TOWN OF MAMARONECK, NEW YORK
HELD NOVEMBER 12, 1942
At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y.
The meeting was called to order by Supervisor McCulloch at
3 :30 P. M. (Eastern Tar Time) .
Present: Supervisor McCulloch
Councilmen Bates, Brewer, Griffin, Mandeville
Absent: None
The presence was also noted of Town Clerk Payne, Town Attor-
ney Delius, Comptroller Luceno and Town Engineer and Superintendent of
Highways Foote.
The Supervisor announced that the meeting was called to pre-
pare the preliminary budget for 1943, also to consider any other busi-
ness presented to the Board.
The Town Clerk reported that pursuant to requirements of the
Toiern Law all departments had filed their detailed estimates for the
1943 budget and further that copies had been presented to the members
of the Board on November 9, 1942.
The Supervisor and the members of the Board proceeded to
prepare the preliminary estimate.
A study was made of the estimates and the Board decided to
complete its work on the proposed budget for 1943 at the regular meet-
ing of the Board to be held November 18, 1942 .
The Supervisor asked if there was any other business to be
placed before the Board.
Councilman Mandeville stated that he had contacted the
attorney for the relator in certiorari proceedings to review the
assessment for the year 1941 on the so-called Park Plaza apartments,
in Larchmont Village, and that he was twilling to discontinue this
proceeding upon the assessment being reduced in the total amount of
$12, 500. He called attention to the fact that both the Assessor and
Attorney had previously recommended a reduction in this assessment,
upon the basis of an appraisal obtained by the Town Attorney.
Councilman Mandeville then introduced the following resolu-
tion which was seconded by Councilman Griffin:
WHEREAS, heretofore a writ of certiorari was ob-
tained by Arthur E. Muth Real Estate Management,
Inc . , owner of property described on the assess-
ment map and assessment roll of the Town of
Mamaroneck as Block 602, Parcel 791; and
WHEREAS, the Assessor and Board. of Review of the
Town of Mamaroneck duly filed returns to said writ,
and no further proceedings have been taken; and
WHEREAS, the Torun Attorney and Assessor recomimend to
this Board that the proceedings be settled and dis-
continued upon the reduction of the assessment for
the year 1941 (tax of 1942) as follows:

NOW, THEREFORE, BE IT
RESOLVED that the assessment for the year 1941 (tax
of 1942) upon property owned by Arthur E. Muth Real
Estate Management, Inc. and described upon the
assessment map and assessment roll of the Town of
Mamaroneck as Block 602, Parcel 791, be reduced as
follows:

provided that the certiorari now pending in the name
of Arthur E. Muth Real Estate Management, Inc. for
the year 1941 (tax of 1942) be discontinued without
costs to the Town of Mamaroneck.
FURTHER RESOLVED that the Town Attorney is hereby
authorized and directed to sign the necessary stipu-
lation to obtain an order of the Supreme Court pro-
viding for such reduction and the refund of excess
taxes paid, if any.
There being no further business the meeting adjourned at
6 :30 P. Y. to meet again on November 18, 1942, to complete its work
upon the budget estimate for 1943 .
