolidated Laws . Section 3. The faith and credit of said Town shall be and are hereby pledged for the punctual payment of the principal of and interest on said bonds, and a tax shall be levied annually on all of the taxable property in said Town in an amount sufficient to pay the principal of and interest on said bonds as the same shall become due . On motion of Councilman Meginniss, seconded by Councilman Griffin, the foregoing resolution was adopted by the following vote: AYES: Supervisor McCulloch Councilmen Bates, Griffin, Mandeville , Meginniss NOES: None Councilman Meginniss introduced the following, resolution: RESOLUTION DETERMINING THE FORM OF $31,000 GENERAL BONDS OF 19401 SERIES I, AND $26, 000 GENERAL BONDS OF 1940, SERIES II, OF THE TOWN OF MAMARONECK, IN THE COUNTY OF WESTCHESTER, NEW YORK, AND PROVIDING FOR THEIR SALE . RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMARONECK, IN THE COUNTY OF WESTCHESTER, NEW YORK, as follows: Section 1. The $31, 000 General Bonds of 1940, Series I, authorized by virtue of a resolution entitled: "Resolution appropriating the sum of $31, 000 to pay a portion of the cost of public improvement work relief projects in the Town and authorizing the issuance of $31,000 bonds of the Town of Mamaroneck for said purpose", and the $28, 000 General Bonds of 1940, Series II, authorized by virtue of a. resolu- . tion entitled: "Resolution authorizing the issuance of $28,000 General Bonds of 1940, Series II, to pay not exceed- ing 80% of the local share of a supplemental appropriation for home relief for the fiscal year commencing January 1 , 1939". adopted June 19, 1940, shall be in substantially the following form: UNITED STATES OF AMERICA STATE OF NEW YORK COUNTY OF WESTCHESTER TOWN OF MAIARONECK No. A. 1, 000. 00 The Town of Mamaroneck, in the County of Westchester, a municipal corporation of the State of New York, hereby acknowledges itself indebted and for value received promises to pay to the bearer of this bond or, if it be registered, to the person in whose name it is registered, or, the fifteenth day of July, 19 the sum of One thousand - - - - - - - - - - - - - --Dollars ($1,000.00) , and to Pay interest on such sum at the rate of per cent=, ( %) per annum, semi-annually on the fifteenth days of January and July in each year from the date of this bond until it matures upon presentation and. surrender, as they severally mature , of the coupons therefor annexed hereto or, if this bond be registered, to the registered holder. Both principal and interest of this bond will be paid in lawful money of the United States of America, at the office of the First National Bank of Mount Vernon, Mount Vernon, New York, or, at the option of the holder, at the principal office of the Guaranty Trust Company of New York, in the City, County and State of New York. Daylight Saving Time ) at the Town Offices, 158 West Boston Post Road, in the Village of Mamaroneck, in said Town, and the Town Clerk is hereby authorized and directed to cause a notice of sale of said bonds in substantially the form hereinafter provided to be published at least once in the "Daily Times". a newspaper published in the Town of Mamaroneck, which is hereby designated as the official newspaper of the Tom for the purpose of such publication, not less than five nor more than thirty days prior to the date of the sale, and also to cause such notice of sale to be published at least once in the "Daily Bond Buyer", a financial newspaper published in the City of New York. M. EASTERN STANDARD TIME -(11 o' clock A. P.T. Daylight Saving Time ) for the following bonds: $31,000 par value General Bonds of 1940, Series I, of said Town, maturing F6,000 on July 15, 1941 and 1942, $7, 000 on July 15, 1943 and 1944, and $1,000 on July 15 in M each of the years 1945 to 1949, inclusive; purpose , to provide funds to pay a portion of the cost of public improvement work relief projects having periods of probable usefulness of 5 and 10 years, authorized by Chapter 782 of the Laws of 1933, as amended. $28,000 par value General Bonds of 1940, Series II, of said Town, maturing $4,000 on July 15, 1941 and 1942, $3, 000 on July 15, 1943 and 1944, $4, 000 on July 15, 1945 to 1947, inclusive , and $2, 000 on July 15, 1948; purpose ,to provide funds to pay for home relief in the Town, authorized by the Public Wlelfare Law. The period of probable usefulness of the object or purpose of said bonds is at least twenty (20) years. Said bonds are dated July 15, 1940; denomination $1,000, and are coupon in form, registerable as to both principal and interest. Principal and semi-annual interest, January 15 and July 15, payable in lawful money of the United States of America, at the office of the First National Bank of Mount Vernon, Mount Vernon, New York, or, at the option of the holder, at the principal office of the Guaranty Trust Company of New York, in the City, County and State of New York. Bidders must state in their bids a single rate of interest which all of the bonds offered for sale are to bear, expressed in a multiple of one-quarter or one-tenth of one per centum, but not exceeding six per centtnn ( 6%) per annum:, and must state the price offered. The bonds will bear the lowest rate of interest stated by any bidder in a ' duly acceptable bid, and will be awarded to the bidder stating the lowest rate . If two or more bidders offer to take the bonds at the same lowest rate, the bonds will be awarded to the bidder offering to pay the highest price therefor. No bid will be accepted for separate issues or separate maturities, or at less than the par value of the bonds , or unless accompanied by a certified check or bank draft upon an incorporated bank or trust company, payable to the order of the "Town of Mamaroneck, New York", for $1,180. being two per centum (2%) of the amount of the bonds. No interest will be allowed upon such check or draft . Checks of unsuccessful bidders will be returned promptly. The check of the successful bidder will be retained to be applied in part payment for the bonds or to secure the Town against any loss resulting from the failure of the bidder to comply with the terms of his bid. The Town operates under the Town Law, constituting Chapter 62 of the Consolidated Laws of the State of New York. All proposals together with check or draft must be enclosed in a sealed envelope endorsed "Proposal for Bonds" and directed to Mr. Bert C . McCulloch, Supervisor, Town of Mamaroneck, New York. The right is reserved to reject any or all bids. The bonds will be valid and. legally binding obliga- tions of the Town, and the Town will have cower and will be obligated to levy ad valorem taxes upon all the taxable property within the Town for the payment of the bonds and interest thereon, without limitation of 'rate or amount . The opinion of Messrs. Hawkins, Delafield & Longfellow, of New York City, to this effect mill be furnished to the successful bidder. 5 FINANCIAL STATEUENT 1. On motion of Councilman Meginniss, seconded by Councilman Griffin, the foregoing resolution was adopted by the following vote: AYES: Supervisor McCulloch Councilmen Bates, Griffin, IJandeville , Meginniss NOES: None Councilman Mandeville introduced the following resolution: RESOLUTION APPROPRIATING TIM SUM OF $5,500 TO PAY A PORTION OF TIM COST OF PUBLIC IMPROVEMENT WORK RELIEF PROJECTS IN THE TOWN AND AUTHORIZING ISSUANCE OF $5,500 BONDS OF THE TOWN OF MAMARONECK FOR SAID PURPOSE RESOLVED BY ThE TOIIN BOARD OF THE TOWN OF MAMARONECK, IN THE COUNTY OF WESTCHESTER, NEW YORK, as follows : Section 1 . The sum of $5;500 is hereby appropriated to pay the portion to be borne by the Town of public improvement work relief projects in the Town undertaken through or by the authority of the Works Progress Admini- stration of the federal government, or other work relief authority of the federal government, including the cost of furnishing labor, materials, supplies and equipment for such projects and incidental expenses in connection there- with, the said public improvement work relief projects to include only projects having a period of probable usefulness M of at least five (5) years, computed from June 19, 1940, the date of adoption of this resolution and no indebted- ness, whether temporary or permanent, has been incurred prior to said date to finance any portion of the cost thereof. To meet said appropriation, bonds of the Town in an aggregate principal amount not exceeding $5,500 shall be issued. Section 2. Said bonds shall be dated April 1 , 1941, -- shall mature in annual installments of principal, shall bear interest at a rate not exceeding six per centum (6%) per annum, payable semi-annually on the first days of -- Barth and September in each year, shall be numbered, shall be in such form and of such denomination, shall be payable at such place or places, in such specie or other currency, and shall be sold at public sale in such manner and on such terms, but for not less than their par value, as shall hereafter be determined by subsequent resolution or reso- lutions of this Board. Section 3. The faith and credit of said Town shall be and are hereby pledged for the punctual payment of the principal of and interest on said bonds, and a tax shall be levied annually on all of the taxable property in said Town in an amount sufficient to pay the principal of and interest on said bonds as the same shall become due. Section 4. This resolution shall take effect immediately. On motion of Councilman , Mandeville, seconded by Councilman Griffin, the foregoing resolution was adopted by the following vote: AYES: Supervisor McCulloch Councilmen Bates, Griffin, Iciandeville , Meginniss NOES: None Councilman Mandeville introduced the following preamble and -resolution: WIEREAS, a 'resolution entitled: "Resolution appropriat- ing the sum of $5, 500 to pay a portion of the cost of public improvement work relief projects in the Town and authorizing the issuance of $5,500 bonds of the Town of Mamaroneck for said purpose`, adopted June 19, 1940, has become effective . Now, therefore, be it RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMARONECK, IN TEE COUNTY OF WESTCEESTER, NEW YORK, as follows: Section 1 . For the purpose of temporarily financing the cost of permanent improvements provided for in said resolution, in anticipation of the issuance of bonds, the Supervisor is hereby authorized to issue a Certificate of Indebtedness of the Town of Mamaroneck in an aggregate principal amount not exceeding $5, 500. Said Certificate shall be designated "Works Project Certificate of Indebted.- ness". Section 2. The following matters in connection with said Certificate are hereby determined: Date: July 13 1940 Maturity: April 1, 1941 Denomination: $5,500. Number: W. P. A. #19 Form: Substantially in accordance with resolution adopted October 4, 1939. Place of Payment : First National Bank, Mount Vernon, N. Y. The Supervisor is hereby authorized to determine all matters in connection with said Certificate of Indebted- ness, the determination of which is not provided for by this or subsequent resolutions, and his signature upon said Certificate shall be conclusive as to such deter- minations. Said Certificate shall be signed by the Supervisor, shall have the corporate seal of the Town affixed thereto and attested by the Town Clerk. The Supervisor is hereby authorized to sell said Certificate at public sale or private sale at not less than par and to fix the interest rate thereof at not exceeding six per centum ( 60) per annum, and to deliver same to the purchaser upon receipt of the purchase price, plus accrued interest from the date of the Certificate to the date of delivery. Section 3. Any instrument issued pursuant to this resolution shall be a general obligation of the Town of PrIamaroneck, and the faith and credit of the Town are hereby pledged for the punctual payment of the principal of and interest on said obligation, and unless otherwise paid or payment provided for, a tax sufficient to provide for the payment thereof shall be levied and collected. RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMARONECK, IN THE COUNTY OF WESTCESTER, NEW YORK, as follows: Section 1. For the purposes authorized by law, the Supervisor is hereby authorized to borrow an amount not exceeding $175,000 and to issue Certificates of Indebtedness of the Town therefor against transfers of tax liens owned by the Town not otherwise pledged, pursuant to the 'Westchester County Tax Law, constituting Chapter 105 of the Laws of 1916, as amended. Each of said Certificates of Indebtedness shall be designated "Tax Lien Certificate of Indebtedness". Section 2 . The Supervisor is hereby authorized and directed to sell said Certificates at private sale at not less than par, without advertisement or public bidding, and to deliver the same to the purchaser upon receipt of the purchase price, plus accrued interest from the date of the Certificates to the date of delivery. Any instrument issued pursuant to this resolution shall be a general obligation of the Town and the faith and credit of the Town are hereby pledged for the punctual payment of the principal of and interest on said obligations, and unless otherwise paid or payment provided for, and amount sufficient for such payment shall be inserted in the annual estimate and a tax sufficient to provide for the payment thereof shall be levied upon all the taxable property in the Town. On motion of Councilman Iateginniss, seconded by Councilman Bates, the foregoing resolution was adopted by the following vote : AYES: Supervisor McCulloch Councilmen Bates, Griffin, Mandeville , Meginniss NOES: None Following a lengthy discussion on the expenditures of the Town Welfare Department for relief purposes, it was unanimously agreed that there was nothing the Town Board could do to keep the expenses down. Charle s M. Baxter, Jr. , attorney, appeared on behalf of the Union Savings Bark of Westchester County to offer settlement of certain certiorari proceedings for the reduction of assessments . Following some discussion the members of the Board suggested that Mr. Baxter confer with Town Attorney Delius and Assessor Smith before presenting his offer for settlement to the Board. At 9:25 P.
